Hi Shivani, My company is not giving me bonus, they are saying that an employee has to present as and employee till April month salary pay out. I have resigned recently and my last day is 31.03.2023. to get the bonus for the financial year jan-dec2022, employee should be there till April month salary pay out. In my contract it's written as company discretion and also it is mentioned as Pro rata basis. But no where it is mentioned that employee has to wait till April pay out
It statutory oblingation of company to pay bonus except in the case it is making loss since 5 year of it's incorporation. And u must have worked for not less than 30 working days in a accounting year.. U have right to raise your objection and take a legal action if company default in making payment
in the case law Pandian Railway corporation Limited Madurai v. Presiding officer, labour court . While searching I have found 2 views in it- 1. That the right of management to forfeit bonus on the ground of misconduct shall be only with reference to the accounting year. 2. That if an employee is dismissed from service, he is disqualified from receiving bonus under the act and not just for accounting year. Mam, kindly guide on which view was upheld? @CA Shivangi Agarwal
