when the government acquires the cultivable land of a farmer and uses it for industrial purposes and announces the award after many years, does the government look to compensate as agricultural land rate or land as industrial rate?
Asp per the judgment of Supreme Court after struck down of section 3J of NH ACT 1956, in union India vs Taremsingh case, farmers whose lands acquired after 1997 eligible for filing solatium ,12p.c additional market value by filing before Arbitrator/Dist Magistrate.Is there any clarification/guidelines issued from NHAI/ Ministry of Roadsand Transport.
Who will get compensation from NHAI? In below different scenario
1. If land is sold after 3a notification .
2. If land is sold after 3A notification.
3. If land is sold after 3D notification
4. If land is sold after sanction amount declaration
U can't sell land after 3a 3d if u sell the amount wil go to privious ownner / the person who sold it

I have not filed reference application since 9 years as award passed by collector in 2015. I am not satisfied with award now want to move an application under sec. 64 of said act but it's bared by law. Is there any SC Hc ruling where sec 64 application allowed after many years.

Nowhere it has been clarified whether escaltion/ intrest will also paid on basic value of building also or it will be only on basic value of land. Because definition of land in section 3 ( p ) includes things attached to the land
Severance applies for la 1894 act for old cases ? Or any limitation act applies to the old cases
Most of the time buyers are registering at slight above the circle rate. So how can Collector decide the Market value. In Ahmedabad difference between market value and circle value is 4-10 times.
can different compansation given on the same land ? such as can it be possible that gata no. 10/1 get different companstion then gata no.10/2 ..meanis the same peace of land ?
Dear madam,
In may 2022, our land was notified for acquisition by Bangalore development authority, recently Supreme Court January 2022 judgement says bda need not give compensation according to 2013 act, after this can we expect compensation according to 2013 act
I need to know that , What will be the impact of the judgement dtd. 06-03-2020 of 5 judges bench of Hon'ble Supreme Court (regarding land acquisition cases sec. 24(2)) , on the metters decided on 31-08-2016 by the double bench of Hon'ble supreme Court of the same nature. Will the effect of judgement dtd. 06-03-2020 is retrospective or prospective.

What will be the status of acquired properties sold between 2013 to 2020 I.e. judgment of SC in Indore Development Authority. Vs Manohar lal. Sale is valid or authorities to give fresh notice for those properties which have been sold.
Any new judgements for A-port karab land which the HC paid by 100% compensation.

Kindly give your attention to this issue also as it is highly related to the life of farmers , jamindars and land owners .
In the year 2013 , land acquisition act 2013 was implemented on the replacement of old English land acquisition act 1894 . In the act 2013 relief was given to farmers, jamindars and land owners from the high handed ness , unfair deals and forcefully acquisition of their lands .
But vide a judgement dtd. 06-03-2020 of Hon'ble Supreme Court 5 judges bench , the said land act 2013 is again silently converted into land act 1894 , now the land act 2013 is also likewise to the black English land act 1894 , totally against the farmers , jamindars and other land owners , But Strange no one is talking about this , sab chup hai🙄
The judgement of 319 pages of the 5 judges constitution bench of Hon'ble Supreme Court dtd.06-03-2020 in land acquisition matters related to Sec. 24(2) etc. Of land act 2013 , should be / must be withdrawn immediately in the public interest.

To my reading in paragraph 363 of judgment it appears retrospective but there is no such clarification on the sale of properties between march 2016 till the Indore Development 5 judges judgments. All are in limbo.
