    Given the prospect of a delay, Smith should file a superseding indictment charging Trump with insurrection in DC.

      JERK SMITH can't charge President Trump with insurrection because he knows, just like everyone in the DOJ, judge and person with common sense knows that even the distorted portrayal of Smith's proposed criminal charging facts does not rise to the level to fit a charge of insurrection.
      That is why, to this day, no one has been charged with the insurrection statute. The most basic conclusion to derive from this is that the DOJ agrees with the investigative finding of the FBI, that being no insurrection occurred.

    The cell tower pings, only confirms that the PHONE was in the vicinity - but CAN NOT verify who was carrying it.

    Phone cell tower pings are known to be outrageously inaccurate, no? And not admissable evidence in courts as to proving locations.

    Enjoyed your collective commentary very much. Just subscribed. Ben, your allusion to the OJ Simpson case is perhaps more prescient than you realize. The smart money is on jury nullification in the big Trump cases. It only takes one Trojan Horse juror.

    I think this drilling down on cash expenditures w/ Fanni Willis to be ridiculous. I always have a stash of cash having grown up w/ absolutely nothing and my mother counting on me to accumulate coinage. I keep an accumulation of cash to which I deposit every 2 weeks according to whatever I have left over from my self-determined payday allowance. Additionally, in testimony, Fanni's father testified to being placed in a very awkward and disciminatory situation where he was forced to come up with cash, not allowing any other form of payment. This trial and testimony revealed to me how racism is alive and well in the US especially in the South.

      The lawyers for the indicted defendants dripped of racism continuously. These white lawyers lost their supremacy in Atlanta years ago & they want to rise again. It is the Civil War Reconstruction white obstruction redux. The defense relied on the old racist tropes of Black sexuality (black people can't just be friends) & untrustworthiness, and cunning dishonesty. They disrespected Mr. Floyd great statue internationally & his experiences with inbred American racism, ridiculed Ms. Willis private & public life & discredited the career of Mr. Wade. Then, hyper-hypocritically, the closing argument for the denfense doubled down on their racism by shamefully accusing Ms. Willis of introducing racism into the court proceedings!

    Why, oh why is the DOJ playing by the old rules when SCOTUS is NOT? Just try him and let the SCOTUS try to stop it. Merrick Garland needs to go if he won’t bring it to trial.
