      @@batkorub I do not understand why you would think that does not make sense. Nor do I know what you mean by "family institution." But I am not sure that I need to understand that to address your statement. In the U.S., divorce and other domestic relations laws are defined by the state legislature. The legislators can change the law whenever they feel like it. The legislators occasionally make changes, but those changes are not as big as they probably should be. I think the reason that the changes are not too big is that there are political consequences for making changes that are too big.

Cleaning, child rearing, cooking, shopping, keeping track of and organizing all the families affairs, etc. Her support allowed him to succeed that success while also getting to have a family. She deserves the money because of the role she played.

    I don’t think people realize a “prenup” doesn’t have to be cookie-cutter, and it doesn’t automatically mean the wife gets nothing. Anything can be contracted for, like percentage of what wife gets if he’s faithful/not faithful, percentage of her income relative to his before she had kids playing a role in the breakdown, divorcing two years in versus 15 years (sunset clause). The point is communicating with your spouse and dealing with reality and possibilities. Being able to communicate like that also doubles as a marriage skill. I’d rather negotiate my own prenup with my husband than have the State do it for me.

      Indeed! Making a prenup is super important if any of the partners start a business, to prevent the other to be hit by potential creditors. What matters is what you write in the prenup, not the prenup itself.

      Agreed. I honestly think a prenup or a marriage contract is also to protect the kids from any siblings or parents of the married couple. My husband and I (who didn’t have a prenup, but we will end up doing a marriage contract and will) will require for our children if they want to be involved in our businesses. And it’s not just about our kids, the shite my husband and I have been through with our families is Reddit level crazy and it’s not like it’s impossible one of our kids couldn’t get a head injury and turn into a different person, it’s to protect their spouse too. Not just my kids. It’s also to protect them all from both sides of our families. It’s not always about the couple. Id argue it’s only an amount. The more paperwork (will, pre nup, post nup, marriage contracts) saying exactly what the married couple expects the less their siblings can make the kids life hell as an adult when the people die. Believe me, I fully expect both sides of my husband and I’s family to come after our children for any wealth accumulated. It’s always spoken about like “in case of a divorce…” when it should be a bit more detailed than that. I’d argue a pre nup/marriage contract is more important for a stay at home mom because it would clearly outlines what happens if she gets left or she leaves him. Etc. And if the pre nup is in good faith, the man should still take care of her like the situation above. I’m also pro-women having a fall back plan, not because of divorce but because of death or terminal illness. A woman needs to be able to provide to a degree god forbid her husband dies prematurely or gets Ill. I’m in the financial services industry in one of my businesses, and life insurance is part of it. People do die early…

      This. Everyone thinks a "prenup" is just an agreement that both parties don't split financials in the event of the marriage failing, but that's 100% not the case.
      You can make a prenup agreement for ensuring that 50% is split evenly and going over those assets ahead of time. You can make a prenup detailing custody of children, especially in the event of the death of your spouse.
      People don't realize that the point of a prenup is to supersede the legal precedents in place to protect both parties in the event of a failed marriage. This can prevent family members from attempting to circumvent wills if one of the prenup signors dies. It's not always about financials.

      Keeping a home raising children is not easy it take a lot of time and effort… the time and effort the man/woman who is the provider is putting in their career. After a divorce the provider will keep her/his career but the parent raising the children and keeping the home will have nothing of their own and will have to make ends meet at 40s/50s without any experience or any marketable skills … so yes half of everything and alimony.

    Prenup works multiple ways so even if you sacrifice years you can have your own prenup that accounts for those years so that you’re compensated accordingly. Prenup doesn’t just block someone from access to money if there’s a divorce but ensures access as well

It’s just someone who wants to take easy while the other works their ass off, and it creates an unstable home environment most of the time. My mother and father both raised us (3) while working full time jobs. They both did equal parts in it, don’t you try to tell me it’s the woman’s responsibility to take care of the kids, it’s a job that needs to be shared. Who tf wants to grow up with one attentive parent and one neglecting parent. If one partner is fully reliant on the other, what you start to get is negative feelings brewing in one or the other party. You hear stay at home mothers complain about it all the time or the fathers in that situation.

    The thing about prenups is that they’re customizable, so either you agree to the terms of the prenup that both parties agree to or you get whatever the court decides. A prenup doesn’t necessarily mean that you’re left with NOTHING. But it does prevent someone taking HALF of your possessions

    Ppl have such a toxic view on prenups. It's just like a living will and you can design it however you want. The biggest reason you want a prenup is when you don't have one you turn over a divorce to a judge because marriage is a legal contractual document and if you have a prenup it avoids a judge and protects both parties from money hungry divorce lawyers that always make it worse. Look into prenups and understand you literally can design it however you want. It's not just 'what's mine is mine and what's your's is your's.' Aaaaand you can adjust the prenup whenever you want so with unexpected life changes happen you can update it. Sounds like a will doesn't it?

Like you guys talk as if 90% of men are wealthy when in actuality that is far from the case, most divorce cases - The woman gets nothing because there is nothing to actually take.
      Marriage is 100% for the protection of women because the whole point was that women didn't work and stayed at home with the children, so if their husbands left or died they would be able to keep houses, etc. As she said - If you want your wife to stop working and have kids/stay at home - Then you better be prepared to sacrifice half the shit because that is fair - She gave up a career so that you could build one, whilst she cared for a child/children.
      As for Divorce is started by women... you realise the statistics for divorces is miniscule comparatively so despite "75% of women starting divorce" its only about 15-20% of couples that are actually getting divorced. So its such a heavily favoured contract, yet women aren't breaking it anywhere near as much as people pretend they are.

Men don't want to go in with everything and live with nothing, which is the case in so many of these divorces. Women sacrifice their time, dignity and potential for assets when a husband asks them to stay with the children, if he then decides to divorce she is left with no assets and livelihood. Nothing is stopping her from having a job or making her own money. The woman can step up and help out and now leave the husband stretched out thin just to support the household. A good woman would need a prenup.

    I agree. I’m a stay at home mom. I haven’t worked in 8 years. If my husband were to leave me today I would be so screwed. I would need him to help me get on my feet and provide as he has been.
    Getting divorced would cost him more money in the long run. Good we have that off the table and work through everything.

    What some people don’t realize is you can also add stuff to your prenup to ensure you aren’t going to be left with nothing. Example: you can add infidelity clauses to it. If he/she steps out on the marriage they will pay, if they become abusive during the marriage they will pay. It’s not just a paper saying no matter what you get shit if we divorce.

      Bring married seems like a booby trap. Those clauses added could backfire if a person chooses to get real nasty and lie especially during a divorce. Then it all comes down to who's a better manipulator and willing to bare through the torture longer. I think people who have those intentions after marriage had those intentions prior and during their marriage. Because if there was love at all during the marriage the individual who knows they messed up wouldn’t fight it because they know they hurt the person they were madly in love with.
      There are a number of celebrities that have clauses like these. Justin Timberlake added this to his prenup with Jessica Beil after being caught with another woman. It included a hefty pay (I believe it was everything he owns and custody of their kids). Michael Douglas and Catherine Zeta Jones has a clause in their prenup as well regarding infidelity. And these couples are still married and madly in love.
      No I can see where an Amber heard would flip the script but let’s be real, she was selfish and in it for the fame to begin with and in the end lost.

      Like I am 100% down to put a clause in for time spent child-rearing or whatever. Prenups are just what marriages originally were, contracts. Both parties agree to the terms and you can update it if you want.
      So my perspective is that you should do a prenup every regardless and if the two of you can't have the serious discussion and compromise necessary to write a prenup you shouldn't get married.

    One of my successful uncle got divored by his wife and she wanted 50% of his assets, but funny enough, most of his money was not under his name and was in a trustee with ridiculous conditions 😅
    She ended up only getting $5k from the divorce.

Every woman with more income would've left him. That's why my mother pushed me and my sister to finish university and establish independet lives, first.

      Most women get married and have kids at 28-30 well after college and be in mind the majority of wives make less than their husbands so this means nothing. Most men would be okay if the wife got 20% but not half because alot of the time it’s way more than half

    While I agree with her…the prenup is also there so she doesn’t take advantage of him. Protecting his assets. He will lawfully and rightfully make sure he helps provide for the children. Nearly 70% of women file for divorce. In a lot of divorces a lot of men have to virtually start over.

    These sorts of things can be spelled out in a…prenup. You can specify how much money she would get in a theoretical divorce by number of kids, responsibilities at home, length of marriage, etc. Her argument is a false one; not only do I want to not have to work, I want half of the assets, alimony and child support when I divorce you. Don’t fall for it. Work out ahead of time what you both can consider fair; if you can’t agree, then don’t marry her.

      @@loose505 Yeah but I was (obviously) referring to the fact that she is taking on the vast majority of the responsibilities in raising their kids. To do that she is sacrificing her career, and ability to be financially independent from him. Meanwhile he is sacrificing time with his children for money, which is necessary for this to work. But if they are no longer together, she has sacrificed her ability to build a career, and he has not, so financially she is at a huge disadvantage.
