The petitioners, inter alia, challenged the provisions of
Sub-Rule (2) of Rule 11.1 of the Punjab Civil Services Rules, Volume II
(Annexure P-2), and seek restoration of the commuted portion of pension
after a period of 15 years instead of 11.5 years.
Counsel for the petitioners also contends that recovery of the
commuted portion of pension appears to be in excess of what is actually
legally due to the respondents, which finds mention in Para 4 of the Writ
Petition.
Notice of motion.
Ms. Deepali Puri, Addl. A.G., Punjab, accepts notice on behalf
of respondents-State and seeks time to file reply to the Writ Petition.
At her request, adjourned to 21.08.2023.
Let the reply be filed on or before the next date of hearing after

Ye commutation act to sabhi par ek jaisa lagu hoga chahe koi initiate kare ya na kare it's a dutyof govt to regulate same rule for each employees / retirees .

Court ka faisla to sabhi pe equally implement hona chahiye. Govt rules mei partiality nhi ho sakti.very good initiative. Sir 18 months ke DA ke arrear ka writ bhi court mei pending hai uska status bhi update kijiye pl.csn we central govt employees hope for refund of same by govt.
Why next date of hearing after four months. The honorable justice is requested to dispose off the case on next date of hearing in favour of poor pensioners.

ਚੰਗੀ ਜਾਣਕਾਰੀ ਹੈ, C.W.P 2271 of 2024 ਜਿਸ ਵਿੱਚ ਮਾਨਯੋਗ ਪੰਜਾਬ ਐਂਡ ਹਰਿਆਣਾ ਹਾਈ ਕੋਰਟ ਵੱਲੋਂ ਆਪਣੀ ਹਦਾਇਤ ਵਿੱਚ ਤਿੰਨ ਮਹੀਨੇ/ ਤਿੰਨ ਹਫਤੇ ਅੰਦਰ ਸਪੀਕਿੰਗ ਆਰਡਰ ਲਈ ਸਮਾਂ ਦਿੱਤਾ ਸੀ । ਮਿਤੀ 02/02/2024 ਤੋ ਬਾਅਦ 01/05/2024 ਜਣੀ ਕਿ ਤਿੰਨ ਮਹੀਨੇ ਹੋ ਜਾਣਗੇ, ਕਿ ਇਸ ਤੋਂ ਬਾਅਦ ਮਾਨਯੋਗ ਹਾਈ ਕੋਰਟ ਦੇ ਫੈਸਲੇ/ ਡਾਇਰੈਕਸਨ ਨੂੰ ਲਾਗੂ ਨਹੀਂ ਕੀਤਾ ।ਕਿਰਪਾ ਕਰਕੇ ਦੱਸਿਆ ਜਾਵੇ,ਕਿ ਕੀ ਕੀਤਾ ਜਾਵੇ ਜੀ ।

There are pensioners whose recovery was done till 17 years like me. We was superanuated in March 2007 and my recovery for commutation was done till December 24. Please be advised if I can file a case for refund of my money recovered from me for such a long period.

i retired on 31st may 2007 on 1st june 2022 they must restore commuted portion but un fortunately it will continue till November 2024 Rationale of undue recovery is not sufficiently explained .Probably banks want to make govt servants scape goats for their NPA. . But it is also true that pensioners are living on pension given by Govts. God save Indian pensioners!

Why not transfer all similar cases pending in different high courts to Hon'ble Supreme Court for a common decision which will be applicable to all retired Central, State government employees and also to all Central and State Public Sector Retirees also.

This is centralised issue of all veterans sir. Individual can not approach for court one by one. Govt will act upon Court verdict. Suitable step must be taken by SPARSH to refund excess recovery of amount for more than 10 years 8 months. Tq sir
