From what I understand there have been people taken into custody and have sat in jails for months without being charged which is a violation of the right to due process.

Ramon you might want to do research before making such outlandish claims. The most glaring inaccuracy is that a state sets bail for state crimes and a federal magistrate sets bail for federal crimes. Federal detention does not provide bail as a given. If you really believe there is a double standard you are right but not in the way you believe. Historically in state courts in our past minority suspects who could not afford the higher bails set for them would often be afforded pre-trial confinement. Judging by your post you are a conservative and we do need liberals and conservatives to make this country work. The distinction between jail and prison is purely a matter of semantics. Jails are for pre-trial confinement, prisons are for the convicted. Detaining a person without due cause makes no distinction about the facility and it's naming conventions.
