It's the same with these brothers: in one camp are those who feel they're guilty of manslaughter, and in the other camp are those who only see rich spoiled brats who wanted money. Trying to convince one camp to change their minds is almost impossible.
I believe them, I really hope they get out of jail soon. Of course they committed a crime but they've in jail for 30 yrs, let them live their lives now.

Unless you are a survivor of incest or sexual assault you have no clue. I was abused buy my grandfather and 2 uncles. I was afraid to speak up because I was afraid of who would take care of my grandmother, and that my 18 aunts and uncles and 25+ cousins at the time would hate me. So I suffered for years. Had horrible relationships. You just can't understand until you have been there.
The second judge definitely made up his own mind and didn't allow the abuse evidence to be presented. Shameful because it was a big part of their defense.
I'm not Hazel but the judge was a former prosecutor who had tried and lost a very similar case in the past. He was also the judge who presided over the Rodney King trial, which ended in the acquittals that sparked riots.
The abuse claims were not removed from evidence out of spite. They were taken off the table when Lyle Menendez refused to take the stand when recordings of him boasting about his performance on the first trial were going to be entered into evidence into the second trial. He didn't want to be cross examined. But because the abuse claims were contingent on his direct testimony, his refusal to testify made them moot. What he and Erik wanted in the second trial was for their taped testimonies from the first trial to be entered into evidence so that they wouldn't have to testify. This wasn't a case of Stanley Weisberg being prejudiced or corrupt. And the sentencing guidelines were proper and just. Especially where it relates to the mother. You don't go out to your car to reload your weapon after you just pumped six shotgun bullets into your mother and then claim self defense.
@@jstephenj There are no recordings that damage Lyle's credibility. The Norma Novelli tapes were ruled upon and the judge felt that there was nothing of significance on them. Martha Shelton, who claimed to have a tape of Lyle saying. "We snowed half the country, now we have to snow the other half", later admitted that it was a lie, orchestrated by Dominick Dunne, who paid her to lie in his Vanity Fair articles on the case: nypost.com/2004/05/14/she-says-he-dunne-her-wrong/?fbclid=IwAR0eg47yN2XAArzMNJuFBFGe7rS4ajpQIh8rSV3Q8yzRQPgRWXUBClV1Fxc The judge didn't allow most of the defense witnesses to testify until the penalty phase to determine sentencing in the second trial. The judge and the DA's Office were desperate for a conviction and there was a political agenda involved.
They were adults and living in wealth their whole life! A hard life would be a child who has nothing such as food and shelter! These murderers wanted money and didn't want to work for it! They were not molested! They lied! Wake up!! Privileged little white boys still have people trying to get them out!
My heart aches for those brothers. I believe they were molested by the very person who was suppose to love them. Don't believe for a second it was because of greed. Maybe they think they deserved money because of everything they went through. I just hope they get the help they need and find peace.
I don't remember if the battered women's syndrome had been established, although, it has never been given the weight it was intended in actual court cases, but these two fit the criteria. It was pretty clear that their father was a brutal, sociopath, and I believed the brothers' testimonies I think the problem was not even that they lied about it, it was the spending sprees COMBINED with the lies, and they killed both parents, although their mother was not exactly mother of the year. Also, if those 2 were cut loose back then, I think they would have ended up causing harm to themselves and others. You can't murder your parents, or anyone, with a shotgun, and expect the mindset they had developed to be encapsulated and not affect their whole lives. I hope they get released either way. They've served enough time, and I think have used it to understand themselves and their crime.
SM Potts, California had a battered women's defense then but the judge wouldn't let them use it. He said it didn't apply to them because they were men.
One guy was in Princeton.they were 18 and 21 adults pretty much ….. it was premeditated murder…. You can’t go to the authorities specially the older brother that is not at home anymore ? Don’t believe it. Those roommates probably lied to the reporter but in court I’d they lie they will be accused of perjury
What? Did we watch the same interview? There is some CYA taking place with the "we haven't yet listened to the tapes" and use it the word "alleged", but that's par for the course with something like this, not evidence of her personal bias.. Jeez.
I don’t think sexual abuse or spousal abuse was give the same weight in court back then as it is today. They suffered terrible abuse at the hand of their father while there mother turned a blind eye. I believe if they were tried today instead of 30 years ago they would have been charged with man slaughter at best. What was done to them by their father was unthinkable and I for one hope they get a new trial.
I believe them they especially shot there mom more than their dad i think becuz she didnt protect them so they were extremely angry and hurt at her for not protecting them
"The family outside these two boys strongly denies this." That is entirely untrue. Two aunts (one from the mother's side and one from the father's) support them; a paternal cousin testified Erik Menendez had told him, two cousins from the mother's side believe them, and a third tesiftified for them at trial. The father's mother and his other sister did not want to believe the allegations, but still supported the boys by attending the trials; the aunt also testified for them.
Alli Muller I don’t get it I mean I believe their story but will it get them less sentences ? I feel sorry for them after embarrassing themselves about them being molest story they still get such long sentences .
Greed is a powerful motivator. But honestly I believe these brothers were abused. Killing both parents in the prime of there life for an insurance payout seems far fetched. They have served almost 30 years. It's time to let them go free.
Agree with all that you said, but my question is,,, they were 18 and 21. Why didn't they both just move out and get their own cribs? They certainly had enough money.
@@goodmorningsundaymorning4533 When you go through abuse of that level, you don't think clearly. Your abuser has a very strong power over you and make you feel like you can't do anything. Additionally, that money was not their own. It was their father's money. Their father was extremely rich and powerful, and that probably led to fears of their father finding them.
@@goodmorningsundaymorning4533 their psychological maturity was of 8 to 10 year olds as the psychologists testified. Moreover one of the brothers actually tried running away prior but was hunted down by the father who threatened him. Plus I feel people asking them if they could've ran or moved out is just as insensitive as it sounds like victim blaming. If there has been a female survivor,no one would dare to ask her such things. That should apply to make victims too I guess.
I think you need to gain a better understanding about types of interviews and their purpose. She didn't set out to cross-examine this guy--the point of the piece is to say "this is what this guy has to say about this case." While I believe she often demonstrates problematic bias, that wasn't the case here. What exactly were you expecting her to do here? She did a surprisingly good job, as I see it.
I don't like the way Megan Kelly treats guests in such condescending manners. Like this dude has more education, works with more real people than you, is trying to get the story out, yet you act like this?
I don’t understand whats with some basic TV hosts thinking their knowledge would be above those who spent years of their life studying and researching like that guy.
I played tennis with Erik at the same club, at that time his dad was tough on him, Eric was good enough to make it in the big league, What a shame for everyone.
Right, they killed their parents to ensure they wouldnt get kicked out of a will. They lied about what happened, went on a shopping spree and they should have been left alone after murdering their parents. Wow so they should be judge and jury oh and benefactors too!
Lola - I fully agree with you. They did not want to loose life style they loved, they needed their parents money so they murdered them and then went for a shopping spree.
Lola Lopez, they were already cut from the will prior to the killings and they knew that. Their uncle, who was the executor of the estate, confirmed this at both trials. They had accounts that their father had set up for them that had money deposited into them each month. Spending money was not new to them and they did not buy anything without their uncle's approval.
I think that this is proof of how- if a human is abused or mistreated, especially by their own parents, they will be mentally unwell and hurt others. I think it’s time for a retrial.
While it is true that abusers were often abused children, the converse is not true. Most sbused children grow up to be champions of the downtrodden i.e. ACLU lawyers, social workers, human rights activists, child advocates, therapists, etc.

Sexual abuse in children damages them on so many levels. It is like a bomb going off deep underground. They are changed forever. The trauma is so horrific caused deliberately and sadistically by a dependent parent whom their survival depends upon, in this case 'Jose Menendez - their Father. Eric the younger of the two brothers described his father as "brutal, painful and torturous'. He was a dominant man who expected perfection. He had a powerful presence and they were afraid of him. What has happened in this case is 'the money' piece (their wealth) has got in the way of the truth and motive and the labels such as 'spoilt rich kids' has stuck. The focus on rolex watches and fast cars is irrelevant and distracted too many truths behind it. Money buys the toys in this world over, they had it , it was not new to them, they had grown up with it, it's very different and was not motive. When you strip away the money and look at the facts we see it clear. When these men spoke in Court they were like 'children' boys who were still stuck in the terror of what their father did to them, the outrage, the injustice of it and the pain and damage that had done. They were still stuck inside 'frozen in trauma' and the betrayal. They were unable to articulate because 'like younger boys' they once were being abused with no protection from those who should have protected them. They had been sexually exploited when young onwards, their outside appearance did not match their inside appearance. Inside they were those young boys in pain and shock. Their mother - Kitty Menendez they describe as a 'woman in pain who was an alcoholic and suicidal' and how she was an 'enabler'., she did not protect these men as boys when they were children and she knew it was said their whole lives what he was doing to them but would not let 'anything ruin the family'. Many powerful people have a public personality and a private personality (even poor people money aside) their father - Jose Menendez did. Sexual abuse is done in secret, where no one sees so no one tells all over the world. Who was going to believe them? They had to live up to such high ideals for their father and the appearance of the family mattered greatly to all - including Kitty Menendez who denied her two son's reality and that her husband was physically, emotionally and sexually abusing them. She has been described by Lyle Menendez as being 'emotionally battered' by him herself. Deception was at the heart of this family.
My mother was a horrible mother but on the outside was perfect and charming. Once my mother passed away I called each of her sisters that was still alive and told them how abused I was and nobody believed me! Not even her own family my own family. Thankfully they are all dead now on both sides. we were told within an inch of our lives to never speak of what happens inside the house outside the house so we didn't. In 2004 my brother committed suicide but I was too tough and I outlived my mother! I had more balls than all the men in my family! She came close but I was not going to allow her to break me however she did take every ounce of self-esteem I ever could have had and I ran away to marry at 23 a shredded human being. You don't recover well from that any kind of abuse and my brother was 10 years older than me and he molested me. My dad was my hero and he wasn't treated very well by my mother either but he stayed because of me I was his princess daughter!
The family denies their abuse? At their first trial Erik's lawyer called 51 family and friends to testify about the abuse. They all now say they're lying? I really cannot stand so-called "journalist" that so blatantly disrespectfully to people opposing their views. Even if you don't agree, you should give your audience a sliver of a chance to form their own opinion.
I think the uncles (their mother's brothers) were the only ones who denied the abuse. They wanted money from the estate, since Kitty died after Jose, they thought they should get what was left of the estate if the brothers were convicted.
A chemical analysis of the paper and ink can provide a direct estimation of the age of the document. In addition to this, forensic analysis can also provide information on the chemical constitution of the material, which can be cross-referenced to manufacturers of the paper and the ink and perhaps the production batch and subsequently the year.
I agree and they shouldn't have even interviewed this man before all the facts are known...Highly doubt this is legit and that the Menendez brothers will ever be free...
These boys are so lucky to have Robert Rand on their side. He’s stayed steadfast in getting them out and has believed them since the beginning. Amazing man. He’s dedicated a lot of his life to spread awareness and truth.
Erik’s Letter to Andy has been around for years and years. It was in the Elm Drive House but was not allowed in court to support their case. Whilst what they did was outrageous and clearly wrong I believe them!
In most states there's no duty to retreat from your own home. If you're kidnapped you can wait until the kidnapper falls asleep to use lethal force. Being born into it is worse.
The letter from Erik to Andy Cano was never introduced during either trial or at any evidence hearing. A few sentences were shown in a TV special a couple years ago but the show incorrectly said the judge would not allow the letter into court. The entire letter gives you a much deeper picture of this troubled family including a section about the brothers' mother, Kitty Menendez.
It was in the Elm Drive House? It was from Erik to Andy, not the other way around... There was never such letter, it was just a fake strategy to find new evidence which is probably the only way for the brothers to have a chance to get an appeal.
@@ricardzubimendi7152 Since the letter waa never introduced at either trial, how could it be used as part of the defense strategy? And it was found among Andy's possessions
They would already be out of prison if this happened here in Australia. America is extremely harsh with punishments and while my country does need to get tougher on some crime sentences life in prison here is 25 yrs not till you die, in a small number cases some are in till they die but they are mass killers, serial killers or cop killers. These brothers would have probably maybe have gotten 10 yrs if it happened here. Regardless they have done enough time let them out!
lol no. will the parents to get to wake up back up, come out of their graves, and restart their lives? NO. these are likely dangerous murderers and there is no saying that they wouldn't do it again. why put the rest of the public at risk? of course I dont know all the facts, I just stumbled on this case. they claim they were abused; in my mind, it doesnt excuse the killings but I could see it being justified for a lighter sentence than life but honestly they killed the mom too.... and she didnt even directly abuse them, if what they're saying is true. it all fits into the narrative of them killing the parents strictly for money. anyway norway has among the lightest sentences in the world and their recitivism rate is very low so who knows maybe that would be a better model but implementation in the US may not translate as smoothly
When Lyle said he doesn't know when it's going to happen, that is also how Tyler Perry described his sexual abuse as a child. Like the same way Joyce Meyer described it.
It's time to let them out!! They have paid for what they did and they understand that it was wrong. But they have not changed their story once in 28 years!! They endured horrific abuse and should be let out!! #letthebrothersout
The documentary Menendez + Menudo Boys betrayed shows how much justice has failed these brothers and the menudo boys. It's sickening and heartbreaking at the same time.
just watched the law & order series about erik and lyle... incredible, how a society can destroy 2 innocent young men... and the role of the judge - with all the politics in the background - is outrageous... blessings on erik & lyle... may their case be taken up again and justice be served.
People don’t know or remember the times. Those women on the jury that saw this for what it was, are very smart and technically ahead of their time *knowing* these testimonies were/are truth. Smart women. Sexual abuse was the testimony of almost everyone that knew them! Very unfair trials.
The retrial had the same judge who changed rules and gutted the defence removed a bunch of family witnesses and told the jury they couldn't consider fear as a motive
I honestly do too. Watching the documentary, the one thing that stood out in my head the most was the cousins testimony. That letter perfectly corresponds with that story. Also Megyn Kelly is abysmal.
I release them today 33 years of bulshit in Gail for what???????? For no reason it’s justice . There parents abused them and they need to be released now
Free these men! Sexual abuse is something nobody would understand unless they have been through that. It’s a deep pain I wish nobody would ever endure but unfortunately it’s common in all societies of life. These two have been through enough, free them already! I can’t believe how unfair their trial was, and I remember how everyone would call them cold blooded sociopathic murderers. They were molested for years by their father and mother! Megan Kelly is so rude! I wish this man wouldn’t have given her the time of day, but I guess he’s doing it for the Menendez brothers. God bless his heart.
This has put a very deep dent on my heart. If this was only brought up again to be shamed and discredited and pushed away, that’s truly screwed. #mentoo to give hope and shed light on a topic that just might be put down by another judge is ridiculous these men were the victims they were supposed to be the survivors and yes they did murder their parents but there are far worse people in this world who have gotten away with so much more! They have served almost 30 years in prison some people might say that’s not enough and some people might say that was most of their lifetime. This topic of the Menendez brothers always makes me so emotional it is unfair to not be able to do anything about it Destroys my heart.
The telling to roommates about abuse, seven months before the murders, could've been part of their plan. The letter could also have been a part of the plan. However, the cousin saying he was told when they were little boys tells me the abuse happened. I definitely think they deserve a new trial with all evidence allowed.
I don't think telling the roommates about the abuse was part of the plan. Lyle only told Donovan Goodreau about the abuse after Donovan revealed to Lyle his own molestation. Lyle became extremely emotionally distraught upon hearing this and only then revealed to Donovan that he had been molested by his father. That doesn't sound like a preconceived plan to tell them.
I wasnt even born when this trial happened but this is awful for someone to have to go through. No one should have to experience that from their parents.
both roomates are cowards I mean I understand their situation and their are afraid and don't wan't to be pult in this but they have promised to say the truth and if thats the case why did they lie and further more why did they even show up if they going to tell a lie ... I mean its even harder now to prove that the have been abused after the lied it the court. I am really annoyed about the fact that both roomats think this is kind of a silly joke because for one side they tell the journalist that Lyle has told both of them that he and his brother have been abused by their dad but in the next moment their response to Megyn Kelly question is : I don't know anything about it and if there is a tap which recorded it I would be shocked!! I mean what the tell???, if thats true , then both of the roomates just put an act on because they don't want anything to do with that... They should pull them together and act like adults because they already in the middle of it even if the want it or not, they are playing a huge part in this hole thing and could even change the life of the menendez brothers !!!!!
jj yeah I really don’t understand this either. I get that the roommate who also suffered abuse may be less inclined to tell his story, but to suddenly have them both turn around and state no abuse was ever discussed with the brothers, doesn’t sit right with me. I believe the brothers were severely abused and that they should be given a retrial to hear ALL of the evidence. If I knew something about their case that could’ve changed the outcome of their sentence, I really couldn’t live with myself if I had lied or hidden that. I’m not sure how the two roommates can be ok about withholding evidence and continuing to uphold something that’s not true.
The evidence wasn’t allowed to be shown in the second trial and some of the jurors said later after they got the information that if they heard that during the trial they wouldn’t have convicted them of first degree murder.
This is a man that chopped off his dogs head because he thought the dog ate his bird I want the boys open the refrigerator the dogs head was inside the refrigerator I believe everything they say
They both look so good, handsome. I never watched their trial but I heard they bought expensive cars and such. I judged them on that. Now I am hearing about this trial and I feel terrible I thought they were guilty. I only hope they get out soon. Should never have been imprisoned in the first place. I cannot believe this happened over 30 yrs ago.
Free them! They have suffered enough! And they said if they were molested why didn’t tell anyone?! Well they did! Also he said their emotional maturity was 8-10 years old! It is a proven fact that once your molested your growth get stunted!
When is comes to testifying people get scared I just went through something at work . They chicken out if they only knew their testimony is so so important.
They killed a MONSTER!!! It was hard for them to confide in anyone because first, it was appalling and shameful especially since the abuser was their father. As for the spending, it symbolized rebellion and victory at the same time because they have finally defeated the monster and its accomplice.
I think the sexual abuse, coupled with the fact that after all the emotional and physical abuse their dad was going to cut them out of his will was the breaking point for them. They snapped.
i think its really disgusting that people automatically think they just wanted money. how many stories have been unearthed about child abuse that made people's jaws drop in disbelief? those negative reactions is exactly why people (kids or adults) dont speak up. no one argued whether or not they killed them. the real argument was the punishment they deserved. they did not deserve life without parole. we lock them up forever but let people walk freely for killing their own toddlers.... smh
Maybe I am a cynic, but why did the cousin wait almost 3 decades to produce that letter? If the father was molesting them, the letter might have convinced the jury to sentence them with the possiblity of parole
Why didn’t they come forward? For the same reason most women dont come forward right away when they are abused. Double standard much?
Its hard for both men and women to come forward about abuse especially men when it is done by their twisted father

The second judge definitely made up his own mind and didn't allow the abuse evidence to be presented. Shameful because it was a big part of their defense.
It was the same judge in both trials. :-(
Hazel Thornton do you think the judge was bought and paid for?
"We snowed half the country, now we have to snow the other half", later admitted that it was a lie, orchestrated by Dominick Dunne, who paid her to lie in his Vanity Fair articles on the case: nypost.com/2004/05/14/she-says-he-dunne-her-wrong/?fbclid=IwAR0eg47yN2XAArzMNJuFBFGe7rS4ajpQIh8rSV3Q8yzRQPgRWXUBClV1Fxc
The judge didn't allow most of the defense witnesses to testify until the penalty phase to determine sentencing in the second trial. The judge and the DA's Office were desperate for a conviction and there was a political agenda involved.

Agree. It is one thing to get molested, but to be molested by a father seems like the ultimate betrayal.
I don't remember if the battered women's syndrome had been established, although, it has never been given the weight it was intended in actual court cases, but these two fit the criteria. It was pretty clear that their father was a brutal, sociopath, and I believed the brothers' testimonies
I think the problem was not even that they lied about it, it was the spending sprees COMBINED with the lies, and they killed both parents, although their mother was not exactly mother of the year. Also, if those 2 were cut loose back then, I think they would have ended up
causing harm to themselves and others.

RELEASE THEM TO THEIR FAMILIES.
Megyn : "Well, uh, we don't know what the truth is in this case." Well, uh, yes we do Megyn.
The abuse wasn’t proven in the second trial which convicted the brothers.

Robert Rand, the man you are. Stuck with these brothers for years and STILL advocating for them now. Amazing man
They should be in parole they were victim of his abusive sick maniac father.
If they were abused then release them
Would have been different if it were the Menendez sisters.
Oh, are we gonna fall back on Robert Rand meme #112?
i think its really disgusting that people automatically think they just wanted money. how many stories have been unearthed about child abuse that made people's jaws drop in disbelief? those negative reactions is exactly why people (kids or adults) dont speak up. no one argued whether or not they killed them. the real argument was the punishment they deserved. they did not deserve life without parole. we lock them up forever but let people walk freely for killing their own toddlers.... smh
Even though I find this case fascinating I still find it hard to believe.
Sarah Hayman same. I feel horrible but something just doesn’t feel right about it.
Than you haven’t lived with a narcissist psychopath. I have
Thank you Robert. For never giving up on this long journey for the truth and to see justice done.
Free the brothers !!!
so very sad
Maybe I am a cynic, but why did the cousin wait almost 3 decades to produce that letter? If the father was molesting them, the letter might have convinced the jury to sentence them with the possiblity of parole
It wasn't the cousin who produced the letter. The cousin is deceased. His mother found it recently.
