i dont get why a judge would ever say "try it" to pressing charges. is a charge to be stacked or not? be specific. no reason to be at the pd otherwise. pd needs a district attorney bad
It makes sense as advice when the judge isn't making the laws, but they are making the law. If there is a question about what you can and can not charge just change the law so its clear. This "try it" crap is just guaranteeing that a bunch of people are going to be screwed over until a lawyer wastes their time and a judges/cops time to have a court case just to get clarity on the law/charge put into common law. At the end of the day the PD is the one that suffers because they screw people over trying to take advantage of these intentionally left grey areas, and in exchange they get even more bad PR due to things like this putting them in a never ending cycle of being hated by the civilians and shot by the criminals.
The judges say try it so that precedent can be set, not every rule should come from legislation. It’s impossible to write legislation that covers all situations, that’s the purpose of precedence. Also nopixel will probably never have a DA office because they want the officers making the arrests to be able to understand/articulate the charges they press. Having a DA office would lead to officers pushing charges they don’t know how to defend (even moreso than already happens now). There does seem to be a push to get some legal aids to help the pd, but the more officers are given training wheels around knowing the law, the worse they will become at knowing the law
Its so judges can make case laws and decide whats ok and what isn't. That was the plan but none of the Judges understood they can make case laws which is why server went over 3 months without a single case law
I think only extended mags and attachments count, that being said I don't think they should. Just charge for the gun and send them. It's part of the issue that cops just HAVE to make sure they get every last charge.
