I wish that we knew 100% because my ex wife kidnapped my son for 6 years before I saw him again and he never went back to her...and Social Services was involved and and allowed her to get him back, without even having a place to stay....DSS actually had to meet her while she was trucking with her new boyfriend. They were in an 18 wheeler lol. So, I know how the system can be one-sided and most of the time it's the father that gets "railroaded".

I have much respect for Mr Washington taking full responsibility for the dirty test and not trying to deny it and not complaining about the out come. Judge Simpson is very fair.

Hi Squishy. The answer is No way could I be a police officer, attorney, or judge. The stress and BS would cause me to be in jail or fired or both. The patience for ignorance and stupidity they must have is very much higher than I have.

I luv the way that judge Simpson simply stated that there was cocaine found in the defendant's system then waited silently as the defendant set their dumbfounded and seemingly not understanding it was his time to speak.
I was actually waiting for Judge Simpson to ask if he had a medical cocaine card. It seemed the way that convo was going! 😂😂😂

Staying silent is an old psychological tactic and still used today. Humans can’t stand the silence and then try to fill the void by talking. Try it at a party or a gathering of people and watch what happens. Of course it may get you branded as a “weirdo “ 😊
@OldWomanfromtheMountains I like to do that. Especially when I know or suspect someone is lying to me.
Unfortunately, a person I love has been lying to me for quite a while. It took a family tragedy for me to realize what this person was/is doing. I have had to put this person on Trust But Verify. And all I have discovered were more lies. The thing is, these are lies that don't need to be told. The truth would be much better. When I confront this person, more lies trying to convince me the other lies were the truth. And if I do the silent part, more lies are added until even this person can't keep track of any excuse they may give. I have known this person since the day I was born. So far, I don't need to expose the lies. I really don't want to have to expose this person. There are other people who have caught on and others like I was for so very long, that believe everything this person states. I don't want them to be hurt by the lies, however this is going into legal matters. I will not lie for her in front of a Judge. Because the truth is more than enough to suit her purposes. I've tried to talk to her about it only to have her lie again. So I do use the silent approach. In Court, I won't.

I hope we get an update on that last case. I know it might be boring for some people but I haven't seen an ineffective counsel hearing in the American court system and I think it would be educational. - especially regarding the 2 sides of that particular issue. As an immigrant myself I'm not unsympathetic, but I also see the court's hesitation in setting a slippery precedent.

Oh, there are lots of *bad* "ineffective counsel" claims that come up, especially from SovCits. Kim Blandino pulled it at least once, after his final court-appointed lawyer somehow didn't manage to pull his well-roasted nuts out of the fire. I've seen a few cases in which lawyers screwed up really badly and failed to do right by their clients, arrogantly insisting to the end that they were in the right. I don't think I've seen a case in which a lawyer voluntarily admitted that they had failed their client and that the client deserved better.
We I do not see that all because when someone plea to a deal it is required they understand the full legal consequences and he was not told what all those consequences are especially the one that he could be deported over what many would call a spat. It really take nothing to be arrest for domestic abuse. A tiny scratch anywhere will do it.

Judge Simpson is the man. Genuinely, I love that guy. I would love to have dinner with him and hear all the stories he has to tell. I bet it would be legendary.

In the last case, most people are focused on the wonderfulness of Rita White. I couldn't help but focus on how the defendant's wife is showing every cue with respect to being a DV victim.
Just seeing the possible deportation case and man I am impressed with the attorney taking responsibility for the misinformation given to the client. WOW I am amazed. Judge Simpson is in a tough place in regard to accepting the plea or not to. He's so intelligent when it comes to the law. He is my favorite Judge, I think. There are many I like but for so many different reasons and approaches. This was a great vid!!!

That exchange between Attorney White and Judge Simpson was amazing. I geek out on lawyers (a judge is an advanced/expert lawyer, before anyone tries to correct me on that) arguing the law with such decorum and integrity. It's the stuff our system is built on. Much respect to both parties!
I saw that deportation case live yesterday, man... I am very curious how this is going to play out!! Definitely keep us updated on that one if its live streamed for us. Im as confused as Judge Simpson is with it for a multitude of reasons. I mean, she is not an immigration attonery, so he would have HAD to have spoken with one prior to taking the plea, its literally required for that to happen, the judge requires that to happen, so to come in and say basically everyone told him the wrong thing is very odd to me.. It seems almost as if he just wasnt listening or assumed that, nahh ill be fime they wont deport me.. idk. Very interested in the resolution of this one. Thanks for the videos Squish!! He committed DV and resisting officer (he plead guilty), there are consequences to actions. He was facing felony charges. Even if he is allowed to withdraw misdemeanor plea…the state will just refile the original felony charges. Admittedly the victim (wife) may refuse to testify. The assault/resisting will go forward.
IMO - His lawyer saying ineffective assistance isn’t completely accurate. Defense attorney consulted an attorney with immigration specialty and provided that advice to client. Those seem like responsible and appropriate assistance.
The defendant’s fight will be in an immigration hearing.
The defendant has full right to waive any attorney/client privilege. If the communication is to his benefit…why not wave privilege.

If you plead guilty, you have to admit to the facts of the case under oath. Won’t they be able to use this against him if he’s able to withdraw the plea?
@@whitelobster1ifyif you withdraw the plea, you get to take that back, so it doesn’t count. It’s sort of like if the police start asking questions before Miranda rights- you can’t use that in court

I enjoy seeing behind the curtain what goes on. I watch the arrest videos when I can find them. I understand the need for plea bargains but, I think sometimes they are a little too lenient.
You want to see bad plea deals? Watch @Mandoo and see the horrendous plea deals the DAs in Louisiana are handing out to child SA perpetrators & how quickly they come up before the parole board. A recent one, a guy got 4 yrs for SAing a little girl beginning when she was 4 yrs old and went on for years. He did 18 mos, & was up before the parole board. A bunch of people come up that have gotten life w/o, sometimes consecutive life w/o. They passed a new law that almost all of the life w/o have to come up before the parole board for a commutation hearing. An outside source should be going in & looking at the DAs down there handing out these deals because they don't want to take anything to trial! 🤬🤬🤬
I've seen people drink mouthwash if they couldn't get any other kind of alcohol. I can believe he drank 10 "non-alcoholic" beers in under an hour if that's what it took to appease his need for alcohol.

It is so frustrating that these entitled, law breaking, reprobates have the gall to act so disrespectfully in front of a judge who holds their future in his hands by WEARING A HAT IN COURT! Hey paint licker....take your freakin' hat off in court.
They get their way in the streets by yelling louder than the person they are interacting with. I think it was also in part because of parents not telling their kids ( NO ) from time to time.
I don't get the American obsession with no hats in court. I'm guessing it's a remnant of the old days with big rancher hats and ridiculous tophats.
@@RoughThief It's a sign of respect. The same reason why it's considered rude to wear a hat at a dinner table while dining. The practice insinuates the subtle message of "I know I'm not going anywhere and you have my full attention."

He claimed 20-30 non-alcoholic beers. But like the Judge pointed out he'd have to drink those in the time it takes to drink 1 beer in order to keep those levels of alcohol in his system. That's friggin ridiculous. He knows he's lying his butt off. 🙄
Judge Simpson is definitely allowing hats and hoods, etc. which makes it awkward for other judges! 😳
He never gets formal like Judge Bryant. Not saying he has to get nuts like she does, but it would be nice if he made people act like they're in court.
Those instructions are at the discretion is the court. He's not obligated to care about what other judge's care about. This is his livelihood. He chooses to live longer, not have high blood pressure and to move cases forward rather than get caught up on things that don't bother him.

@@lindadeeds5326Immigration law, especially in practice, is a completely different specialty than criminal law. It’s really unfair to judge Ms. White for not knowing that a guilty plea to a misdemeanor could get a green card holder deported. I worked in immigration for years, and I didn’t know that. U.S. immigration law is a big tangled mess thanks to it being run more on policy than statute for the last thirty years.
She's just trying to do the ethical thing here because she honestly believes she made a mistake that shouldn't be allowed to hurt her client. I get that Simpson needs the formal hearing, but I don't get all his annoyance and continued head-shaking. He teaches attorneys, and he should be encouraging the practice of honoring your oath, not acting like she's inconveniencing the Court with her 'petty ethical issues.' I like Simpson, but his general attitude is very pro-prosecution.
@@-HeyLyd- I think he's really just worried about the precedent it could set if it goes a certain way. idk the ins and outs of that but I know certain things in law can have ripple effects.
@@EbonMaster Yes, precedent is important; as I said, the hearing is necessary. But his apparent annoyance at her raising the issue is uncalled for. Set the hearing, hear the evidence, and then decide. What's the point of arguing and head-shaking once you've said you "have no problem" holding the hearing? She'll bring her evidence and it will be whatever it is.

Case #6 - Deportation? Great PD, tells the Judge how to decide. Judge needs ALL info to make a decision. Be careful, defendant may run.

I'm not so sure about PD Apple asking whether the second hearing will be in person at about 19:10 ... that might seem to be a simple, logical, and innocuous question, but what she was really doing [in effect, at least, if not by intention] is making sure that her client can go straight to jail, rather than getting to turn himself in.
I agree. Most defense attorneys, if needing to clarify, would have done so by specifically requesting that the hearing be virtual, to make it perhaps a little less likely that the client would be remanded. That said, she may know that Simpson doesn't really play games on that score, so if he's going to remand, nothing's stopping that.

Or try this: maybe she was worried that, if Simpson were to revote on the spot, if he weren't there in person, he wouldn't have turned himself in and then her client problems would get worse. A defense atty isn't supposed to do something like that, even if she believes that it would be in the clients best interest long term, but maybe she did it anyway, because he might not turn himself in and/or he'd go out and slam 26 O'Douls in an hour again. tee hee (In other words, maybe she was trying to prevent her client from lying some more.)
FYI: Simpson is entirely correct that you can't get to .06% BAC by drinking .5% ABV beers. There are studies on this.
Much respect for Atty White for owning up to her 'ineffective counsel' issue. When it comes to potentially destroying a family, she stepped up and is accepting her mistake. I hope it worked out for them.

Ms White seems to think that withdrawing the plea resolves the matter ... it doesn't if the plea is withdrawn then the felony charge is re-instated and has to go to trial if found guilty at trial not only MAY he face deportation but also prison time.
Ms White you were not ineffective you were careless and should have known the plea deal would effect his immigration status.

Immigration status doesn't have anything to do with it. Defendant enters a plea and suffers the consequences. Why should an illegal wife beater get more consideration than a legal citizen wife beater?

The immigration status is very relevant the crime he plead to could mean his deportation it certainly means that he will be refused US citizenship.

The non citizen resides in the US at the pleasure of the government and there is a greater onus on them to obey the laws.
They are made well aware of in the green card application.

I think they need to make the rules clear about appearing by zoom in court in a letter or via their attorney, this guy is taking the absolute P**s here. Walking around shopping and a hat and hoodie on . They should be slapped with an automatic fine for being dressed inappropriately or get a contempt charge. We have people lounging in bed , slouching in chairs, smoking god knows what sometimes, wandering around the house or outside and the attitude is unbelievable, it may be zoom but it is court

These frequent fliers that have been in court for years, sure seem to have trouble with the public defenders. The "if you can't afford an attorney, one will be appointed to you" lawyers. Swear it seems like if you PAY for one, you can choose who and how they represent you. If its for free, you are kind of limited.

You know, I mean, yeah, he's a criminal and all, but I kind of respect Aaron Washington. He didn't make excuses (because you know it's always someone else's fault with most of the scum), acknowledged (wisely without directly admitting use, but not insulting the court's intelligence) the dirty drop (and took responsibility for it), and even made it clear he understood another dirty drop wouldn't be tolerated. Sure, he shouldn't have messed up to begin with, but hey, he's still heads and tails above the scum that we usually see.
Edit: Likewise, I have a lot of respect for Rita White. Yes, she should have educated herself about the immigration aspect before giving advice, she willingly acknowledged that she had made a mistake (and was ineffective), and put the heat on herself instead of her client. It's not the easy move, but it is the most ethical move (that will likely result in a bar review, so it's not just Judge Simpson she has to worry about hot water with).
Maybe just me, but does anyone else have the feeling that Mr. Shannon didn't get an Uber or a ride to be in person because they would've done a PBT?
I don't think he did it for that reason as much as he knew for an absolute fact that if he had the hearing in person that day, he wouldn't be going home when it was over. Just like I don't see him turning himself in at 6pm the day of that zoom hearing. He was adamant about having something to do and not wanting to turn himself in til after that on Sunday. He probably won't even turn himself in at all and just wait til they catch him doing something else to take him in on that warrant. At least, that's how it usually goes for a large percentage of people in his situation anyway

I know they are in trouble and in court, but i do feel bad for defendants that have yet to see their PD. Just my opinion
How is it that people don't know they are in a court room? Take off your hat before you turn on Zoom, stop walking around, don't drive, and DON'T INTERUPT PEOPLE! 99% of the people don't know how to dress for court. Many people can't even speak without using slang. "I know what time it is," is not an appropriate answer to a judges question. On a transcript it doesn't even make sense. The ones that really sounds ridiculous is "my baby mama," or "my baby daddy."

Mr. Philip should have asked for a jury trial and then his wife, the complaining witness should not have shown up or refused to testify. And they probably would have dismissed his case.
