Before Super Mario Run hit the App Store in 2016, Lep’s World was basically the only way to play a Mario-like platformer, so cut it some slack. Fun Fact: The original Lep’s World game is now broken. You have 10 lifes in the game and when you lose one it doesn’t take one off the 10 you have anymore, making so you can’t get a Game Over anymore.

Well because in a legal sense there is no difference between a rip-off and a fan project. There is obviously a difference in intend but legally there isn't. So if they would allow high profile fan projects then other companies could start calling their ownership of Mario's IP into question. Nintendo could endorse some games like Sega has done but they are hesitant of acknowledging projects done using their IP's that they had no control over. I do see Nintendo changing this though. As programming software becomes easier and easier to work with and the amount of internet users continues to increase the Nintendo fan projects will only continue to increase in quantity and quality. Nintendo can only keep ignoring them for so long.

It's not even the same shade of blue, and the clouds are down at the bottom, along with a city. And Flappy Bird had a whole different type of gameplay and art style. I do see Nintendo changing this though. As programming software becomes easier and easier to work with and the amount of internet users continues to increase the Nintendo fan projects will only continue to increase in quantity and quality. Nintendo can only keep ignoring them for so long.

People were saying flappy bird was takes down because two guys got in a fight cuz one of them beat the others high score and then the other guy was threatening to kill the him, which is why app stores didn't want to be associated with the app. So even if Nintendo told them to stop that not why some people think that it was taken down.

I wouldn't call that a rip-off. He didn't try to deny that it was Mario. He pretty much openly said he made a Mario game for the 2600. Fan games and fanfictions aren't rip offs as they openly admit that it's about existing material.
I would think a "rip-off" would mean that something is denying being a copy or a version and pretends to be it's own thing.

Flappy Bird didn't rip off Super Mario Brothers. And no, the background looks nothing like Super Mario World. It's not even the same shade of blue, and the clouds are down at the bottom, along with a city. And Flappy Bird had a whole different type of gameplay and art style. And for those who think the bird looks like Cheep Cheep, I do agree. But the thing is, Flappy Bird just took iconic things that everyone knows about so that they don't have to introduce anything.
