    To the people saying they announced themselves, he had less than 4 seconds to understand what he had just heard before he was shot. He didn’t even have time to put the gun down. Heck, he could have had it because he saw someone moving around outside his window.

At approximately 2:09 a.m., Officer Walker Prado observed through the sliding glass door that one of the male subjects, later identified as 31-year-old Avelino Medel II, was armed with a gun in his hand. Medel, with the gun in his hand, pointed in an upward direction, then walked towards the front door where officers announced themselves.
      It is not illegal ESPECIALLY in Texas to answer the door with a gun in your hand in your own home.

      And how would that change the outcome? There's a handful of other videos on this channel alone showing that opening your door to cops with a gun in hand has _always_ lead to an OIS. And it's _always_ for the same two reason at housing complexes: Either the officers are conducting an investigation and are greeted by these paranoid gun owners, or they're there to serve a warrant and end up in a gunfight with the wanted felons.

      Orders don't exist through walls and doors before visual identification is established. Dude was just checking his peep-hole while armed, as Americans do, to make sure there isn't an armed motorcycle gang or looters outside his door. A common criminal tactic is to bang on your door at night and shout "Austin Police, open up!"

    Someone knocks on your door in the night and shouts something you can't understand. You pick up your firearm and head towards the door. This is all normal, proper, and legal. The next moment someone, without warning, shoots you down through a window. That seems like excessive force.

      He’s walking to the door where he heard a voice just say they are police and open up. All attention on his front door to make sure it is police and not some random people. Then gets smoked immediately from an unseen shooter from through the window. Without a single command to drop the weapon. Yeah this is definitely a bad shot. If this was something that required any urgency, they wouldn’t have set up for a few minutes listening in. Officer Prado showed a total lack of control with his firearm.

    Reminds me of the lady that got shot walking in her living room with a gun in her hand...clearly no threat at that point in time, just cops shooting at a person with a gun in their hand, not to mention that it is perfectly legal (maybe not smart, but legal) to have a gun in your hand inside your house. I am all for PD handling business when guns are pulled on them...but it seems like people are getting shot or killed that could have been prevented.

    Why do people think "yelling police" is a magic word that means anyone in a home automatically just knows police are at the door.       The perp was already violating an ordinance with disturbing the peace and making verbal violent threats. So the police were well within their rights for surveillance within the domicile through the window. If the officer believed that the perp was pointing that weapon at him or was preparing to injure his fellow officers then he was well within his rights to employ lethal force. You may not like it, but these types of law enforcement statutes around the country have been upheld by the SCOTUS on more than one occasion.

He stayed inside his home and kept his weapon in high ready, pointed in a safe direction.       Not that easy. There are caps on how much you can get from a lawsuit against the government. In most places it’s around 200k. Subtract you lawyer fees and you be looking at around 140k. You could also sue the officer in civil court too. But, how much you think he will have. And, in this case he was not on the force long and most likely got fired after this event.

Cops run up announced while it is dark outside.. man in his own home responds to an unexpected noise at his door... armed, because you never know.. he gets blasted from the other side of windows that he cannot see out of, from cops who can see everything...     Cops set up an ambush for a noise complaint. Peeping in the window with cops banging flashlight on the front door. The man could say he had less than 3 seconds to react and got shot from the ambush before realizing what was going on.

      It’s not just a noise complaint. It sounded like some sort of domestic violence situation. Why would he come to the door with a gun? If he really felt he was in danger, he should have barricaded himself in a position of advantage, shut the lights off, and dialed 911. Even if it was an intruder, it makes no sense to confront them at the doorway. He knew it was the police, and he was going to shoot at them.

The difference between someone legally holding a gun and killing you with it is a matter of one second and a slight orientation change. Humans don't have perfect reactions or reaction times. Looks to be like it might be a technically bad shoot, but I think that the courts should take human ability into account.

      Yes, that knocking is necessary. It's called a "cop knock". The intention is to make it impossible, unless your deaf, to claim you never heard the knocking and get yout attention so you hear the shouting of "POLICE". The knock is supposed to wake the dead.

    Austin PD showed up guns drawn when i was carrying a gun (on hip in holster, and in a rifle case) to my vehicle. I was taken to the jail and released within 20 minutes at jail. I moved away a month ago because Austin is basically Cali at this point.

      The answer to your question is no. The officer doesn’t have to legally wait until he is looking down the barrel of a gun before he can shot a suspect. Each case is different and the officer will have to articulate why he used deadly force when he did. The officers actions will be judged by what any other reasonable officer would have done in the same situation. Hindsight (watching RUclips videos at home or playing Monday morning quarterback) is not the standard for judging how an officer should react.
