    Anti-discrimination ordinance, raises the question of whether the “source of income” clause is enforceable, since it conflicts with a state law that bars local municipalities from enforcing fair housing laws.

    State codes that prohibits local governments from expanding the state’s fair housing law, which does not bar discrimination against renters based on sources of income.

    They conduct a new inspection each year after or if there’s a complaint. The inspections aim to ensure safe and sanitary conditions, and evaluate apartments or rental homes based on 13 factors, like lead-based paint, smoke detectors, or water and air quality.
    The Complaint 7 The LIE!
    landlords reported waiting three months for an inspection after agreeing to rent to someone using Section 8 WHEN in fact the longest wait times were no more than eight days.
    Regardless ofinspections shouldn’t be such a burden on landlords. Housing agencies to conduct inspections within five business days of someone selecting a home. If they don’t, a landlord can move on to find another tenant.
    A neighborhood’s new anti-Section 8 rules will push many Black residents out of a North Texas suburb.
    Landlords in Texas don’t have to accept renters who receive federal housing assistance, but a Denton County community is taking it a big step further: making most of the town off limits to Section 8 tenants.
    "'Source of income discrimination' refers to the practice of refusing to rent to a housing applicant because of that person's lawful form of income."
    History
    State and local laws prohibiting SOI discrimination began to appear in the 1970s, steadily spreading across the country, and increasing exponentially beginning in the mid-2000s. (See A. Bell et al., “Prohibiting Discrimination Results,” Ctr. on Budget & Policy Priorities (Dec. 20, 2018).) In 2017, the American Bar Association adopted a resolution that “urges federal, state, local, tribal, and territorial governments to enact legislation prohibiting discrimination in housing on the basis of lawful source of income.” (American Bar Association, Resolution 119A (Aug. 2017).)
    Can I refuse to rent to section 8
    It's illegal under federal fair housing law to refuse to rent to someone on the basis of their race. In several states and large cities throughout the country, it's also illegal to turn someone away merely because they have a housing choice voucher.
    Can landlords refuse housing benefit?
    Can landlords do this? No, they can't. In September 2020, housing benefit discrimination was ruled unlawful in a landmark court ruling.
    Do all apartment complexes have to accept Section 8?
    No. A landlord is never required to accept a tenant's application, but many areas will require you to treat a Section 8 tenant's application with the same respect that you would treat any other application
    Do owners have to accept Section 8?
    California implemented new laws at the beginning of 2020 that require landlords to accept Section 8 or housing vouchers as an income source from applicants. Rental property owners cannot discriminate against an applicant or deny the application just because of a housing voucher.
    Think Twice Before Turning Away Tenants With Section 8 Vouchers
    Before you follow a policy of turning away prospects with Section 8 vouchers, you should first take a moment to find out whether what you're doing is legal.
    What It Means to ‘Take Section 8'
    When prospective tenants ask if you take Section 8, they want to know if you would accept part of their rent through the Housing Choice Voucher Program (still commonly known as the tenant-based Section 8 program). But just because a prospect asks such a question doesn't mean the answer is up to you. Before you respond, you should be sure of whether your state or local fair housing law bars you from turning away prospects for this reason.

    I waited for a voucher for almost 2 decades. I got a voucher and my worker gave me a voucher that runs out in 15 days. I am paying for a damn hotel until tomorrow after fleeing the person who took the car away and has gotten more abusive after the voucher! She is basically threatening me to take Anything and won’t help me with the $122 a night here!

    i just went through this for over 9 months i am in calif where supposibly you are not allowed to not rent to someone with section 8. well they forgot to tell these people the rules. i was told to my face at one apartment complex and its about 30 years old nothing special its right across from a police station at that (nothing bad but not necessarily where people are beging to live) and sure its gated (with a 4 foot fence anyone can get over) when they first built them they were renting for 500.00 and sure prices have went up but they havent upgraded them since 1999 and now they want 2400.00. great our voucher is for that much it had just changed payment standards a week before this so i go in and say i am looking for an apt and they are so eager to show me and explain everything to me they couldn't of been nicer then comes the bomb to them i tell them i am on section 8 and before i could even get the words out there smiles turn to like a disgust look and total personality switch and the women says well this was a waste of our time and yours because we have never and we will never rent to anyone on section 8. mind you ive never talked to this woman before and she says you all (as if she knows me and how i live) ruin our apartments and leave us with thousands of dollars to fix and you are off in another house to ruin i tried explaining to her if that happens we are out of section 8 forever and she says no theres the door and also she says unfortunatly the payment is over what they will pay and i said no it went up last week. the next day im looking at ads and can you believe they went and raised the price to now 2600.00. that is how all these places are getting away with not renting to section 8 in calif they just put it over the limit which in reality isn't hard to do its impossible to find a 2 bedroom apartment or house in my area under 2400 the average for a 2 bedroom is more like 2900. and what i don't understand is all this crap you have to pay to fill out an application do you know how much i spent during 9 months i would guess well over 2000 just to never hear from them or they string you along and then oops sorry someone else came along. section 8 needs to do something about the application fees its almost 50 a person if they are 18 so for me it was 100 each time. it doensn't make sense this one house told me oh its really not for rent but if we put it in the paper once or twice every couple months with the low rent price then alot of people apply and we make alot of money then just say its been rented and im sure alot do that. or they shouldn't be able to take more than 1 or 2 applications. the rule is your suppose to be 99 percent going to get it but that don't apply either this one place had over 120 app at 50 a piece thats what 6000 dollars. i think section 8 tenants get talked to like dirt and treated like dirt most of the time this one lady in a condo asked my son not to come in and look because she didn't want his wheelchair tires to get her carpet dirty in the rental i just turned around and said not so kind words to her like what the hell why are you showing it to us i told her my son was in a wheelchair. i reported her to housing for that one.

    The Sec 8 office here approved my redetermination on June 6 but didn't bother writing us a letter to tell us. A while back they changed their location but didn't bother notifying us to let us know. We want to transfer our Sec 8 voucher but the city we want to port to we read they are very slow. This Sec 8 office is very slow as my lease ended May 31 and so why must I still be living where I am? It's caused us a lot of worry and stress also.

    You are right about all this, of course, Jay. Where I live, big corporations are buying up the properties by the 100s. Then they are run by a local property management company. The few apartments that are listed for rent for the most part is subpar. I don't even see how they pass inspection, but then when I finally got inspection in my current apartment, the guy wouldn't even mark anything off including mold.
    My neighbor is terrorizing me and having a blast doing it. I made the mistake of telling him that I am allergic to marijuana. I'm not making it up or exaggerating, I really am. Over 4th of July weekend he decided to mix Zevo bug spray with kerosene and sprayed it heavily throughout his apartment. I know it was him because I asked if he had that smell coming into his apartment too. I and the other neighbor thought it was the worker who was making the 4th apartment ready who caused the smell to run through the ventilation. We thought he had set off foggers and didn't bother to tell us, until I found out it was this guy next to me who delights in making me miserable. Anyway, I was so freaked out when he said he mixed it with kerosene. I had to open all my windows, turn off the a/c all day and all night and wear a mask. I called the fired dept out of concern that it could cause a fire. How that turned out was the police showed up some 3 hours later. Told him to stop spraying it and to open his windows to air it out. He is still using it, but not as much. When I asked him to stop, he told me it isn't his fault the ventilation is messed up and that I should move to the empty end apartment to resolve the issue.
    I contacted the property management office, but they don't care at all. Last night he had a 5-hour pot party, and my poor little dog was coughing and gagging. I use a fortune in Ozium spray and air fresheners which don't do much and I have two air purifiers on top of that.
    I'm just so sick of it, and it's hard not to retaliate in whatever way I can.
    I think the property management company sides with him because he is not a Section 8 client. The thing is though, he pays $370 a month because he knew the former owner personally, and they let him have a break of $80 off the monthly rent which is what he currently pays.
    I so wish I could move but everything is slim pickings and then there's all the requirements to rent. Application fees, deposits, pet deposits, credit check, etc. etc.
    I had a voucher to move, it was a flat 120 days. I couldn't find anything so now I have to wait until next February to request another.
    Life can really suck sometimes. My apologies that this is so long. It helps to just put it out to anyone who will listen, and that's not many.

    Can LIHTC Senior housing Apartment complex charge me a DOUBE DEPOSIT, they don't charge their othe tenants not on LIHTC, simply because I don't have a FICO score they want, which I don't know what that score is, despite my Credit History of paying my Current Section 8 Apt. Rent and Utilities on time or before they are due for the last 60 month (5 years). I live in Plano, Texas. Evergreen of Richardson is almost bullying me to pay a $400.00 deposit, which my current apt. has never done, and I didn't have good credit when I moved in because of long term job loss at age 65 during the great recession. Where can I get help with this Dallas Housing and my counselor or HUD.

    I'm going through bad divorce my spouse left me destitute
    So I joined a service in SLO county and in a couple of weeks I got approved and then selected I know have my voucher for section 8....but I need proof of income I am dying from heart failure homeless living in a van my husband refusing to provide $50.00 a month for support so I'm most likely going to loose voucher I don't have an attorney cus I have no money.
    I have supportive Mother who could give me $50.00 a month to cover my share plus the place I found to live is way affordable it doesn't use up the entire voucher price, any suggestions on how to prove my income with my situation?

    I could be wrong; but it was my understanding that minimum income requirements were also a violation of us fair housing standards such as requiring that you make 4,000 a month. Not only where my income comes from, but how much I make should be none of their business. So long as I can pay the rent. Yet I constantly see minimum income requirements listed in my area that keep people who make enough to pay the rent; from being able to rent a place because they don't make three times the monthly rent which is sometimes a requirement in my area. I also find things such as pet rent being listed in my area; in which Pennsylvania does not allow for pet rent, only a separate security deposit equal to one month's rent and subject to the same applicable law as a standard security deposit to be returned in the case of no damage, and placed in a secure account. Yet these listings keep on popping up in my area advertised not only in our newspaper, but even in our social media forums related to rentals in my area. If they are advertising things that are not compliant with applicable law; should merely advertising such a thing also be barred. people are under the misconception that if they agree to a written lease with those requirements that they are bound to it. And many people do not understand their rights that if any part of the lease does not apply to applicable law, that portion of the leas e cannot be upheld. Yet even our district judges are authorizing evictions based on landlord complaints that are in clear violations of these acts. Yet they turn a blind eye to the person's right and instead favor the landlord. How is this allowed?

    The nasty emails I get after passing background checks and tell them I have a voucher is ridiculous and very hurtful I got a voucher due to a illness to keep my children stable monthly with income but the amount of ewww remarks are overwhelming and can get you down Is there legal action enforcement in the state of Texas because I have grown tired and have been searching for two months and get turned away from being housed by landlord all the time

      @@Section8Consulting can u possibly help me? HUD isn't excluding my IHSS income that my fiance gets for me. I'm developmentally disabled and physically disabled. They are making up questions to ask IHSS now to try to exclude people from a US law that was even fought over for 7 years with the Reilly vs. marina county housing authority. I can't get a response from disability rights office either. I can't afford my medical expenses and rent

    Can you talk about being on section 8 and the implications of having stock or long-term capital gains? For example if a person is trying to get ahead in life and say they have unrealized long-term capital gains of a couple thousand dollars but is afraid to take those gains because they are afraid of being kick out of the program possibly and then wouldn't be able to get in the next year even though it might be a one-time gain which should be tax-free because its under the $40k single filer threshold. How can a person get out of the system unless he can buy a house outright in cash. If he saves up any money for down payment for a house then that saved money is used against him for a section 8 been figuring out what the rent will be.

    Question on source of income, 3X rent requirement in a rent restricted apartment complex. These are "set aside" apartments in a HUD funded building that rents to section 8 also. I am on SSDI and don't make 3X the $1300 rent that they require. Should they be going by the total tenant payment for 3X the rent or the full $1300? I'm confused. You didn't explain what source of income laws means exactly.. any help? p.s. I live in Texas where there are no protections for source of income.

      That is a requirement invented by the landlord. As far as I know it is legal.

    Yes I think it's a lot where people are putting in the Box everyone that's on Tuesday or section 8. Is tenant to tear up property tenant to us out of control. Etc if you are on section 8 or not I'm texting me everything is not the same just like all landlords in it bad apples good apples

    I cant even get section 8 our waitlist have been closed forever. But I found an apartment yet no assistance to land it. Oregon segregates low income now. Inclusion is better keep ppl wanting to strive.
    I lost my business before the pandemic I am a 47 yr old white single mother. The barriers are high even for me. I literally have to provide documents to DHS on what resources the are required by law and policy. It went so far as contacting the senator and my congressman to back me up. I have spent months researching trying to figure out how to access housing. It's ridiculous. When ppl suppress, judge or degrade it highlights their lack of self worth. Confident individuals that reflect are racist or judgmental. I'd love help from you, but I am on the verge of being homeless with my child. I don't have money. But if you helped me get into housing I'd be happy to pay you something of what I could afford. Like $50 I only get $430 from TANF . I had a residential and commercial cleaning business pandemic sucker punched me.
