Hello Sir, had few doubts. In the case-law of constructive notice that is Kotla vs ram Murthy, why did kotla loss the suit? as he did not sue the company but murthy personally. And in Rbb vs turquant case, how can he sue turqaunt as he is a liquidator and stranger to contract?
It is mentioned in The Chapter of Liquidation, Once a company gets in process of liquidation, it can't be sued can't sue, But the same by liquidator with approval of COC. 🙂👍
