A powerful, anime focused text-to-image model belonging to NovelAI (novelai.net/) was leaked on October 6 2022. AUTOMATIC1111, a prominent Stable Diffusion community member made it easier for people to use the leaked code, and was banned from the highly active Stable Diffusion discord as well as some other associated discords on October the 8th. We interviewed AUTOMATIC1111 to get his side of the story.
There is a lot of discussion at the moment over whether the ban was warranted, but in my opinion there were sound business reasons behind it and AUTOMATIC1111 doesn't seem overly concerned with his being banned in any case.
Immense thanks to PeePa for doing like most of the research. He did not write the script all the opinions expressed here are my own so please yell at me and not him if you think this video is bad.

I don't know man. AI that strips the illustrators' artworks with no regards for intellectual property doesn't make it easy for people to feel bad when that AI is stripped from the company's database and people download it with no regards for intellectual property.

*_Three things I learned from this drama:_*
*1:* AI code that took about a day to create with hired engineers that will never be recognized for the work is under copyright for the company. As if _they_ made it.
*2:* AI artwork that takes an artist a full day to make after iterations, prompt manipulations, In-Painting, and they still can't copyrighted their work....
*3:* That I could care less about "their" code being "stolen" because 1 + 2 = 3.
If the engineers and artists wants to copyright their work, why don't they start a company?
@@frankkong3235 a crazy idea right? Realistically though, it would have been far harder for a bunch of broke/unfunded artists/programmers to start a company on their own (though still possible with collbarative individuals and strong spending discipline).

This may be an unpopular opinion but I want all boobies to be free. NovelAI not being open source kept a lot of boobies trapped. However if they never had a financial incentive to make NovelAI in the first place. We would not have had any of these boobies. They gave birth to a whole new world of boobies. But as soon as your do create them you have responsibility to set them free. They can keep there subscription plan for those people who don't have powerful enough PC to run NOVELAI Diffusion. Or for those who don't understand how to setup there own AI etc. And even SD has it's own site still. So it appears as though a lot of people still pay for access. But I believe they should have planned for it to be open source from the start. lol Maybe after 1-2 years to regain the cost of development etc. But I feel like it being leaked is justice. I know that sounds bad. But when I think of the poor confined boobies I just weep.
And when it's open source it's more customize-able, it's more untapped and free. It's the #1 anime style AI out there. Dalle 2, MJ, Waifu Diffusion and SD all seem to be worse in my opinion. However some of those have a few pros that NovelAI may not have. However in the grand scheme of things only Waifu Diffusion holds up at all.
The next model the planned 14-16GB VRAM SD Model. I want to see what people can do to train it on anime. I wonder if the already existing crack of Novel AI can be used at all in the next SD Release? lol If not we need NovelAI to re-develop a new model. Maybe they can host like a gofundme or something and when the goal is reached they develop an open source NOVELAI Diffusion 2.0. I do not expect this to happen. However if they try to make another inhouse only model I want it leaked too. But I would pay over $100 towards funding an even better model if it's open source. I'm about to buy a 4080 16GB. Lets hope the next SD model works with 16GB or less. If not it will be years before I have over 16GB VRAM.

They used freely available code to train a model on images they didn't have the rights to. Nothing about it is "proprietary" no matter how many people like you make excuses

Thanks for taking the time to put this together... WI saw bits n pieces on reddit / discord and wandered what the heck was going on. This was a gret non-biased explanation.
I hate submitting to whataboutism, buuuuuut... if there's any credence to the claims about NovelAI's exploits (i.e. ignoring Danbooru artists' requests to opt out of their models and even going as far as scraping exclusive, copyrighted Patreon content (which has to be illegal...?)), the widespread user support for AUTOMATIC1111 goes further than him simply being a renegade underdog.
If I ever get serious enough to graduate from using Colabs, I'm leaning more towards using his repo (sans any leaked code). Again, if the claims are true, NovelAI only care about their bottom line and will happily breach the copyright of individual, not-wealthy artists to do so.
I 100% CANNOT speak for NovelAI, perhaps they're a bunch of wankers, but they HAVE to make a huge show of force right now or nobody is going to take them seriously and that could put them at risk.
As a company who just had a serious leak they're basically forced to come out swinging to preserve themselves.

Their model is fully trained on scraped data from Danbooru with a ton of exclusive content that others uploaded there, no opt-out system or any way of checking if your art has been used. So their model is trained on data they don't have rights or license for using, which in the industry means you can't commercialize the trained models since you need full license on the data, but since it's so many small artists they can't easily do any lawsuit either regarding it.
Listen everyone is complaining about people using copyrighted work. Caring about the bottom line. How NOVELAI deserved this because of how all AI's steal from original artists etc. Here is how I feel. I respect original artists. Real art is amazing. AI is nearly as amazing at times. But it's different. I like anyone who tries to expand AI Art development. That goes for the main steams developers like Team MJ etc, that goes for Team NOVELAI directly. And that goes fort he people who stole the NOVELAI Model and leaked it. I like them all. I want AI to advance and I'm willing to look past anything shady involved. If I was an artist I would let them use my art. I will even pay to support development. Closed or open source but open source is way better.
It's the path to the future I say. And even more importantly I think about all the boobies! Unlimited boobies... When AI art is dragged into the courtroom. Whoever is arguing on the side of AI. Be it an individual who used the art and is somehow being sued for it. Or maybe it will be the AI company itself like MJ or SD being sued by like a stock photo company. Who knows Lawsuit dismissed.

Either way, hypernetworks seem very promising, the new update on Automatic1111's webui allows you to train the model with your own images (different from dreambooth or textual inversion style training). So it's progress nevertheless, I wonder if it would have been kept under the rug otherwise only to profit from. Cause there will be closed source technologies related to this which we will have to pay for, which would in turn hinder the progress of the open source free market.

No, AUTOMATIC1111 did not leak the code, he just implemented the new information. If AUTOMATIC1111 had made available, the model trained by NovelAI then he could be held accountable.
The problem is the training data that got leaked, and that is the most of the hard work NovelAI did. You can use the trained model with, or without, Automatic's implementations.
I completely understand the frustration of NovelAI, but they hit on the wrong target, the one that leaked the code is who they should go after.

I find it ironic that they are this protective of their code but have zero qualms with stealing artists artwork without credit, without asking for use rights, and even so much now people can steal artists styles to make their AI art. While granted I don't think anyone should steal code, the elephant in the room is still there. I think all of this just proves that AI will eventually take over everything, including proprietary code. Like they tell artist like myself now, AI art tools are here to stay. I either adapt or get left behind. Code will be the same. Can't wait for copyright laws and patent laws to get updated to protect these large corporations from losing their proprietary code. Who cares about the little guy right? Governments won't be able to keep up IMO.
It's normal if you think about it a bit, people are not interested in the work of others but when they play theirs uff. For me, let them filter everything they can from these shits that used content that did not belong to them without any consent
Screw NovelAI, screw Satbilty AI. I cannot care less for them. It is AUTOMATIC that made possible I can run SD on my machine. He is a sort of the Morpheus figure in this regard - and of course the corpoarte "agents" are after him - no matter if he did or did not anything. For me he is the Name behind the open source use of this AI. God bless him. Long live the king!
Don't screw Stability AI, they're the ones who created Stable Diffusion and also made it possible to run on your machine - you just had to be a programmer to use it pretty much. AUTOMATIC1111 made it easy for people to use by creating the WebUI. I have no idea why NovelAI are going after him instead of the people who actually leaked their model.

And given that, using the Matrix analogy, you dont give any credit to people or machines who created the Matrix, because true heroes are the people who cracked it free from control of machines (symbolically Stability AI or any corporate artificial authority or entity).

Do any one of us have the right to complain. Last I checked these ai models are trained of other peoples hard work, who are not happy about it. I dont think automatic should be punished if there are certain conditions....
Was this hyper thing something that people were eventually gonna learn about from starry ai or was it patented to stable or Nobel ai. Unless its patented code or tech, it's no one but novel ai fault for loosing there edge, in this fast developing space
It sucks there code got leaked, but everyone involved in ai art is using stolen workn(sorry I dont mean to sound harsh using stolen, just getting my point across) and nothing goes back to the creators just they used to train their models.

I don't plan on using the leaked NovelAI models; but the way they've been treating Automatic pushes me away from giving them any money.
Even if it turns out Automatic did cross some line according to fine-print in copyright laws or whatever, which I'm not convinced he did; there's a big difference between what a company is legally allowed to do, and what they should do to not look like assholes.

Honestly speaking, both of what novelai and AUTOMATIC1111 do is pretty dubious. But I support AUTOMATIC1111 far more because at least they stand true by their morals and don't pretend like they're morally superior while pulling strings behind peoples back.

that seems like such an extreme, viewpoint, the people at NovelAI are probably under a lot of pressure to put up a good show of force, and they're mostly not doing anything untoward as far as I can see.
@@lewingtonn NovelAI is practically hated by the entire artist community for using ripped / scraped data for their model and trying to commercialize it heavily after the big hype of A.I art. No opt-outs, no way of seeing if they used your art specifically, not having any license or rights to the data which means the model can't be commercialized... NovelAI basically begged for this to happen.

They weren't informed, no opt-out, no credit and it's not even open source but a paid service trained on their leaked artworks. Of course they're furious about them

@@Bloom_HD I'm not sure how much room I would have to communicate any info about finding magnet links for the novelai leak on google if I wanted to (which I don't because that would be illegal). If you're curious about sizes, from what I've read, the first that came out was was about 52GiB, and pt2 of the novelai leak which supposedly has the text models and some other code and stuff, was something like about 124GiB; doesn't look like people care much about pt2. Not sure what else I would be allowed to say.

3:56 not that big of a deal... look was this leak "legal" if your business model was based around the public paying you to use Ai gen services it was a bad business model sure maybe it's entertaining at this point in history but it's new. More likely any business model was based around commerical use, companies and business will still pay some one to legitimize the image use. now that does not mean they will not just pay plusable denyable "artist" that uses the illegal ai for insperation. note all of these companies thought they would be the death of freelancers artist now they are up set when a leak means the freelancers artist will replace them. making their reseach companies only get as big or last only as long as their first ideological/disgruntled employee. small lean start ups that will not take over the world but only fill a niche, that's the new landscape.
I think the guy was normal. He did not spread the code, just added code that helps running ANYTHING that uses the same tech - including the leaked stuff. This has no direct correlation with the leaked stuff. If this would be a 3d model that is leaked and you make a 3ds importer "just in time" it cannot be illegal - sorry...

Slightly better is a bit of an understatement. I watched a side-by-side comparison by AItreupreneur and the output generated by NovelAI is significantly better, can hardly be distinguished as AI art in many cases.

AUTOMATIC1111 did not steal anything, or made available stolen information.
