      "Here's the deal" is a term they use when they kno they messed up but will not admit it. They use to to somehow "maintain" control of the situations, much like the directives they give after when its not necessary. The officer had to come back knowing he wasnt gonna get ID jus to get the last word. Dont go back on their property

    I felt sorry for poor officer Crawford, when he found out they lied and he couldn't arrest you. The look of sadness and disappointment on his face was heart wrenching. It reminded me of a small child, just told he couldn't go to the circus, or that Santa wasn't coming. Sad.. - A body cam would prove where you were and more importantly.. where you were not !       @@jackallen3732 proving it was false is a hard thing to do. Most buisness with their own physical address are responsible for maintaining walkways (ei.. snow/debris removal, trip hazards). They assume to have control over the space. Making a police report when you truly believe you are in the right isn't illegal in this case. Boundary and public right of ways are something constantly being challenged and misunderstood. Filing an affidavit or committing purgy after being told by an official of the boundaries would then be considered a false report. That doesn't seem to be the case here at all.

The cop asked the woman if she was getting on a bus.. meaning there is a public transport stop there.. it also means that the city has an easement right (she explains some of it on video). The business owner didn't call.. workers did.. what's the chance your local McDonald's employee knows the property lines? Yes very clear property lines if you have a plat maps and survey equipment

Took the time to personally feel a type of way about the lady being where ever she was and doing what she wanted. It's simple as that, no reason to call the police especially if she spoke with the guy like she said and informed him. So obviously your stance is wrong on who the person shouldn't be accountable for that but the lady has to go thru what she went thru and get threatened by jail for literally a lie, the cop said the guy said she was trespassing to the police department to get her either removed or locked away.       H1Gh the one thing the officer's supervisor and I agreed on was the MTA employees simply weren't aware of their boundaries. They reported a non-crime on behalf of management. Where they went wrong was to lie and claim I went on restricted property. It took video to prove they made a false report.

      Even stop and id requires a crime to have been committed. And two pieces of id name, date of birth, or address...not a physical id. Not that they need it in this technical day and age.       That's BS. Check the law instead of just expressing your opinion. In most states you are required by law to identify yourself to police when asked (or told) to do so. If you refuse the officer is within the law taking you into custody until you can be identified.

    I could have written the end dialog for this video. I had already guessed that the second cop was going to return and tell the first one that there was no video of you entering the property in question. Especially when the first cop went and discussed it, out of your hearing range. And, of course, just like the dorks they are, he had to issue a last warning. Don't go on their property. I have to give you more credit for holding it together, because, I know I couldn't help but saying something, like, "How does it feel to be shamed, officer? My thousands of viewers will never forget the dumb look on YOUR face, or, the stupid comment about people being required to carry their ID on them."

      The way she handled it was perfect. No reason to rub it in their face. Continuing to do things exactly as she is will serve her very well should she ever have to obtain an attorney if she is falsely arrested. Tom Zebra spoke about this fact in one of his videos. He messed up with the way he used to handle these situations.

    You conducted yourself in an excellent and calm manner.
    At the end of that conversation where the police stated that if you enter their property, that you would be charged with tresspass.
    What would happen if after that exchange, that you stated to the officer "Officer, I intend to stay on public property at all times and will proceed over there. If, you get another call about tresspass, please investigate that claim as I will carefully document that I have never stepped on any part of their property."
    Then follow-up that claim with a printed document from the county property tax website, proving that you were on public land at all times, and ask the police then to get evidence from the company that you tresspassed on their land. It will be impossible for them to do so if you never stepped foot on the their land. Ask for a supervisor as well.
    A good outcome would be the supervisor would validate your claim and explain the law to the company as well as the officers.
    A bad outcome would be an unlawful arrest, but with your good documentation and proof, should allow you to win a lawsuit if it ever comes to that.

      these pigs think that because they tell us something it is law.You would be surprised at the number of people who do believe them;I think that Police officers need a minimum of a college education in criminal justice.Most of them are uneducated or only educated to the minimum qualifications(state police academy,etc.).They have a bare minimum knowledge of law besides the basics.

They could've been much quicker but I give them credit for going back over there to double check if she actually was on that property and letting her go after it turns out that no such proof could be provided. They didn't put her in cuffs and didn't raise their voice. That's already 10x less egregious than most encounters.

      I would have liked to see you take him up on his offer of "Any questions?" and pressured him for reasons why he automatically thought you were a criminal, was desperate to violate your 4th amendment rights, refused to apologize for handling an interaction with a citizen in an appropriate way and being completely wrong. Really push the point home that he works for you and he should get his facts straight before he threatens to arrest a law abiding citizen without cause. Great job though.

    Wait a damn minute. So they got a call/report that you were on private property and the owners wanted to press charges. So, the cops tell you that you'll be arrested if the videotape/cctv shows that you indeed were on their property. Now, after the cops reviewed the footage and didnt arrest you, it's obvious you were NOT tresspassing on private property, as proven by the cctv, and contrary to the complaintants claims. I would have demanded that the cops arrest the complaintant for blatently lying to the police and giving a false report/infomation. It works both ways. Teach these fuckers a lesson.

      @@scotthayton1114 IN the court is one thing, but you can go anywhere around it without ID, according to their own ruling. The high court is not considered a public place, so having to show ID for that... welll hmm, seems to me that should still be allowed but probably isn't since 911.
      The original case involved a black man with dredlocks walking through a ritzy (ie white) neighborhood. when he would not show ID, he was arrested and the case went all the way to the supreme court since it was deemed a constitutional matter.

    Still, in that position I WOULD have a problem. If they scanned the business' video footage and it clearly showed she was not on their property, they made a false emergency call. Might not hurt to bring that up to the officer in advance of the scan--- to give them time to decide if they want to threaten a law-abiding citizen in favor of a deliberate, unlawful action against her. by another private citizen. She is after all, serving the public herself by educating law enforcement.
    Most municipalities have law on the books against misuse of emergency services/911 call.

    Hey cop...you gonna arrest on here say? Go get an affidavit from the store owner or manager describing the civil tort...that he has suffered. Even if I went into the store on the "public invite" it ain't a trespass unless he asked me to leave and I refused....then and only then is it a tresspass. Please.....learn the law.

      2 ways to tresspass, fail to leave a private place when asked, or continue onto a well stated private property that says no tresspassing. that's it, nothing else is truely tresspassing it is complete opinion after that and inadmissable in court, but they can still claim tresspass and book you into jail, of corse, always be prepaired to spend a moment in jail when flexing your Civil rights.

      Why? It's good to put them right on the law, as these cops don't know it. Then any arrest or dentention can be challenged later, and they can't say they were not aware they were doing wrong, but yes never give any other information.

    His supervisor stated he saw no policy violations. He stated he and officer Crawford spoke in depth about how he could have communicated better with me. I told him I hope this serves as a tool resulting in this officer doing a better job in the future.

      @@Thorkmalin1970 You're not making sense. First you're talking about someone filming public officials in a public place. That's very straightforward. But then you come up with something totally out of the blue and talk about arresting a citizen for "wiretapping". You're talking two entirely different things here. There *are* wiretapping laws, and if you want to refer to an appellate ruling or recent case law rulings, go right ahead. LASS is one of the most complex area of law enforcement, as any cop will tell you. That is why, among other things, we subscribe to the POLS online, and with that app, we can bring up current case law in seconds. I used it when I first started in police work, back when there was no such things as "cell phones" but we did have "car phones". Remember the little black antennas on the rear windows of cars with the little squiggly portion at the bottom that connected somehow through the window and into the main "box" of the phone (which was usually in the trunk, with the headset mounted up front somewhere). Back then, I subscribed to the POLS also, except it came in a big binder with quarterly updates where we tossed out old pages and put in new pages with new laws. Without that sort of reference, it's impossible for a cop to keep up with changes in LASS except for the big ones that the DA's office fills us in on. We're not lawyers, we're cops. And we're not impressed when someone knows statutes and talks like a big shot. I've arrested lawyers before and my cases were both convicted just fine. I've arrested physicians, and I even arrested someone that I can't talk about even to this day but he was in the military and beyond that, I signed an NDA that is valid for life unless they tell me otherwise someday.
      So my point was simply to say that a citizen absolutely, positively CAN be arrested for wiretapping. That's why I don't understand what you're talking about. You or I can't go out and wiretap someone right now----we'd be arrested, and rightfully so. I'm bringing this up because, I'm sorry, but there are a lot of moron Milienials on RUclips and if they see what you wrote with a bunch of numbers and letters, they'll think you're a lawyer who knows how to "show it to the police!!". We don't care what someone's occupation is. We just enforce the last to the best of our ability. Thank goodness I'm retired from this mess. The BEST tool to ever come to law enforcement: the video camera that officers must wear these days. BEST BEST BEST idea EVER!! I always kept a micro-recorder in my uniform pocket, and I could hit the "Record" button LEGALLY if I thought someone was getting ready to make things up and complain about me. We have a sixth sense for some things. That micro recorder saved my ass more times than I had hoped, but it served its purpose! People who complained about me using profanity, or calling them names, or treating them poorly.....I just turned in the tape to the watch commander and said, "Listen for yourself--I've got the whole thing right here'. And now, most of the left wing anti-police groups (the ACLU, the SPLC, etc) who were the groups BEGGING for cops to have to wear a camera are now suddenly turning their whole argument around and are saying "No!! We don't want them wearing cameras. It violates our right to privacy!!!". HAH HAH HAH!!! I love that. REALLY love it. They wanted cameras to "prove" that we were doing so many things wrong. But it backfired, just as we predicted. Now instead of catching us doing something, it's showing what we really have to deal with on a daily basis. And these minority groups hate it because it shows dirtbags as dirtbags, and nice people as nice people. In other words, it's the truth. The video does not lie. AND WE LOVE THAT!!
