      good for you. sitting their watching your god video in your armchair. reality is he did NOT do anything wrong. no fault conveys. he was not negligent legally or morally. maybe it will help him with experience next time but inexperience does not equal fault. FACT is the car pulled out failing to yield mere MOMENTS before the truck got their. fault lies with the car. Period.
      the CORPORATION does not want to absorb fault hence why they tried to shift blame convey fault. THE LAW correctly recognized all fault lies with the failing to yield car and that the cammer DID try to take action even if it was the wrong action. there was no negligence in that choice so no FAULT conveys. 100% fault of the intruding car was the correct legal and moral choice.

      @@nerys71 He did not say he was at fault, he said it was avoidable, which it was. He had a full 4 car lengths and he was not traveling at a rate of speed that would have kept him from hitting the brakes, thus avoiding the collision all together.

      @@dcrosby386 Avoidable is literally a MEANINGLESS statement. technically "ALL" accidents are avoidable on some level. the issue is negligence. fault. responsibility.
      it was not 4 car lengths. it was 2.5 seconds 55-60ft or less than 3 car lengths. had that car popped out 1 second sooner you MIGHT have a point. it did not. you do not.
      he had ROUGHLY 2.5 seconds give or take a quarter second from when it was clear something was happening to when impact occured.
      reaction time average is 2.3 seconds. not stopping time. REACTION TIME. you then need to add stopping time on top of that.
      Stopping distance at 25mph is about 55ft. you see the problem yet? its pretty simple math. even if he hit the brakes he PROBABLY would have still hit the car unless he noticed the car exactly at the 2.5s mark which is NOT likely. probably more like the 1.5-2.0 second mark. far too late to be able stop in time. YOU noticed the car right away "I" noticed the car right away. but we are sitting in chairs with perfect vision video and foreknowledge that we ARE going to watch an accident happen.
      STOP TRYING TO WIN THE INTERNET ARGUMENT AND LOOK AT WHAT IS ACTUALLY HAPPENING.

    1:55 all those months of trouble and strife, not to mention the potential financial burden of hiring a lawyer, missing work to go to court, having your car in the shop being held until all the here and there was finalized and a check was cut to the shop to start work. ALL because you chose to "prove a point" instead of brake, damn shame.

    CHP on 4:41 had more than enough to determine the driver of the Prime truck. All prime trucks have tracking.
    All they'd have to had done was to call Amazon.. you have what seems to be the trailer number on the bottom right around 4:13, and the carrier plaque multiple times from 4:15 onwards.

    4:20 the importance of having a quality dashcam and not having crap in front of it that can obscure the view. better planning in placing a dashcam is needed

      Yep. We see quite a few clips were the cam was obviously some $25 Wal-Mart special. If the offending driver sticks around, it will help prove to the police who was and was not at fault. But if the other party decides that he/she has better things to do than stick around, it's hard to anybody to identify the other vehicle if all your cam recorded was a blur. People should invest in a good quality cam. I personally recommend BlackVue and Vantrue, but there are other high quality ones.

      I bought the cheap one figuring the cops would not go after a hit-n-run driver but the image would be good enough to protect me against a liar who stopped or whose car was disable at the site.

      That white rogue was entering traffic, the cammer legally doesn't have to stop for anyone. It is your job to sit there and wait for traffic to clear, not just assume it's clear.
      It's not the law for the left lane to stop when the right lane does.

      @@Metabrowser That was a flashing turning light for the cammer so it means they could keep going without stopping as long as it was clear. They didn't roll the stop light at all. They still should have went into the right lane which would have been better though.

      Need to start with Driver Training. the United States basically HAS NO driver training or requirements to speak of. Pass a physical, eye exam, a stupid test a chimp could pass, and take a driving test a chimp could damned near pass. Basically NO training.
      Decision making skills come from training. Very little of it comes from instinct.

    Man, the amount of drivers that rather use their horn than their brakes in this video is alarming.
    One cammer: "Can you believe this footage was used AGAINST me?" Yes, yes I can
    Another cammer: "They ran me off the road." No, you DROVE off the road instead of slowing down.
    Another cammer: "They encroached on my lane and eventually cut me off." Sounds like you had plenty of time to react to it beforehand.

    1:54 - dry roads, no attempt at braking, you share some fault and Enterprise's determination should have held. Why are people so shocked that there's some onus on you to drive defensively? Your entitlement in hitting someone who got in front of you is why insurance rates are increasing everywhere

      Except that's not how life and reality works. When people take evasive action MOST people make one choice and tunnel vision on that choice. its takes either natural talent or SERIOUS practice/training to overcome this state. This driver elected to swerve. so braking was off the table in the time span available to him to make a choice over what to do.
      even if he thought of braking it was too late. he had already committed to swerving which he correctly canceled because of the other car. Would braking have saved him? unknown. I am not 100% sure it would have stopped the collision but maybe reduced the damage. swerving only requires moving your arms which area already on the wheel ready to do so. braking requires releasing the gas pedal MOVING your foot and pressing another pedal. contrary to what people in their arm chairs on the internet want to think this takes TIME.
      People are also CLUELESS as to how "FAULT" works. fault is not about what COULD you have done. its about what you DID do and what you SHOULD have done.
      NOT MISSING an accident is not a case of fault. it would not add to shift of contribute to the fault of the cammera. 100% of that goes to the person who failed to yield and pulled out in front of another driver period.
      The only way you can transfer fault to the cammer and the REASON cammer won in court/lawyer is because the cammer was not NEGLIGENT. if the cammer made no attempt at all to avoid and had time to do so maybe. if the cammer was speeding. etc.. IE you would have to show some level of negligence on the part of the cammer IE that he did something "he was not supposed to do or be doing" (speeding on the phone riding in the shoulder ignoring some sort of traffic control etc..)
      he was not doing any of that. he was otherwise doing everything he was supposed to be doing and doing it properly
      Mistakenly electing to swerve instead of brake is not negligence. NOT REACTING as fast as you arm chair drivers with god vision video THINK he should have reacted is NOT NEGLIGENCE.
      now if the car was simply sitting their in his way and he ELECTED to simply "drive into it" then and only then could you say "he did something wrong" and there would be fault to share.
      in this instance there is NO fault on teh cammer. he did nothing wrong. MAYBE he could have brakes MAYBE he could have reacted faster. those are maybes those are not negligence those do NOT convey fault.

    1:54 I agree, you had plenty of time to slow/stop but instead, you tried to maneuver around the vehicle. In that much of a hurry that you can't slow down for a few seconds to allow another car to pull out?
    4:41 - don't drive in the blind-spot of another vehicle and then rely on the other driver to 'check their blind-spot' before merging over.

      Yes he failed to take a reasonable precaution; and yes Enterprise gave him a few hundred bucks to make him go away then billed the car renter for it. When I was adjusting I would have ruled 50/50

    #26 - I've reported several bus drivers in our local District for that kind of driving. (I also reported one bus that had a diesel leak that was visible on the road. I was acquainted with the bus manager and she was =very= thankful for that one!)

    Video #1 0:30 - no one should be chasing another driver through urban streets or anywhere for that matter. This "cammer" technically ran a STOP sign. Any vehicle chase puts innocent people - drivers, pedestrians, cyclists at risk for what? To get a minor crash sorted out. Get your priorities straight. It is not worth the chance of injuring someone else to get a licence plate number. ILR Car Control School

      Are you serious with this advice - speed up and use the shoulder? If so, that is some very dangerous advice. That shoulder is not a smooth paved shoulder from what I see and speeding up in definitely NOT the answer. Speeding up and trying to steer on a soft shoulder is a recipe for disaster! They would be much better off simply slowing down and staying behind the truck. ILR Car Control School

      @@carcontrolschool To add clarity I was saying for the driver to speed up prior to the semi merging. It he was driving faster and closer to the black car and not in the blind spot of the semi this could have been avoided to begin with.

      @@SiK2tehTouCh That's not the answer either. That would put them too close to the vehicle in front. At the start of the video they are already too close to the SUV in front. The best move would to be slow just enough to not be beside the semi. One of our "rules" in defensive driving is to never drive beside another vehicle whenever possible especially trucks. To be clear, your advice says "use the shoulder on the left..." which is definitely not a wise thing to do. ILR Car Control School

But it’s different POV from happening in person to you seeing it in the video when I ran that stop sign I looked to see if it was safe, I will say it was clear does not mean it was right of me.

    @4:14 it doesn’t matter which insurance carrier you are with. If the damages exceed over the value of the vehicle it’s a total loss. If there’s significant frame damage it’s a total loss. It’s not about which insurance carrier you have. On top of that, you have the option to retain the vehicle.

    8:36 you're not supposed to turn wide in a single turn lane, closest lane, then merge. yes they should use a signal to change lanes, but you're not supposed to be there in the first place.

      1. its not illegal, in fact, what we're TAUGHT in driving school is to stop at a red light, make sure its clear, and then you can turn into any lane given that it is safe to do so 2. How is it a danger to turn into an empty lane after i make sure its clear? Nobody has brought up a reasonable answer to that. Y'all are the reason the roads are a mess of road rage, getting mad at nothing.

      @@calilee6894 uhhh I didn’t agree with them for fun, I agreed with them because they are CORRECT and have common sense and basic defence driving knowledge. Instead of going off your emotions and feelings of what you think is right because you said so, I encourage you to look up traffic laws.
      Where I live the highway traffic act (section 141) literally says you must turn into the lane “that corresponds to the lane from which the turn commenced”. It’s an $85 fine where I live and points taken off if you do not. Not sure what the heck your driving school was teaching, but I learned to turn into the closest lane, as the law expects where I live (this is also the case in most states with a few exceptions, which could be your state possibly). Regardless, it’s just smart driving whether it is the law in a state or not, especially since there are so many hidden intersections, plazas, and side streets.

    1:57 There is some clown named Nerys that is the only guy defending the cammer and he is completely wrong about fault. No one ever found that the cammer wasn't at fault. The cammer hired a lawyer who filed a lawsuit and it was cheaper for Enterprise to settle and pay the repairs rather than hire a lawyer and proceed with litigation. If this case went to trial or subrogation the cammer would be found majority at fault because a reasonable person could have stopped and it appears that the cammer swerved away and then swerved back to hit the other car.

    #12 On a two lane road like that, with slower traffic ahead in the right lane, the moment the red semi passed your parents on the right it was obvious what was going to happen. Why would he be speeding up with slow traffic ahead if he wasn't about to cut into the passing lane? I'd advise your parents they need to stay ahead of the semi or drop back and give the semi space to move over. This is to avoid an accident, not defend their right of way.

    4:41 Smail Claims. Sue Amazon for the maximum smail claims you can (varies from state to state - in Michigan it's $5,500). That amount should cover your deductible plus any pain and suffering you may have (even emotional - I still have nightmares from the accident that nearly killed me and that was 6 years ago).

      It wouldn't stick since they were in the truckers blindspot (and no, truckers can't check their blindspots as easily as we can in our cars or small trucks) that's why there are signs on the back of semi's and trailers that warns drivers (even with a nifty graphic that shows you) that you shouldn't be there or drive in that area because they can't *see you* and no, drivers shouldn't just outright assume that people are there - if they did that - they'd never get anywhere.
      Of course, this is now changing, more and more truckers are installing blindspot cameras in order to make it easier to see if someone is being dumb and staying in that area.

      @@Suisfonia you have a duty to make sure the lane is clear regardless of what vehicle you're driving. At 4:18, cammer would've been visible in the trucker's blind spot mirror (the one on the nose). At 4:25, trucker should've been able to see cammer in their main side view mirror. And when the cammer was run off the road, trucker would've definitely seen that. Then we have cammer's car horn that trucker completely ignored. Also, it's not dumb to maintain a safe following distance, quite the opposite. If you have a line of traffic in front of and behind you in the left lane, there's a very good chance you have someone beside you. Pop on your turn signal, crack your window and wait a bit. Window is so you can hear a horn, turn signal is to show others what you want to do. As long as I'm not running up on a semi (greater than 20mph difference), I'll them over with a few flashes (high beams during the day, popping headlights on and off during night). This would most definitely stick.

If they were on the right side then they would have been in his blind spot, but on the left side the driver can see clear down to the back of his trailer.     clip 12, 4:17 Lay on your horn, and maintain location, and maintain speed.....is clearly NOT how to handle someone encroaching into your travel lane. Defensive driving skills clearly lacking. Reduce speed, move to the right, and let the truck have the lane since they so clearly want it so desperately. This little passenger car is no match for that 18-wheeler and is going to lose the fight.
