Still waiting for an approval, decided to not take a section 32 settlement may be a mistake but the treating doctor said I need surgery. Hope you are on the road to healing. Had an acdf back in 2014 took a while but made it to be able to work, but was injured on the job recently and things are up in the air.
Rear-ended by a drunk driver in a company vehicle Northern California Bay area. Silicon valley to be exact. Leading to a double disectomy. What do you think my cases worth and is a double discectomy worth more than the regular disectomy?
It’s always hard to predict based only a comment but generally discectomy after a Rearended crash can be 6-7 figures. Yes a double surgery for two levels is more invasive and has greater damages therefore more compensation. Good luck
Great video. I got a chair massage that lead to cervical disc replacement surgery in September 2018. The surgery did not go well and the discs moved leading to a fusion surgery last month. The first surgeon was terrible with his follow up. I would like to see if I have a case. Thoughts?
Yes definitely. Just need to claim aggravation and exacerbation of the prior injury. Many people have injuries that don’t give them symptoms. Some live with herniations and don’t even know about it. But the accident causing need for surgery is life changing and that’s where the damages and case value come from.
Hi again , so last Monday I had single lvl. alif 360 and because of bad peticale screw positions they had to do a second surgery on sat to change two screws again and I was in the hospital 8 days total.. Does the fact that I had a second surgery in the same week make my case even harder or better for my lawyers?.this is a open workers comp construction case from an accident in Manhattan 4 years ago
Hi. Sorry to hear that. Hope you are doing better. Yes a second surgery definitely increases the overall damages and case value. Complications after surgery are foreseeable and what the law calls natural sequelae of injury. If you have a third party injury lawsuit for the workers comp under New York labor law (construction) it should be a very strong case.
I had a disc to rupture. I had a lumbar fusion done on my lower back. A year later I had to have surgery again because the fusion didn't heal correctly. After the second fusion 2 days later I suffered severe burning in my legs. I was left with severe nerve damage in my left leg and foot. Now I have drop foot which requires me to have to wear an AFO for the rest of my life. I've had a total of 5 back surgeries. Four in lower back and last one at the top. I was not hurt in accident or on the job. Is there anything that can be done?
Great Videos I have a question if WC is covering all the medical bills and surgery for a Xlif Spinal Fusion will there still be a settlement after surgery and return to work?
Yes. If you have a third party lawsuit that’s separate from WC. Even if you don’t have a third party action, you can obtain a section 32 settlement with Wc in New York.
Workers comp cases in New York settle under section 32. So essentially they stop the biweekly smaller payments and pay out a larger lump sum all at once. Best to consult with a workers comp attorney as our firm litigated their third party personal injury lawsuits.
I have a few questions about this type of surgery, I was in an accident with a vehicle who hit my car last year in December, I went through all possible treatment as far as physical therapy and injections, which was 2 sets. I got recommended for 2 level disc replacement (L4, L5 an S1). My Medicaid approved for single level an won't approve 2nd level. My options are limited at this point. Except for the fusion surgery 😭😭. I do know that the person who hit my car has a 500k dollar policy, an own numerous of businesses, there are "preexisting conditions from about 7yrs ago from a work related injury, I was told that the insurance company questioned that, an I was told that the MRI wasn't identical to previous MRI. So if I do go ahead and get the surgery is this a likely opportunity for a big settlement? or what's the likelihood of less settlement if I don't get the surgery but my doctor's recommend it? BTW this accident happened in Las Vegas
Hello, how much do you think my case will settle for. I was rear ended at a red light complete stop by a 16 year old girl texting in her dads truck. They took full liability. Problem is we both have the same insurance. I had L4,5 laminotomy with rhizotomy. Also they have a $250k policy limit. This is California btw. I’m worried because all my medical bills are gonna eat up my settlement if all I receive is the policy limit I’ll probably be left with $5.
I got no fault accident with truck. I shoulder and acdf neck surgeries. After surgery almost 2and half years i m waiting for settlement. Ef i want to chage my attoreny how can i do it

In New York a micro is worth substantial amounts. We have settled percutaneous discectomy procedures with a Stryker decompressor from 200k-550k. A micro is a step above that so I would say the value could approach 1 million if it’s worked up and prepped correctly.
