  • New GST Rules - GST on rent of residential property has been introduced by the government, effective from 18th July 2022. In this video, we’ll talk about who has to pay GST on residential property, GST RCM, and who should register for GST in India.

    About the Video
    Under the new Goods and Services Tax - GST rules, effective from 18th July 2022, a tax of 18% is now applicable to rent on residential property. The tax will be charged as per the GST reverse charge mechanism (RCM), where the tenant will pay the liable GST. Previously, no GST was payable on residential property rent, only rent on commercial property was taxed. However, as per the latest GST notification from the government of India, tenants who are GST registered will be charged 18% GST on their rented residential property.
    As per the new GST rules 2022, it is not mandatory for the landlord to be GST registered, but the tenant of the residential property has to necessarily have GST registration. These rules will mostly affect companies who rent residential properties, like guest houses, for employees or for any other purpose, or small businesses operating from residences or house property. It will also affect business professionals carrying out their personal practice from rented residential property.

    Sir I am a businessmen having GSTIN in Delhi.
    I have a Commercial property in Haryana received rent 18L in FY 22-23
    Should i pay GST or i should wait for increasing the rent above threshold limit 20 Lakh for taking Registration in Haryana after that i will GST Please reply Sir🙏🙏

    But landlord gst regestered h aur mai gst regestred nhi hu.
    Kal unhone mujhe june se ab tak gst ka bill banake bhena hai. Bhai pls help me .
    And landlord inform me 5 days before.

    Sachinji you explain everything so well,even layman will understand very easily thanks for that,tell me if I have a Garrage and its rented out to a restaurant for its store room and income is say 9 lakes per annum and I am already paying TDS,and I have apartment which is rented out to private tenant and income is 12 lakhs so in that case total income is 21 lakhs ,will I be liable to pay GST in combined form.

    ▶️Renting of residential unit taxable only when it is rented to business entity
    ▶️No GST when it is rented to private person for personal use
    ▶️No GST even if proprietor or partner of firm rents residence for personal use
    Sir please explain rented to employees is taxable?

      But no gst on rent by him now he is exempt

    sir my old building was gone in redevelopment 5.years beforewe wear getting rent n now new flat is ready 8.months rent is pending n builder is saying we wil charge 18.per Get on your rent we wil cut 18.per Gst n we wil giv u 8.months rent. is OK what builder is saying..can u plz guide me.... thnk u

    Sir what if a landlord rents a residential property to an e-commerce seller who does business with less than 30 lacs annually from home and is registered under GST.
    Will that tenant be liable to pay gst on rent on rcm..

    I run a restaurant in a complex which is full of shops. There is no such space for owners to reside there. The property is registered as a residential property.
