    Swatting is harassment, the reason it happens most often to streamers is 1) streaming can expose your IP address which can be used to find a person and 2) the swatter can watch them get swatted on stream. To frame it as a thing between angry gamers is not entirely accurate, that happens but I believe it’s more prevalent in situations like VTubers being fished by spoofing a popular VTuber network to swat them. Part of the problem is the prevailing wisdom of swatting is “don’t talk about it or people will do it more” however I believe that’s a naive approach, and education is necessary to save lives, not trying to hide information in the information age. Willful ignorance is an approach destined to fail, we gotta talk about it, raise awareness and work toward proactive solutions to this real threat to human life.

      If someone dies, it’s not just harassment, it’s manslaughter at best and murder at worst. (And even if someone doesn’t die, it can still be charged under “attempt” theories of some categories of homicide.)
      If you’re in a jurisdiction where it is a felony to make a false 911 call with knowledge that the call is false and intent that the reasonably foreseen consequences of a 911 call happen, that would trigger whatever the local felony murder law is (if someone dies).
      If we’re really generous and say the call could be characterized as the commission of an unlawful act not amounting to a felony, or in the commission of a lawful act which might produce death without due caution and circumspection, that would be involuntary manslaughter.
      Under the law of principals, anyone who intends that a thing be done, and does some act or says some word that causes or helps another to do that thing, is considered to have done the thing themselves. (A common use is to charge first-degree murder against the hiring party in murder-for-hire plots, even though they weren’t or wouldn’t have been at the scene of the crime at all.) So if someone calls the police with the intent that the police shoot the victim, it could legally be charged as though they had gone to the person’s house themselves and killed/attempted to kill the victim.
      The biggest complication is a jurisdictional question. Most of what I wrote above is based in federal law, because most SWATing is going to be across state lines (if not country borders), however, because 911 isn’t a federal resource, the lawfulness of various 911 calls will be state-dependent. The question becomes who prosecutes and under what choice of law. That’s the part I would like to see worked out more cleanly.

    • @YawaruSan
      @YawaruSan Год назад

      @@jacksyoutubechannel4045 yeah, when I say it’s harassment I mean that’s the best case scenario, it will never be anything but harassment and only gets worse from there. I use nomenclature like that instead of calling it a crime for reason you listed. It should definitely be a crime but depending on how it’s perpetrated it’s hard to make any legal recourse, and there have only been a handful of prosecutions. We really don’t have an adequate solution to handle the problem, and not talking about it isn’t making the problem go away, it just buries the evidence that not talking about it doesn’t work.

I responded to the police officers and said they are welcome to come on in because I was curious to know what the situation was and what I had done wrong. They told me they had a call that I was going to kill myself and I told him that I would never do anything like that since I value life too much and they understood. Fortunately for me the police were very respectful toward me and I intern was very respectful toward them and I thank them for what they did and said sorry if I created any trouble for them. The intern said there was no trouble and they just wanted to make sure I was OK.

      It's called SWATTING..Someone makes a false call to the police to get a bunch load of police at your home,they usually state the person is going to kill themselves or others as that's what gets a bigger armed response..and if the police think a gun is involved, officer's safety comes first,fire and ask questions later depending where you live..

Player A got mad and called 911, he said that the Player B was going to light his house on fire and so SWAT officers rushed to the scene and when they arrived player B was standing outside with his hands in the air and since it was described as a hostage serious moment. The police acted quick, too quick. And shot player A...
      Speed didn’t script this, a viewer probably wanted something to go down during the stream and so he’d called the cops on IshowSpeed basically saying that he wanted to hurt his family and so the cops arrived, luckily they handled it ok and everyone was safe. How about you see it from the perspective of someone going through it instead of the officers. Imagine you're going about your day and a bunch of cops rush in and put you in cuffs immediately without telling you why they are cuffing you. Then they put you in a cop car like you committed a crime. The whole time your explaining the situation and none of them are actually listening to the explanation.
