My sibling refuses to move out after a year after the will states my mom wanted us to sell the house and split proceeds, she’s abusing the situation smh what can i do?
Unfortunately, you probable need to hire an attorney to start legal action to have her removed. Depending on what state you live in, there are different processes for this. A local attorney can help you understand how to move forward. All the best!
Hi I have a question I know 9 siblings who inherited a house. 8 wanted to sell and one of the sibling decided to purchase it from them. They agreed on a price . The sibling payed them in cash . Then the money was divided among all 9 of them. Please help me understand how that works. I thought the sibling that purchases the house doesn’t get any of the proceeds. Your explanation will be greatly appreciated.
@@anagiraldo924sounds to me like they split the value of the property in 9 ways. They wouldn't split the value in 8 ways. Imagine if there was 2 siblings. 1 sibling would pay 1/2 of the value of the whole house not 2/2 of the value. Does that help you?
My sibling moved two of her unemployed sons into my late dad's two small houses then refused to sell either house. She claimed thats what my dad wanted but the trust has she and I as 50-50 heirs. Huge mess. $25,000 in lawyer fees to force the sale of the houses. They all hate me for not allowing them to squat. What was I supposed to do? I let them live there for almost two years :(
Charge them rent at market rate for their stay. You’ll get50% of that off your sisters half. That’s what I did when my bro refused to move out mums house. My solicitor is arranging it with the new administrator.
Our sibling cost the estate a Million Litigation after changing the documents so you did right our family was ruined so we recommend the NICER Forgery Proof Inheritance Network Latin Law Model interdiction Trust Administration.
I have 5 siblings when my father passed away he left his house to me only, my siblings tried to go behind my back to obtain the property while I was out of state on vacation. I am not exactly sure what steps they took however, whatever they did not work. I did not immediately go to city hall to register the will however, when I heard that they were up to something I immediately registered the will. It’s hurtful that we are going through this but I expected it.
I just lost a sister who never got married or had children. My sister didn’t have a will either. There were 6 other siblings still alive and not one of them attempted to sort, pack and dispose a darn thing in her house. I was the one that stepped up and did the emotional work that had to be done. I don’t think it’s a red flag if someone steps up to do the work.
What if your sibling refuses to decide on selling the home or renting for 6 yrs. I don't want to live there in the house. She's out of state. I've gotten married 6 months ago 0& moved with my wife. My wife and I want to buy a house together and I want to get FHA. But this situation is hendering my progress.
My sister bought my Dads house while he is still alive for about R800K less than market value and offered me R30k for my willed 50%. House bought by her husband and cant be registered at deeds office 50% on my name. Now we live on a farm that is also owned by my Dad and he wants to leave 50% of this property to my sister after l have spent over R400k on betterments. I don't feel that is justified. Im carrying utilities and taxes for over 3 years now and my sister will be entitled to 50% of everything i have done here. What is your advice ? Thank you.
There are a lot of moving parts to this question and It's a bit hard for me to understand. It also sounds like you may be in a different country and I may not have the understanding of the laws there. I would create a new contract referencing what you put into the property over the years you live there and maybe changing the share more like 60-40 or 70-30 so it's not 50-50. I would recommend talking to a local attorney. Get things in writing! All the best to you.
Brither is trying to take everything and put me and my ither brother in the streets and suffer its 4 of us all boys what can i do He cut the Power off today'!...
oh wow...I'm so sorry. I would definitely talk to an attorney. Are you living in an inherited property? If you are all equal beneficiaries I would recommend selling the house and splitting the proceeds or buying that brother out of the ownership if you and the one brother want to stay. Sorry your're going through this.
