    When I went to college for game programming one of my teachers was a former high up in Silicon Knights on the business side and he said there was a lot of fighting between the Dev side and the business side with the higher ups in Silicon Knights during production of Too Human.

    It shouldn’t be possible for a finished game to need its license renewed.
    Licenses should only be required to make the thing; once you have a finished game, companies should be able to sell it forever.
    That would solve so many of these problems.

      A perpetual license is worth more than a time limited one. If time limited licences were removed, then it would take away the developers ability to negotiate a price for a license and the rights holder would just price it at a stupid amount of money meaning no/less games are made.

      It's utterly ridiculous, even if you don't give out a perpetual license. Just give out a limited one, not time limited but product limited. You get the right to [Insert Specific Title here] and all relevant copyright elements limited to the advertisement, promotional material and product of [Specific Video Game]. This does not extend to any additional video game, or additional content after the final release copy.

      Totally agree. I mean, thats how it works with movies. You should only need a license to make new content. I mean movie studios don't have to pull movies from the stores if their license runs out, they just have to renegotiate the license if they want to make a new installment. Why should it work differently for video games?

      The problems with perpetual licenses is that someone can release new paid content -- whether in form of continuing to use an online license, expansion pacts, mods, etc. and then you have to spend huge amounts of legal time and money trying to stop them since now courts have to decide what is a new game vs. fixing the old game, vs. mods, etc. If you rewrite the same game using a modern engine (say Baldur's Gate) or for new platforms (say iOS or Android), or add multi-player, etc. is that a new game? How much new stuff can you add before its a new game -- bug fixes, new sprites, new levels, characters, artwork, expansion packs, etc. Easier and safer for the copyright holder just to set a time line. If the game does well, you of course extend it. If not, you aren't worried about future use of the "same" game in some other way.

      @@BW022 I actually see an easy way to differentiate between new content and fixing the old content. Everything that (for the customer) is covered by the initial purchase of the game is part of the original content (and therefore covered), everything the customer has to pay for afterward is new content. So a bugfix would still be covered by the initial license (even EA is not that bad to demand money for bugfixes - hopefully I'm not giving them any ideas) but a paid-for story DLC would have to be renogiated. In terms of platforms, I would see that as analog to how movies come on different formats. So the contract-partners could either say the platform doesn't matter (with the video game studio being free to make games for other platforms as long as only the original content plus what for the other platforms is free is implemented) or they could agree to a particular selection of platforms, renegotiating if the studio wants to bring the game out for a platform not covered by the contract.

    I remember buying a used copy of Too Human once upon a time. It wasn't an awful game, but I never knew how long it took to develop or any of the story behind it. Thanks for that interesting trivia nugget.

      Piracy existed in the 70s before Microsoft even made a dime, it was because before commercial software development for consumers programmers were hired to develop software for mainframes that dwarfed the software development in cost. It is when it became cheap to own computers that commercial software took off the ground. However people were pirating software and Bill Gates was a key figure in pushing the concept of distributing software PRODUCTS. Before that, software was free and people never paid for it apart from the development costs to hire programmers to initially develop it. So once people got hooked on using software, when the Internet and Ethernet networks, and encryption, came on the scene someone combined these to create license servers to keep people from owning their software. We now buy licenses to use software, we don't have the capacity to trade it, that means are money doesn't hold much value anymore and people in software industry don't compete or ever have to worry about competing to flooding the market with titles on their next releases. But what got them there was the the excuse that people pirated their software so much they couldn't make the sales figures they had projected to their creditors.. Which is assumed as they include people who pirate their software as potential sales. BTW Apple, you've lost me as a consumer when you pulled GarageBand from the iPad 3.. When you did that, you made me very leery of ever buying anything more from the store. Such business practice is driving me to yell a lot more about the virtues of freeware and open source. However if you want to remain in a secure environment and buy software, it's best to buy in the Apple app store, or if you choose Android, a trusted app distributor like Google Play. If you venture out of that, you risk acquiring malware, as it is in the best interest of criminals to exploit this vulnerability.

      @@grados3060 the argument is that if it's physical it's ALWAYS available especially on the second hand market, in 10 years time this game could have still been brought and played by someone if it had a physical release, take that LEGO Hobbit game, you can still buy and play that because it had a physical release even though the licence is lapsed and it's no longer published
      it's legacy something that we will lose if gaming goes all digital

    One game that not a lot of people know about is a little survival horror game called Cryostasis: Sleep of Reason. It came out in 2008, and was delisted in 2013 due to licencing issues, but it had a neat little mechanic where, instead of health, you had temperature.

      You can download Battle for Middle Earth Rise of the Witch-king for free online. Part of the fan base is even remaking the entire game. I am not kidding, look it up, have fun.

      Was going to say the same thing actually. Supposedly it was only going to be delisted again after some time, but I don't know if that's changed or how long "some time" was supposed to be.

      @@ironcladguildhand9321Same! I actually reinstalled it after that; TBH I had wondered why the preview images in the background had faded. Turns out it was because it got pulled from stores.
      Which is a shame because while the game wasn't revolutionary or anything like that, for a fifteen dollar game it wasn't actually that bad and did a rather impressive job at making bending feel powerful. Yeah, it could've been a lot better, but it was still a fun romp against Equalists, Triads, and the occasional Dragonfly Bunny Spirit as Korra.

    A bit late, but Too Human was relisted, with DLC, the week after this video went up on the Microsoft Store for Xbox. It was announced as one of the last backwards compatible Xbox 360 games until Project Scarlett releases, and best of all, it's free!
    Even if its an average game, its back from oblivion, and free to own indefinitely, which is great.

      My brother had it. From what I heard, it was good if you like fighting games that focus on stringing together multi-hit combos, but if you were looking for a game with a compelling story where you got to explore a beautiful world with your awesome avatar powers, you were shit out of luck.

    "Sees the psp part of the video" I feel like they confused the VITA and PSP situations: the PSP actually sold a lot of units, around 80m units (as of 2012), a lot more than the VITA who sold about 15m in total (as of 2018), so the PSP was actually well known and very profitable for them. It was the vita that anyone barely knew about, which is a shame because it was my favorite console after the original DS

      God of war,monster Hunter freedom series, dissidia ff and countless other were pretty much home console level games.
      Luke and Ellen's thoughts on it are hilarious but honestly I was disappointed after moving to the 3ds when the vita failed,with most games it didn't feel like an older switch-type full on console like the psp did.
      It felt like a stripped down console.
      I can still remember clearly the excitement I felt as my father unpacked his luggage and handed me the games he bought this time.
      He'd never forget about it when he went abroad on his business trips. As a third world country, the games we had locally were scarce and ridiculously overpriced and before every trip, my older brother would give the list of good games he should bring from in this trip.
      I haven't thought about it all in so long.
      It's... it's been such a long time since I thanked him for it...
      I'll try to think out what I can get him for now.

      Battle for Middle Earth 2 is one of the most underrated RTS games I have ever played. I enjoyed it more than almost all Warcraft (including StarCraft) and C&C games.

      What are pirated games like, though? My concern with piracy is that someone can sell you a poor-quality knock-up of a game or DVD, and you have no recourse to return it or get your money back, since the law won't help you in that situation, whereas consumer law protects you in cases of dodgy legal releases.

    I liked Too Human, it was unbalanced but a great game. I even played it twice. However, the worst part of Too Human being discontinued was the terrible hangcliff of the ending. I will never know what will happen. The lore was very original and it could have been very interesting to have a second installment with improved gameplay.

    I hope all the people cheering on the death of physical media because digital is "more convenient" are happy with this situation because the consoles go all digital, this is going to be the fate of entire libraries of games. You think when Sony is launching the PS9, that they're still going to have PS5 games up for download, even without licensing issues? It would be a miracle if the older console was even still allowed to connect to their network.
    And speaking of licensing; It's incredibly fucked up that a license for something like a finished game can expire. I can understand a company's license to make NEW games expiring, but it makes no logical sense that once a company has produced a game and put it on the market, they have to keep renewing the license. Once a company makes a licensed product, they should have the right to sell that product forever. Today's copyright is destroying creativity.

      @Mike P - Maybe licensing has always worked this way, but in the past, with physical products, you never heard about game companies having to pull existing products from stores because their license ran out. You never saw game headlines like "Buy that Ghostbuster's game while you can because on the 30th, you won't be able to find it in stores anymore." It's been 33 years since Activision published their licensed Aliens game for the computers of the time, so I'm sure their license has long expired, but you're still allowed to buy copies of this game, provided you can find any.
      And you misunderstood my example with the PS5/PS9. I wasn't saying that the PS9 would or should run PS5 games. Let's say that you have a PS9, but suppose that there's a PS5 exclusive game that you always wanted to play, but never got. You buy a used PS5 console just to play that game, but since the distribution was all digital, you can't just buy a physical copy of the game you want, it has to be downloaded. Will that PS5 still be allowed to connect to the Playstation Network, and if so, will they still have PS5 games available to buy? If not, where are you going to get the games for previous consoles?
      And yes, this in a concern. Right now, there are games on systems like the Gamecube and PS2 that I still want to play. for those, I can just buy a physical copy and play it. But if the distribution is all digital, where do you get digital copies of games once the console has been declared obsolete and nobody supports it?

    No One Lives Forever - stuck in legal limbo because literally no one is sure who actually owns the rights to the franchise. Some years back, an independent studio attempted to update it for re-release on modern platforms. That's when they discovered that there are 3 different companies who may potentially own the rights, but they all admit they're not sure if they do - but they will definitely sue anyone else if they try to claim them.
    So NOLF and NOLF 2 will never be remade, remastered, re-released, or even stuck on Steam for download.

    Loved the way the story was going. Felt like the game had grand potential but it was just a mess to play. Never finished it. Sold it shortly after getting it.

      I went beserker, and I got the achievement for being picked up by the Valkyrie 100 times on the final boss. My gear was all red then and one hit killed me but I eventually took it down.

      @rwsthedemonking I agree that most Telltale games were hot shit, Tales from the Borderlands was the only good one. It was genuinely funny and actually worth your time. But to each their own I guess.

    I know it was probably a joke but the PSP is legit excellent. Leaving aside the exploited emulation stuff, the PSP had Patapon, FF Crisis Core, two God of War games, two Metal Gear Solid games and a lot more.
    Best handheld console for me.

      Leaving aside? hell, the only reason i still play with the PSP every now and then is that it can, via exploiting, installing a custom firmware and then, homebrews, run several classic console emulators like nes, snes, gameboy, sega genesis\megadrive and so on!

      Its where Monster Hunter was givin new life after failing on the PS2 and where it got a fanbase. Were it not for the PSP and MH Freedom, Freedom 2 and Freedom Unite, we wouldn't have Monster Hunter Generations/Gen Ultimate, World/Iceborne, or Rise/Sunbreak.

    There was a Deadpool game originally released in June 2013 on Steam, PS3, and Xbox One, and then delisted on January 1, 2014, along with most other Activision published Marvel games when their license expired. It was re-released on Steam in July 2015 and then PS4 and Xbox One in November 2015 and then delisted again in November 2017 due to licensing issues

    Hey, I liked the PSP! Monster Hunter Freedom, Final Fantasy Dissidia Duodecim, Persona 3 Fes, AND I get to play a lot of PS1 classic games on the go.

      They have a ridiculously slanted view lol, the piracy was awful to developers but the games were above Nintendo portable titles in both graphics and just having way more processing power,it had so much good stuff.
      and also, hell yeah man!! Mhf2 was an amazing journey and ohhhh god of war.
      Fun fact:- we're not from somewhere where game age ratings are common knowledge so I started playing them from let's say 10 or 11 years old. Yeah, I cried after beating yian kut ku,and also the fart gorilla as well.

    I still have a copy of Lord of the Rings:Battle For Middle Earth and Battle For Middle Earth 2 with the Rise of the Witch King Expansion. They are absolutely great games, and are really fun to play. They were originally programmed to work on Windows XP, and will not run on Windows 7 or later, because Windows XP was running as a 32 bit OS, and Windows 7 and later are a 64 bit OS. But if you look online you can find a simple fix for the problem by adding just a few lines lines of script to the ini file
