Can my spouse come as h4 to usa and later convert to h1b on the same petition without giving visa interview? Also is it possible to change the employer and convert to h1b without giving visa interview?
I don't understand fully and I am not sure why she would want to come on H4 when she has an H1B approved. She won't be able to work on H4 without EAD. Even if she gets it converted here , next time she leaves the country she will need a stamp to enter the US again
@@itsokyaaar ya there is a delay with her employer regarding the project but her h1b petition is approved a month ago..so if she comes to usa on h4 visa later she has a chance of conversion to h1b with her same old petition and same old employer or even she can go ahead with new employer with existing approved petiton?
@@ranaanvesh9305If there is no project in US,do not bring your wife to US with H4 visa status as she will be working in India. Bring her with B1/B2 visa. She has two options. Lwp or stay in India by doing job with later b1/b2 journey to US for some months. H4 means your wife will not be able to have income from any source while living in US,no wfh jobs at all. I may be wrong but What I said is probably true from what I heard/read online.

Your company needs to file it in premium.. but yes, it's possible to do premium processing for h1b.

No. You should be fine. Just keep your company in the loop.

Not until you have your h1b. April is when your name is selected in a lottery. H1b isn't approved yet.
