    Yesterday, January 16, 2025, a meeting of representatives of the Ministry of the Interior (MUP), the Croatian Employers' Association (HUP) and the Ministry of Labor, Pension System, Family and Social Policy (MROSP) was held at the premises of the Ministry of the Interior. Representatives of the Ministry of the Interior presented the differences in relation to the version of the Draft Final Proposal of the Act that the HUP received on December 21, 2024 and the latest version of the Draft Final Proposal of the Act, which is still in the finalization phase for the session of the Government of the Republic of Croatia. Although the HUP submitted a large number of proposed amendments and comments that were primarily aimed at improving or more appropriate solutions to the envisaged amendments, most of the proposals were not accepted (the complete statement of the HUP is attached). However, some of the more important proposals of the HUP were partially accepted and accepted, and the most important information is below:
    1) It will not be necessary to prove work experience or qualifications for simple occupations from the list of shortage occupations, the provision with this exemption has been amended, which takes into account the arguments of the HUP and regulates this new condition for issuing a residence and work permit in a more appropriate manner.
    2) The application of the new condition that the employer must not have serious violations from employment relations has been postponed until January 1, 2026, both due to the arguments of the HUP and due to the adjustment of the IT system to enable automatic receipt of confirmations that a specific employer does not have such violations.
    3) Regarding the labor market test and the new condition - adequate salary, the provision has been clarified and the salary for a specific or closest occupation will be compared, and not for the job position (data from Regos).
    4) Additional analyses are needed to regulate student visas, and this issue and the HUP proposals will be considered later, especially since new amendments to the Law on Foreigners are planned for the end of 2025 to align with EU regulations. The Ministry of Interior submitted the HUP's letter with proposals related to the introduction of student visas to the Ministry of Foreign Affairs, the Ministry of Social Affairs and the Ministry of Labour and Social Affairs, and held a meeting on the subject, at which all stakeholders involved welcomed the HUP's proposals and agreed that it was necessary for all departments involved to consider the current situation and prepare a kind of impact assessment. It was also mentioned at the meeting that it would be a good idea to continue holding regular meetings with social partners in order to monitor the implementation of the Law, including continuing cooperation on the topic of student visas and the internationalization of higher education.
    5) Accommodation conditions and blank promissory notes remain as planned despite numerous HUP proposals. The Ministry of Interior believes that employers must carry out better selection procedures when hiring foreign workers and that blank promissory notes demonstrate the seriousness and orderliness of the employer who hires foreign workers. In this context, representatives of the Ministry of Interior stated that they generally have a large number of problems in practice, which is why it is necessary to introduce order, and believe that employers must also assume some of the risk. For example, approximately 13,500 permits were issued for Bangladesh, and only 4,000 people had registered residence in Croatia. Therefore, a decision was made to stop further issuance of residence and work permits for Bangladeshi citizens. Furthermore, there are many difficulties with citizens of India, Pakistan, Uzbekistan and Egypt. The Ministry of Interior recommends that employers hire workers from countries that are more secure and where it is easier to obtain the necessary documentation, such as the Philippines or countries in the immediate vicinity and South America for which visas are not required. Also, the controls have placed a greater focus on taxi services, delivery (despite the establishment of the JEER system - Unified Electronic Work Records), as well as on worker accommodation, because this is where the biggest problems and abuses have been observed.
    It is anticipated that the Draft Final Proposal of the Act will be at the session of the Government of the Republic of Croatia in two weeks and that it will be finally adopted in the Parliament by the end of February, which means that the implementation of the amendments to the Act would be at the beginning of March 2025. After that, it was agreed to jointly monitor the implementation of the new amendments with the Ministry of Interior and the Ministry of Labor, as well as organize workshops by the Ministry of Interior for our members after the Act enters into force.
