    Adv John is very well versed with the law and unbiased, and I respect her views which are very much based on facts relating to the case as well as earlier judgements passed.
    However, those persons who purposefully decided to release the rapists without proper procedure and proper consultation should be severely punished too. Or fined heavily, so that such is not repeated.
    Also the organisation or the persons who garlanded and sweetened the convicts' mouths, must be made to pay for this by banning the organisation or fining the individuals. Let this correction be seen by the entire world so that they will know the Indian courts have spine and stand for Gandhiji's 'Truth'.

    Yes all the cases prosecuted by C.B.I how come state govt. Jurisdiction for any remissions, it is shameful act , I hope Hon,ble high court n SC will take action according to law

    Apart from technical aspects of law , common sense in other words wisdom says the right of remission/ pardon is the domain of victim/ victim family , because they are the sufferer of crime and bearing the pain . Government and justice system only vehicles of delivering verdict and execution of cases . They can only execute , if any request of remission/ pardon is recieved from the victim / victim family , because they are main object and objective of the case on which justice system revolves . Government and justice system rationally not authorised to bring changes in orignal verdict of the case with out the concent of victim /victim's family .

      Yes it's a curse. 400plus articles and on and on no end but when it comes to justice Failure is the result. After retirement only auto biography comes what happened during their tenure.

      It is the opposite of what you say, the judiciary is a blessing to the nation! I don't know how people could say the opposite of what is actually the case. What has the world come to... As a law student am I crazy to study law and aim to be a judge when "judiciary is a curse to this nation"? I have not seen the video fully but at least in my opinion judiciary is a blessing to the nation and the people that go against the nation, that is a very different issue but judiciary in general is good and extremely wholesome.

    This is a shameful decision ever. If the criminals and rapists are given sweets then this is most shameful
    decision which cannot be digested by the victims of the horrific and henious crime. Shame on Indian politics, parliament and judiciary and also the blind followers of political parties in our country. Very Sad situation.😠😡💔

    After hearing this points of law governing such action/decision, I hang my head in shame.. because under such Dynamic Chief Justice of India are these learned Justice of our Hon'ble Supreme Court who have ignored the direction of constitutional bench of the Hon'ble Supreme Court. What is now remaining, the fear is already building up, after another 2 to 3 year, I wonder how the Highest Court of this country will act, and protect whom. I can only pray to God to give them the gift of working fearlessly for the cause of mankind abd to safeguard our rights enshrined in our Indian Constitution. Jai Hind, Jai Bharat.

    Look they may feel, that lying low on the pretext of professionalism can save their skin.

    This is the intellectual rot of our lawyers. Rather than call for changes in the remission system, they straight up declare that Govt is unconstitutional. That's just plain bad advice and comes off as all rules for thee but not for me.

      For the part of Remission - SC laid grounds of Remission in (Laxman Naskar V. UoI) (2000)
      More so, in 2012, SC invalidated the Gujarat State Government's policy(1992) to reward remissions because of its unconstitutional nature.
      However, in the current case, the Council held jurisdiction as the case happened before 2012. Despite this, the unconstitutional nature of this policy is irrefutable.

    This perverse judgement by Guj high court shd be taken cognizance of forthwith _suo moto_ and overruled. Otherwise the Apex Court is likely to be in error and invite further vexatious litigation over this matter in the high courts and the SC. It was a hypocritical statement by the PM on the 75th independence day. Women will not be empowered in this country in this climate of victimisation and blackmail. Wake up SC. Your honour is at stake.

      Look up "per incuriam" - a case settled with lack of care. This, however, was not the matter in this case. Remissions aren't granted on such grounds.

    "Justice must not only be done, but must also be seen to be done”
    The judiciary and executive yet again slacked in their duty.
    This action by the Gujarat govt to release these monsters is a direct slap on social justice in India. It has been evident ever since the case came up to the Gujarat High court in the first place.
    1) Gujarat High court dismisses stating "lack of evidence" and thankfully the NHRC stepped in with the help of SC and the case was taken up by the Bombay High court.
    2) The Gujarat state govt had tampered in the case (Police personnel and Doctors) and the case was given to CBI
    After verdict and conviction and all these years, the ball is back in the court of the Gujarat Govt? What would u expect they'd do?
    This is outright deliberate in intent! If this case goes to court, the focus will be on the "Arbitrary" nature of the decision taken by the State executive, i.e., the committee constituted by the State govt to release such pathetic low-lives out!
    Where is justice in this country?? What kind of message is being sent to the society?? Can't believe polarisation in politics is above basic human courtesy and ethics. Not enough that our leaders shout slogans of Nari Shakti and Beti bachao on independence day, if ur mouths are zipped at times like this when ur hands carry out such injustice in the name of remission.

Of India, which is scilent in this case, may be supporting the result, due to political compultions, though it is illigal, Do these authoruties send message to the people of India, that the jusiciary of India is not reliable for getting the justice,and people instead follow the method , used by Fuulandevi ,years back, that is the victim or victim keeens should take their revenge in person, and murrder the culprits . Then only the justice will be done.

    In the case of Bilkis Beno, the accused did not do it intentionally, but this was also a crime committed in the context of the riots that happened then. However, it is fair to let them go as they have lived a penitent life in prison
