- In a big move today - the Supreme Court of India upheld the 103rd Constitutional Amendment that grants 10% EWS Quota - for Govt Jobs & Education - also in Pvt. Educational Institutions. But the bigger question posed by the SC might just reignite the controversial Reservation debate..... not only the dissenting judges - those in Majority also wondered - till when will Politicians use quotas a tool?

Open: 40.5%
GO PRACTICALLY ,UPTO WHAT %TAGE OF SEATS A PERSON FROM SPECIFIC CATEGORY CAN CONTEST:
OBC= 27 + 40.5= 67.5%
SC= 15 + 40.5= 55.5%
ST= 7.5+ 40.5= 48%
EWS= 10 + 40.5= 50.5
General (who dont come in any of the above)= 40.5% only
In debate of reservation, most people dont know or knowingly don't want to discuss these things.

Ews is a gift to us the general student, admissions in India have never been on the merit but just the caste of the individual. Ews is a very good decision by the government. If people have problems with this specific reservation they should cry too for the SC St Obc reservation to be banned because that's equality.
o really ?? Do u know what is the said population of all categories? pop(Gen)=15%, pop(SC+ST+OBC)=85%. How many people r in BPL list of Gen? If it is 50%, then 7.5%(Gen)=BPL. They hv got EWS quota, then what abt
BPL= (SC+ST+OBC) nearly abt 40-50% of their population, according to Sinha Commision Report (watch 7:00-8:00 min)?

100% right Akash for years I thought why aren't there so many colleges and job openings so that we absolutely don't need reservations but due to corruption, polarisation and apathy there's cut throat competition for few available avenues.
And these "few avenues" or limited seats or opportunities are artificially made and given to prevail. Therefore, the problem tends to prevail indefinitely and so the reservations. In a single year, many thousands CR (approximately 10 thousand Cr) are spend for NEET, JAM, etc. If we invest such ammount in making good institute and providing good quality education, we don't need reservation at all. That would have been real progressed or progressive society. But, no, we invest money in coaching, but not in good quality education imparting institutions. In the same way, we do not create job for every citizen according to their skills. If jobs are available for every prospective citizen there is no such requirements. So, the reservation policy will go on most probably for indefinite time. When a teacher or professor get retired, that post is left vacant for many years. And in between, who ever comes out from that institute, become a deformed product. That is our truth. How can one expect Socio-economic equality in this country and in such scenario? And among such corrupt people, especially officials and politicians!

The reason is that... reservation can't end discrimination even if we wait for 200 more years...but we should make strong laws for it...

Last time I checked the existing reservations were for the "socially discriminated" and "backward" classes. There was no reservation based on economic grounds before this new EWS quota.

I strongly agree , the main problem is not having checks and balance , and it leads to misuse of such ammendments .
I think government should make a barrier that a person who has this much salary or property then their children will not get reservation that's all and other people below this irrespective of cast should get reservation ... And reservation must be applied for tier 3 jobs ... It must not be applied for Doctors ,engineers, ias , armed forces because here this will be dangerous in upcoming future.

@@nitecedemon152 Dear frnd let me tell you cutoff of Backward class is due to less competition in there seat which is mostly due to lack of participation which is mainly because such categories doesn't get facilities like most of student.
For example If in a college there are 100 seats of which 30 are reserved and 70 are general. Now if out of 30 seats only 40 backwards students give exam what will be cutoff. In second case there are 70 seats for open and 500 general students gives exam now imagine level of cutoff

Can any body tell that, out of these 5 Justice, how many belong to SC/ST/OBC?
Simply you can see here a great example of representation in judiciary of these class. Around 80% population of this country belong to SC,ST & OBC but they are nowhere in Judiciary, University, Media, Higher post of Defence, Secratriat post etc. and we still believe that they will serve social and financial justice.

Reservation system should end after 7-10 years in this matter of time , govt should build enough educational institutions to reduce the high competition and stress among students. Success of nation comes through deserved ones not reserved ones. We got many talents but not enough opportunities.

Economic way of reservation is much more effective than caste system reservation. There are many General category students who belong to poor /middle class family who don't get any benefit, whereas many SC / ST students with good family income are getting benefitted. To note that their parents were also benefited some years ago, there children will also get benifits after some years. This is totally flop plan. Dr BR Ambedkar told that this reservation policy should be eliminated after 70-80 years but I'm not seeing any such chances in near future. This shit system will go on for ever.

As a general student it hurts to see reservations taking away seats from deserving candidates. Though backwards classes exist but my OBC frd is richer than me and still can have benefits of reservation. Living in the dark ages 💀🌚

Such an informative video more than educational institutions! But from social reality perspective which you spoke,is absolutely undeniable because the incidents that are coming out of central states like Uttar Pradesh ,Madhya Pradesh and Chattisgarh are very much disturbing in terms of heinous crimes thats takes place without any news coverage and also its really important to emphasise as to how some regions in Northeast India are so much socially deprived of basic necessities like roads, healthcare services , education a village level , and the continuous corruption by the governments running those is extremely sad as even after 7 decades of independence still there are people who doesn't know about how life is outside those rural ares due to lack of importance by the governments . They are being used only as vote banks before elections and are hallucinated with fake promises. Its really disheartening as to how we as a human are running so much behind power and money, degrading the humanity in ourself. ITS TIME EVERY LITERATE PERSON STANDS UP FOR THE MISHAPS EITHER DIRECTLY OR INDIRECTLY OR ELSE WE ARE GONNA SUFFER MORE IN THE COMING YEARS.🙏

absolutely agree with you why aren't their more universities and more hospitals . In the end they put more reservation. introduce new quotas to gain votes and then most of the burden and stress fall on middle class general people. Because of reservation many people who are not capable or are not deserving get the seats in college's and job's which goes wasted .
Why not we demand on creamy layer and non creamy layer .... It should be the demand for sure.

As the Hon’ble Court pressed for the justice in the form of economically and socially, it is the obligation of the State to provide to the needy people who are actually in need should get the fruits of the Amendment. The point to say that the Hon’ble Supreme Court is trying to do justice to all but the Government should not encash the same and lure the political mileage. As you have explained the incidents in the video as to be eradicated in society and work for the harmonious progress.

In maharashtra for mes 2021 exam total seats for AE was 186 and out of that only 14 seats for general male category🥲..reservation is 60% only on paper..we also have 30% reservation for women..

Only 2 per cent Indians earn more than 8 lakhs per family. So what makes such exclusive section economically weaker section. In fact only 10 per cent earn 2.4 lakhs per family So even if EWS is there it has to be less than 2 lakhs per family.
This is wrong info , there's other criteria too , where you breach anyone , and you're excludes from EWS
Like a house of 1000 sq feet in municipalities or 2000 sq feet house in panchayats.
Just this criteria excludes 90% of people from EWS category.

@@deepak62064 Learn to study data and not draw your own conclusions. 1000 carpet flat in Mumbai would cost you 1.5 crores in Dahisar to 8-10 crores in Juhu or Napean sea road. That is EMI of 10 lakh to 50 lakhs a year. All figures given by me were based on data published by Indian government.

Excellent!!!...government's record of poverty alleviation is at best average, that is why we have EWS frustrations spilling over. Same is the case with their performance on reservations for backward classes. Review is a must of both legality as well as the delivery on these laws. and then there is the recent attempt to wipe out the dilute the Forest Rights Act entirely, no doubt as a society we continue to marginalise SCs and STs.

Two points:
First, Indira Swahney Judgement for 50 percent ceiling limit was delivered by a 9 judge bench. How can a 5 judge bench overturn a 9 judge bench decision?
Second, why no one ever questions matrimonial sites which have caste based segregation of people? How can a society be called casteless when caste plays the most significant role in marriages. Ambedkar was right Endogamy is Caste and Caste is Endogamy. But there is no backlash against these matrimonial sites.

In addition why there is a caste column for a nursery class child in his/her diary which is useless ? Children are being taught about castes by their schools from the beginning.

In my opinion all SC , ST , OBC , Gen. Reservation should be removed and only EWS Reservation for all castes should exist . Because not all Gen. Are rich and not all ST's are poor in practical life .

We also need to think sectors like agriculture which have gone unprofitable businesses and most of the new casts demanding reservations in past 10-15 years are primarily agrarian. We are feeding country with loss making entrepreneurship, with no support from state and highly unreliable market.
Akash you missed a couple of important points:
Firstly, reservation is not a poverty alleviation mechanism, it began initially for two reasons: a) to correct historical injustices, b) to uplift sc/st and improve their social and economic position
Secondly, till now (before this judgment), reservation was given only if scientific data was provided proving: a) social and economic backwardness of a community and b) lack of reservation in that particular field
Now, here lies the problem with ews reservation:
a) it is provided to socially advanced class
b) provided to a class that is well represented in all fields especially government jobs
c) also, reservation was not based on sufficient statistical data: it is unclear how many members from the Upper Caste community are economically backward
This judgment is not legally or logically sound. I think for uplifting upper caste poor individuals: poverty alleviation programs such as subsidises, housing etc (which are already provided by the government should be considered)
Also, lastly: some judges on the bench are very conservative and are openly anti-reservation and have failed to uphold the rights of citizens on various occasions.

@@kumarexam4792 In many states, they are less than 10%. I am not sure, how 10% was decided. This is going to allow widespread income manipulation and EWS certification to fill up the 10%. The worst part is the observations are made without taking into consideration of representation instead of merit. Today the judgement is biased because the judges represent their minority upper class constituency instead of upholding the law. Instead i would have welcomed a law to fix the creamy layer problem in SC/ST/OBC.

The Ground Reality of India is, Upper caste people supress to lower caste persons and there is no end of casteism in India today too. Although upper caste holders will weak economically but they treat us( SC /ST /OBC) unequal with them, it doesn't matter that how rich we are😓
EWS is fine but it's implementation is flawed. For example, an assistant professor post can be reserved for EWS, however an associate professor's post or professor's post cannot be allotted for EWS, as assistant professor's income is not less than 12 lakhs per annum 🤔
