The real story is that she got just $1 from her insurance and needed to sue her own nephew to get his insurance to pay. In Connecticut, where the accident took place, state law requires suing the responsible individual for injury insurance claims.
Thank you for posting this as I was about to. It’s just another example of how fucked up the American Health system is. This kind of case happens far too often and her lawyer just targeted the wrong responsible party. The focus should have been on the parents or just sue the parents home insurance for damages. No jury is going to find against a kid who was excited on their birthday.

But if they don’t want to be arrested and fight the cops and they start being difficult, they would need some help to calm you down so they can arrest you. That’s where the taser comes in. The suit case is misrepresented here - the sue was forced by the aunt's insurance company, and in order to get her insurance to pay for her medical bills, she *had* to sue the 8-year-old. She hated having to do so, and they actually retained strong family ties - both sides understood that the suit was purely because of the insurance's insistence.

Why didn’t she just get some scissors to free herself? She clearly didn’t care about the shirts since she was stretching them out so much, so cutting them seems like a good idea. Also, did it never occur to her that you should start with the smallest size you can wear and progressively go up in size as you add more layers? The material in the shirts probably made a difference as well. The thin cotton button up shirt sounds much better than t-shirts. Though any way you do it, putting on too many layers is dangerous. You could suffocate from the pressure. I don’t think CPR could possibly be helpful in any way with that many layers. Reasonable people don’t do things like that.

There is a segment on Last Week Tonight (Public shaming episode on RUclips, approximate minutes 3:12-6:50) about the aunt who sued her nephew. She sued her nephew because her health insurance wouldn't cover her nephew breaking her wrist and the only insurance that would cover the cost was related to (if I remember correctly) the homeowners insurance of the aunt's sibling, but to trigger this clause of the insurance she had to sue her nephew (per the legal rules). Also, if I remember correctly the aunt sued the nephew with parents' consent. She also went on the Today Show with her nephew to explain this (according to Last Week Tonight segment which included accompanying footage).

There is a segment on Last Week Tonight (Public shaming episode on RUclips, approximate minutes 3:12-6:50) about the aunt who sued her nephew. She sued her nephew because her health insurance wouldn't cover her nephew breaking her wrist and the only insurance that would cover the cost was related to (if I remember correctly) the homeowners insurance of the aunt's sibling, but to trigger this clause of the insurance she had to sue her nephew (per the legal rules). Also, if I remember correctly the aunt sued the nephew with parents' consent. She also went on the Today Show with her nephew to explain this (according to Last Week Tonight segment which included accompanying footage).

The aunt had the parents permission because they were not able to pay the medical expenses from her arm.
She had to go through her homeowners insurance and in order to do that she had to sue and name her nephew as the plaintiff.
But I thought the same thing until I heard the story.
Misleading story. She didn’t actually sue.
