Considering I'm struggling to be allowed to even enter for a holiday because of a 25 year old cannabis fine. So how the hell did he not get deported.

I could be wrong but I don't recall OIJ livestreaming in an establishment or business, in regards to his videos, he doesn't really act out or is obnoxious. I'm sure he knows the culture or etiquette ie: respectfully asking permission, etc.

To parts of the internet maybe. However Japan has to worry about how this will be covered by regular international news & media. How they treat foreign nationals in their legal system matters on a much larger scale then just dealing with clout chasers. Maximum sentences for technical first offence, to what many consider minor crime doesn't look good. Even though it's justly deserved, it's a PR nightmare either way.

I mean, there is only so much things they can do. It isnt like the crimes he did commit were super wild or anything, The punishment has to fit the crime and all that. He is super annoying but that doesnt mean you can just give him a heightened punishment.
Although the legal punishment is absolutely laughable, the fact that his trial was handled in a way that left him detained for months, rather than the 23 day limit, leads me to believe they wanted that to serve as their main warning against future offense.
A "minor inconvenience" should already stop a bunch without opening that can of worm of "Japanese law and prison is inhumane and unfair towards foreigners" which might make things worse afterwards.
The last thing anyone wants is getting people like Johnny Somali being an "activist" (whether in background or not) that hijacks (maybe) real issues within Japanese government and tries to "liberate Japan".
A lighter sentence saves Japan money, shows that they care about context (Johnny Somali had "first offense" as far as law is concerned), shows that they aren't cave in to random online backlashes, and also delivers the message outside prison time through the detention loops and that Johnny Somali had to declare "I was a PoS that harasses random people as a tourist" every single time he enter another country when he gets asked "have you ever committed a crime in or any other countries?".

To give them the benefit of the doubt, the judge probably considered his incarceration as the real punishment for the crime with the fine being symbolic.
Also I doubt that he will ever be allowed to reenter Japan and at this point he has vastly exceeded his visa if he entered as a tourist so he will have to leave soon or be arrested again.

@@Kometheus Depends on if it gets to trial or not. If a case gets as far as the courtroom, the chance of getting an innocent ruling plummets (which is where the conviction rate stat comes from, I think). I imagine the cases where people get away with stuff didn't make it to the courtroom.

I was always told to be a good person, cause bad things happen to bad people. Yet time and time again I see scumbags getting away with the crap they pull. Don't get me wrong, I rather be a good person, but my gods A'holes keep getting away with being A'holes, while good people get punished all the time and have to work hard to remain a good person.

It sucks and it's very VERY discouraging. These people deserve to be held accountable and if not in the legal way then may they receive the inconvenience, hurt, or pain they give out to the world. Sometimes though they not only get away with things but seem to keep being successful. But still, let's keep trying to be the good that this world and those who are weak need because there will always be assholes and nothing will stop them from doing what they want.

I suspect, thinking about it, this might be a tactical play - I don't know if it's the case in Japan but there's examples in UK of judges having either an excessively light or excessively harsh touch in sentencing in order to promote a larger legal change. I've seen hints about a full ban on IRL streaming in Japan, one possible interpretation of this judgement could therefore be: "look, we're powerless to control these streamers, we need to push through this ban to have the powers we need!"
Crazy part is he blatantly lied in court saying he had no control over his system streaming, and had no way to turn it off (ummm, an IRL streamer who supposedly doesn't know how to start or start his 'donation' links speakers, or even how to turn off their stream?).... They also ignored where he threatened to hurt Japanese residents if they try stopping him, and even (right on his own stream) said he would physically retaliate and hurt the police if they tried stopping him or touching him... and they also ignored all his other recorded and streamed (evidence) where he repeatedly stated that he owned the Japanese and they can't stop him... and even more bizarrely, the court didn't even seem to take notice that even after his pretend Apology on stream [when some possibly 'Yakuza' members demanded; he then immediately (once they left) went right back to streaming, and saying the Japanese were stupid if they actually believed his apology, and that he's just using that as more "content" to get more views and clout...
They even ignored his other videos -- e.g. from Thailand, where he tried to interrupt the stoppage of some other criminal actions taking place (by another Nuisance Content Instigator IRL Streamer) and falsely tried representing himself as the defendants' Lawyer and legal representative (in order to get access to record and stream the Police investigation against them)... And he had months and months of evidence of his multiple offences through all his streams, so they should have at lease kept placing another charge upon each release [rather than only using that allowed tactic once]
Sadly, it's the legit live streamers (e.g. those promoting Japan itself) are the ones the citizens are now starting to look at suspiciously, and likewise for all foreigners visiting who many Japanese will automatically be thought of as 'more foreign troublemakers)... It's the legit streamers paying the consequences for the Nuisance IRL Streamers while they profit from destroying the reputation of legit streamers.
QUESTION: these Harmful IRL streamers [HIRL -- pronounced "hurl"-- in order to separate them from the legit IRL streamers] seem to go around under the pretense that they have full authority to break the laws of the various Countries and to do/say/record anything they want because that's their "job"... so the question is, do they even have authorized Work Visas [in which they would have to declare their supposed Employer that is responsible for their actions]; because otherwise they're "working" without a Work Visa.
Additionally, if Kick (for Example) is compensating them to provide these streams [and are technically their employer if the individual(s) are contracted and paid through that streaming service to provide that content; then legally the authorities could hold Kick and any of its paid HIRLs actionable with these intentional nuisance stream creations, working in the country without authorization, and criminal activities (which, in truth, are also being committed on behalf of their Kick employer]
Additionally: the "promise to never stream again" -- well, there have already been talks for him to join other HIRLs in Thailand, and you can bet he'll say something like: (1) that only applied to streaming in Japan, or (2) that only applied to streaming in Japan during that visit/stay, or (3) that only applied to my current streaming account and/or name, or (4) that doesn't mean I can't appear on other HIRL streams and have them financially compensate/pay me to participate on 'Their' live HIRL streams... and what stops him from just changing his real name to do it all again

02:30 - No, he wasn't arrested in that restaurant in September 12th, he was arrested 9 days later with an arrest warrant due to a another infraction he made two weeks before the restaurant incident, he entered in a construction site of a hotel that was being under renovation, that was the reason why he got arrested in September 21th and he even recorded his own arrest because he started that day his live stream saying that he was followed by a police officer, and then after getting out of a combini he was intercepted by 5 police officers and then after, a little van arrived with more police... But this time it was police inspectors... And when I saw those inspectors showing their badge and I noticed the papers he had on his hand I realized: "he has a arrest warrant", Salami tried to show that he was in control but I noticed that he was becoming very nervous and he realized that he was in trouble to the point declare to the mods to call the embassy (the embassy will not give a damn for him!!!).
So Joey, you got the wrong info ,the restaurant accusation came 3 weeks later and it was also to prolong his detention until they had a solid case, but it seems that they didn't build that of a solid case, they could had accused him of a lot of sh*t he did during his streams...

@@Pepe-dq2ib I've talked to someone who spent time in a Japanese prison and it is a pretty bleak situation. He started smoking so that he would get a break out of his cell. 3 months in those conditions is pretty fair for his crime, I would say.

Agree. During that time he could not "stream". Had to think if he does this again.. the same consequences... another 3 months for trial. To me 3 months of not being "free" easily surpasses $1500. Imagine being in a cell. 3 Times a day for meals. Regimented activities. No TV. No internet. No Phone. No communication to anyone other than your cell mates and guards.
I can understand why. They're people who judge and enforce the laws, so they have to follow it properly. They can't arbitrarily give out heavy sentences because of their feeling. When was the last time you hear someone getting jailed and deported over playing loud music and being a nuisance?
So probably what they did prolonging the case for as long as possible and keeping that pos detained for awhile was the best they could do.
You are absolutely right, a country that respects human dignity and human freedom does not give extensive jail time to essentially "non-violent" petty crime. Even if it is many cases, these are still non-violent petty crimes that I think he was appropriately punished for by having to wait in jail for months.
I would like to see his accomplices face punishment also. He would not have done this streak of criminal nuisance behavior if he could not have profited off of it so easily. The streaming corporations need to face penalties.

Yes, people have received harsher sentences for public nuisance, but at the same time, we’ve been having an upsurge in violent crime and repeat offenders getting no charges or even incarceration into local jails because of a number of reasons. Race, terrible attorneys, financial/capacity, it goes on. But this is a far greater punishment than he’d be likely to face in the US.
The very fact they actually decided fine Johnny is already an order of magnitude above what he would have received in the US, let alone deport and bar him from the country.
As a fellow American I can say that if he did what he did in america the authorities would be the least of his problems cus he would've been jumped on that train or soon after without doubt

9:30 I'd disagree that the sentence would be any different in the US. Public nuisance laws do exist here and are considered a misdemeanor. A minor crime. Generally, the punishments range from a fine to at most a few month prison/probation.
Considering this crime of being a public nuisance and it is only THIS crime on trial, I am not surprised that it is only a fine. Had he been charged with all the other **** he did, then I would have expected either a larger fine or jail time. The court could only look at this crime in isolation, because the other activities have not been charged and there is no "legal" record of them.

Yes it's frustrating, but understandable. He comes from a protected species. If he had been seriously punished, Japan risked being accused of discrimination or even worse, genocide !
He is being deported from Japan for violating his tourist visa. On top of that, he has an arrest record. If he were to fly into Japan again, and he lies on the customs form about not being arrested, he's going to automatically get flown back out of Japan at his own expense. If he tells the truth about being arrested, there will be an investigation by the customs officers, and it will be up to customs if he will be allowed to visit Japan. They can make any decision they want, if they don't like him, they can send him back.
The consequences were definitely lenient given the disruptive and disrespectful behavior exhibited by the streamer. A clear lesson must be taught to avoid a repeat of this kind of behavior.

In the case of the presented crime, the fine is honestly enough. I 100% agree that the prosecutor should have brought forth past crimes. Even if no one charges him individually, there's definitely some possibility that prefectural entities would have pressed charges if presented with the available evidence. As someone who hates over criminalizing misdemeanors, this is the best way things could have gone.
My understanding was that the time he was in jail forced him to overstay his Visa.
And now he has to leave Japan.
And it is very hard to get back into a country with an overstay on your Visa.
It makes more sense for the Japanese Legal System to get rid of him forever.

Within the United States, there is this thing called an "amicus curiae" brief, which means "friend-of-the-court". It is legal brief created by individuals or groups that are not involved in a legal case, but have expertise that could be very beneficial to assist the court in making its decision. This is usually done in an appellate court and not a trial court.
I do not know how the Japanese legal system works. I do not know if there is a similar feature within Japanese courts. If there is, it may be VERY worthwhile to take advantage of it in the future. There are plenty of content creators living within or traveling to Japan that are respectful, and whose careers heavily rely on setting a legal precedent of harsh and severe punishment for future instances like what occurred with Johnny Somali. If those content creators formed a collective body and hired a legal representative to write something similar to an amicus brief (or provide expertise on the streaming space to ensure that the court is well informed on how much money someone like Johnny Somali made on the abuse of Japanese citizens and culture, as well as how much control a content creator has over what they are doing).
This will absolutely happen again, and people who stream and record videos IRL in Japan have a lot on the line. Making a solid effort to protect their own interests by lobbying, providing expertise, or whatever they can do is massively important in ensuring this doesn't destroy people's livelihoods and enable this behavior going forward.
I kind of understand that they don't want to throw him into jail over it, but yeah, the fine is so low that it doesn't really serve as much of a deterrent.
Then again, I guess he has been locked up a few months since he was arrested by now? That time might be a better deterrent than the fine.

To say he didn't get any jail time would be inaccurate as he spent like 3 or 4 months in jail as he was being charged with the crime so essentially it's more like 3 or 4 months plus a ~$1500 fine.

Did you really expect him to go to prison for years ? He is a nuisance but he didn't actually commit any serious crime. Chances are is he going to get punched in the face if he goes back to doing it since everyone in Japan knows him now.
Do you even know the laws in Japan? If a normal Japanese citizen were to do the same exact things Mr. Somali did, they'd go to prison for a long time. Trespassing is actually a pretty big deal in japan and it's a crime that could give you a couple years in prison.

Johnny walked through an open entrance in broad daylight and was only on site for about 60 seconds, not really enough to convict someone of. A demented old Japanese lady could do the exact same thing and get no consequence despite it still being considered trespassing.

He actually got it worse in Japan than if he were arrested in the U.S. Remember that Japanese police have the ability to detain someone for 28 days without pressing charges, and then add another 28 days on a whim after the first period expires by adding another charge. This is what happened to Johnny. US police are not allowed to do this as it’s deemed unconstitutional. Johnny’s misdemeanor crime would not have resulted in prison time in Japan or the U.S. from a judge. But thanks to the controversial flexibility that’s been granted to Japanese police, Johnny did get prison time for months with no outside contact - something unimaginable in the West.
Japan is a free democratic country. I DO NOT condone his behavior but unfortunately, being free to make dumb choices is allowed for everyone. Japan would have to change their laws if they want his type of actions to stop.

A restaurant is not "in public" though. Trespassing can get you some jail time in the US.

As much as I hate this dude, you have to be realistic in what you're talking about here, it's not like public nuisance is a major crime and deserves actual jail time. And as far as the actual sum of the fine goes, 1500 usd is not pocket change for most people, and even for those who won't have any issues in paying a fine of that size, it's still an inconvenience to your everyday life to suddenly be 1500 short. I wouldn't be surprised if this sentence will set a precedence for any future sentencing of similar cases, so unless you want every streamer in Japan to run the risk of facing even larger fines if they accidentally are found to be a public nuisance and get the police called on them, I would be content with this current outcome and hope that it will be enough for this idiot to realize he should move along somewhere else before he actually get into real trouble.

4 months jail time (basically a 4 months ban from streaming), 200000 yen fine, deportation, 5 year entry ban due to overstaying his visa, and a criminal record under his name (high chance of denied future entry) is pretty good as far as punishments go.
