Exactly. That lady is not even paying rent and the police is still refusing to take action against her? That's unbelievable. It's one thing to not vacate a rental property even after expiration of aggreement, but she's still a tenant, she needs to pay rent in order to have rights of a tenant.

It happened with us too. My father asked the electricity department to cut the electricity of my apartment. She left the house in a single day with all belonging. After that my father had to pay again to get the electric connection back. But this technique worked.
She is now a squatter, not a tenant anymore. Wait outside or anywhere close. Tell the security to inform you as soon as she goes outside. Bring a locksmith, change keys and remove all her belonging outside. Let her go through the legal route, you already have everything you need to back yourself.
@@yentaba1139 Nope...that'd be theft. For any property held like that, they'd have had to agree in the contract for it to be the security. And it would give her a legitimate reason to use force to enter the apartment again. You shouldn't get yourself into trouble while trying to reposses your home

But considering that she's not a tenant anymore and she herself refused to vacate the property or pay rent, isn't her belongings wrongfully parked in that property? It was technically her job to move out her belongings because that property is not her's anymore. If she fails to do so, then she can't blame that her belongings have been stolen. She left them at that place.
@@devashishgole4722 Nope...she can file a case of theft against you and use that to get inside whether she 'blames' you or not, then good luck with evicting her again. Where someone leaves their belongings is their business, but that doesn't give you the right to acquire it. If somebody accidentally left something valuable of there's in your home and you refuse to give it back, you'll surely be charged with theft. It doesn't matter whether it's your home or she put it there despite the place not belonging to her. That's still her belonging, the ownership of those thing doesn't change based on where its "parked". You can try to justify it however you want here, but that's not going to work with police or in the court.
Put her photo as well and spread this communication to the world. Let people recognise what she is and how she is harassing an elderly person. Politeness and decency doesn’t work with criminals as this lady!! Shame on her and her upbringing
It happened to me.. my tenant who is practicing lawyer, was not vacating. I sent notice to him and took him to court.Finally after a year he vacated and then I sold the apartment. No more headache now.People normally say don't rent your home to lawyers and police. But it's true in my life.
This is an elderly abuse. #1 She is a doctor #2 She should be stripped off her license because you can't imagine her having an ethical practice and jeopardizing other people. She is a squatter and occupying the space illegally. She should be publicly shamed! And her face should be shown so other people can save their parents and vulnerable ppl from her hands.

i wish there were laws where if the tenant doesn't pay rent for more than 3 months the landlord can outright enter the property and throw their things out.

My Mother allowed her maid to stay in one of our investment properties after she got married. She & Her husband gave us really hard time to vacate the same. They went on to police station & posted about us on media giving false claims.. finally, my parents had to pay them up to leave. The world is full of thankless people.
We faced the same issue, our tenant put a case on my father that we harassed them, when we asked them to vacate. Court case went on for 2 years and she was luckily forced to vacate. But she had abused the house so much that we spent a lot of money to restore it

Case daal ne se kuch nahi hoga . Employee a man for Rs.15K . All he has to do is visit your flat every day and put a lock on the outside at 7AM and go to the spot where all electric meters are there and pull the plug and take it with him. He will definitely vacate. Case daal ke 1-2 Lakhs kyu waste karni.

whenever I hear such news, I am literally shocked that how can a Tenant live so confidently in the flat after all this! . Even after Courts order, police intervention etc she is not vacating and neither paying rent!!! How??? Is it so easy for a Tenant to take control of another person's house? Not even the society's maintenance team is cutting off her power and water supply! Why! How! So it means one should think 100 times before investing in real estate in INDIA!!!

Happened with me too recently. Leased out my flat to a contractor, wasn't vacating. Got the electricity disconnected. F*cker had to leave. If the court has also ordered to vacate, then simply lock the house from outside, or use force to throw her out. Let's see what she can do.
I guess the problem is that person in question is a woman... So, if he uses force, she is most likely to file a fake harassment case on him like how such frauds tend to do and we all have seen too many examples of what will happen after that...

Beautiful Idea only for Chor tenants.... Also remove doors because owner has legal right. Then remove washing Tap because owner has legal right. Again this is for Chor tenants only, if tenant is genuinely unable to pay then be polite unless otherwise 😊
Similar problem I faced in my Kolkata apartment. The tenant started defaulting on his rent. He said lockdown is going on so his car rental business is not going well. Fine I said and we waited. Soon lockdown was over and his business was also running. Still he didn't pay rent and was not moving out. Police came and told them to vacate the house peacefully without going to court. I even said I don't want my rent, just vacate it. But he was adamant. Started saying his parents are not well, his business is struggling. He will pay all the due rent and then only leave, even if it takes few years. Now I don't stay in India much and my parents stay there. I came back to Kolkata after 6 months, still he didn't vacate the house. We got an order from the district magistrate in another 6 months that they should vacate the house. Then I put false allegations against him that he is selling marijuana and is creating nuisances in the building every night after being drunk. In 2 weeks we brought the police, local political friends and we broke their lock and barged in. We started taking out his furnitures and putting it on the road. He came and started shouting lol. I said I have sold the house and new owner wants this to be vacated today as tomorrow onwards they will start renovation. Trust me friends, within 4 hours he found a new rented house and by evening he moved out. We gave him 2 days time to shift his remaining furnitures. So in this type of situation you have to force your way into your house and then let them complain. You will be charged with trespassing but actually it is your property and occupant is staying illegally, so they are trespassing. When police is there as witness then there cannot be any charge of robbery also.

In west Bengal it is very very tough to get your rented property vacated. Especially from those who have stayed for years. In Alipore, Kolkata my uncle fought a legal battle for more than 10 years to get his property vacated. He lost all his savings.
I don't understand on why that woman said that She isn't aware of the court order. Is that a problem of Court or the complainant or Police ? It's only and only her problem. She needs to talk to her lawyer if she isn't aware of any court order. But even after knowing the fact of the court order, she isn't vacating the flat. This lady should simply go behind the bar. We don't want such human within our society.
She has submitted application that she was unaware of court order. Thats a nice loop hole. Then she will appeal order in another fresh application as she has no where to go. Then she will file defamation case for this video. Then owner will pay rent himself and she will continue to stay free of cost for ever

Cut the electricity and water supply, Same incident happened to me in 2021, and I didn't go to the court because I knew that the other person would enjoy my problems. Then I asked the electricity and water department to cut the supply. Then the family finally vacated the flat in 1 month. Trust me , no one can live without water and electricity. So go ahead and do it. And thats completely under your rights to cut the electricity and water supply because that's your property.
People need to understand and drill in their heads that level of education needn't be and isn't a barometer of one's character. It's an undeniable fact that educated people can choose to do evil and be detrimental to society, nature and fellow man. There are plethora of examples throughout history for this.
My mother is sick and had decided to use the rent to open up a small business for me to run to support her medical bills(I’m in college but had decided to drop out until that business runs itself). Our lease with the tenant expired but he’s refusing to leave, verbally abused my mother who actually gave him an extra year of lease because she has a good heart and didn’t want that tenant to leave with a bitter feeling. Also , his rent is so low compared to the market prices because my mother was approached by a friend to was mutual with that person and said he didn’t have much money , turns out he was working for govt bank and was earning a lot. He agreed initially but didn’t leave even after a year. Instead he demanded that if we in future ever build a new property, he should be given a flat. Wtf? Just filed a case against him. God knows how my mother will manage court hearings when she’s so sick herself. People are so ungrateful. Wish us luck.
The law is great its just that people are fools they go and make agreements from lawyers who copy and paste agreements from the internet, people should be willing to make agreements which secures themselves against such this, sadly even people don’t have any common sense about the law of the country.
@godaddy9837 if it was not a proper agreement then why court gave orders to vacate the property? It's the duty of the court and the police to make sure that the order is implemented properly but they are not doing it. The law enforcement is a total joke in India. @@90skalaunda people are a joke, I am a law student there are clauses you can put in the agreement which allow eviction without even going to the court and saving future expenses. Yeh sab video sai sympathies mut karo pehle document kya bana vho read karo or order kya pass hua vho read karo, tab samajh aayega.
@@godaddy9837 so what? Even if the agreement is not 100 percent legit all ownership papers are with the owners, even then Indian legal system is not able to support a citizen. This is just poor legal system of India.
We literally told our tenant to vacate our house after she legit destroyed it to pieces. Her dogs scratched up walls and doors. We've had decent and sophisticated tenants as well in the past but this one was just nasty. It was as close to her occupying the flat. This is messed up on so many levels.

Same occurred with me. I had a flat in Berhampur, Odisha. That tenant did the same to me. We have to run to court, police station inorder to remove such injustice
Mine is going on from 2017. He wanted to buy the apartment but my dad was nice to him and rented the house to him while his loan was being finalized. He kept delaying the purchase and paid some advance whenever we asked him to vacate saying that it'll be done soon. Due to immense health issues and this on top my dad passed away in 2018. He paid rent till 2020 then stopped that also. We are unable to vacate him, court system is very slow. Multiple tears have been shed to no avail.

This is a clear indication of law and order situation in Noida. She should be charged with multiple ipc sections. And the police's incompetence should also be brought to the respected court.
We had an infringement on our property once. We had rented it to one guy who never paid rent but he sub leased it to someone other people and was collecting rent from them as a landowner but never gave anything to us. They illegally put shops on our land thinking the guy we rented to was the landowner. When we came from the US to see the situation, we just walked in, began throwing out all their stuff onto the street. They called the landowner who came and asked who we were and to share our documents. We told him to f off and we continued throwing out their stuff. He made a few life threats which we recorded and shared with the police and a copy to the US embassy. Police commissioner called us and told us that the guy is connected to a local politician. We again escalated and the local politician and everyone under him was arrested. These types of guys only understand one language.

Had a tenant who would not vacate for 20 years.He had influential persons,so he would take constant adjournments,a paltry rent of Rs.2500. Painful,destroyed the the entire house.May your case move faster
Some case with us. 6 months, no rents. Went to court through a lawyer. Lawer took 30k, court is postponing. Knowing that even after hearing, the job will be not done is heartbreaking. Judicial system is inefficient.
How can someone disobey police order and court order both and still continue committing this crime. India’s rent law need to be revised with at-least police arrest after the issue of court order and non-compliance
Dude, this is India. A tenant can issue a fresh notice stating she doesn't knew about courts order, later will file fresh application that she doesn't have anywhere to go, later she will file harasment case making video if owner comes to their own house to talk with her. Thus, she stays FOREVER and long as she wants for FREE... Sardarji is lucky that he at least got court order in 1.3 years after filling complain... For some, it takes decades and die fighting.

Now with the new laws, people like me can help you even better. This is available with most private security agencies. They handle the police back work and any legal headaches too. Now though, I think that a police complaint is enough as long as you keep in check with the progress online. New reports are now to be filed and uploaded online within days and courts will fast track these kinds of cases. Ab file daba ke nautanki bhi nahi kar sakte.
Stop spending in lawyers and taxis. Pay that money to a goon, make him vacate the house forcefully, if/when she raises objection, show the courts order to her. Only force can deliver justice now
This is where U.S laws are useful. In some states in the U.S, the sheriff's office forcefully evicts tenants using armed police force and it happens swiftly and effectively.
Seriously I feel so pity for this man. He put the whole savings of his life and brought that apartment. I will pray to god that nobody has to go through this and he gets justice.
Same happened to us, a women is illegally staying in our apartment and when we went to ask her to vacate she is trying to falsely accuse of harassment.
We also had a tenant once who refused to leave and she was not paying any rent too. My family threw her out and she filed a police case against us, the apartment was sealed for a few months and we suffered some losses due to this but we were happy that we got rid of the squatter

The rent agreement is not valid one.. Beyond 11 months of rent agreement, the agreement should be properly registered as per registration act before registrar, failing this criteria agreement is null and void
He may have done this because of reference and also to save in taxes which needs to be paid for any lease agreement over 11 months. You are right though all precautions must be taken.
US is pretty good at eviction, barring a few cases. Canada's legal system is still far better than India. Not only that. Nonpayment of rent could reflect in credit history. Someone who is able to pay will not risk it, as future rentals could be difficult.
@@CocopakamovocoNo not really. Canada doesn't have a law like that you cant evict in winter. They can be evicted anytime of the year as long as you have successful hearing and hired a bailiff to carry out the deed
Either police man is her boyfriend or she knows laws misusing at extreme level. The man has the keys should directly go to HIS HOUSE and throw her stuff out. If police or court interferes he can show all the documents required hhim to evict her. This can only be done while video taping for evidence purpose. Refusing court order is like Court also doesn't have any authority.
You need proper legal representation, file an application for delivery warrant along with police protection and break open of lock to recover possession. If the police and court staff fail to recover your possession , file a contempt petition in high court , all arrears of rent must also be paid, so file an application for recovery of arrears of rent by attachment of all the tenants movable property. I have been through this problem . Highly recommended not to rent to single women , bachelors , or any family who don’t have a good job or a decent source of income . Always ask for the employment letter , salary slips etc before signing the rent agreement Most of the squatters come from a poor family background or don’t have enough money to pay rents thus they tend to occupy flats . Also the law doesn’t do much maximum they can do is send notice to the tenant . That’s all
And here i m a single women ant the owner even after paying rent on time and no issues i m harrassed constantly . Sometimes the owners are at fault also. They will submit before the powerful only.
My friends house tenant also refuses to leave house...one day his tenant go outside for work he and his friends come and emptied the flat leaving no evidence behind and told neighbours to cooperate when police come,,,,,plan successfully implemented...when police came tenant don't have any documents and neighbours told that they don't know tenant ....Now hi happily lives in his house..
NDTV before becoming Adani 's NDTV did a case similar to it. After that as news spread that family felt immense pressure to leave to flat and emptied it in three days.the owner couple shifted then thanked the media.I hope the old couple get's their justice
if it is loan free property then mortgage it to bank. Default the payments willfully and ask bank to cease the apartment. Also never make more than a year agreement.

My family faced similar thing! A guy came and asked to rent our vacant house but he let someone else live in it. When confronted, we found out they were lowkey thugs and had political connections. We couldnt do anything about it. After 1.5 years of not paying rent we finally filed a case in court and they were ordered to move out which they did after 6 months. While leaving, they damaged the doors and shelves and made a mess of the house. We had to renovate the house all over. It boils my blood to think how shameless that family is to be able to do such a thing. Also it seems they had borrowed 12 lakh from a women and cheated her out of it. She came to the house after they moved out and was panicking to see they left. Poor woman I feel so sorry for her. Trust no one people. It's a harsh world. I hope they get their karma.
@annamalais2870 Sadly not yet. They live in a nearby area now and seem so happy and unbothered of their actions. The woman I mentioned above is still begging them to return her money, while we are still waiting for our compensation after filing a second case. Life goes on for them while we suffer.
Karma happens to people whom God loves and wants to correct to make us better humans. For some people who will never change, hell and suffering awaits their afterlife.

Sir you shud file a writ petition in high court ...once the petition is passed thru court then the police will be bound to carry out the court's orders & within 7 days time your flat will be vacated.

Here in California if a tenant doesn't pay the rent they get evicted by the court . The sheriffs give 24 hour notice to quit with there belongings once the court gives approval . I feel sorry for uncleji.
You can't do anything unless court orders it. It's actually illegal to cut power supply to tenants or even tresspassers at any cost. If he files case on you, the illegal tenant will stay in your house for free while you'll be in jail. Our law supports criminals more than innocent people.

@@mayureshrasam1708electricity department doesn't cut the power supply..we cannot cut basic amenities even for illegal tenants...we have to seek civil remedies but if we trespass or cut basic amenities then the tenant can file a criminal case against us for that he just has to go to police station and not the court like landlord. Yes, in India there is no protection for your own property… The govt takes registration charges as well as regularly collects house tax, but never helps in eviction… In foreign countries, your asset is protected by govt which directs police to evict and restore restrictions for illegal entry…

Just to add further, I have issued similar order during my stay in Sunnyvale… On the contrary, when I faced similar situation in India, there was no one to help… I very much love my country India in all aspects that’s why I have relocated back for good… But I do have opinion about our legal system which needs to be improved on multiple fronts…

They talent can simply accuse the owner of increasing the rent (no evidence needed), and every time owner tries to fight in court that accusation makes him loose every time. It took the landlord nearly 2 years to get rid of that tenant, only when the tenant himself left the property. This halpened to my uncle whose house was acquired illegally by the tenant. Court case took 30-40 years to solve however nothing happened to tenant he still aquired the half of the house property got sold put after judgement at very low price all sugfering and pain and cost was ot compensated. Shame on the judicial system, also an eye opener for the people who are investing in property without power.
I can see the law is the culprit itself here. Despite having all the legal documents how come it is so difficult for court to pass a judgement against tenant?
This is what happens when you don't do a thorough background check of your tenants. You also have to make sure that the person is not a localite, has influential connections and has a simple life. Else this is bound to happen. Go to Bangalore. They will strip you off before giving you flat keys.
There have been many incidents in which the tenants have harassed and threatened the owners in Bengaluru as well, with some of them even putting the life of the owners at risk. Even though tenants don't have their own house to live in, they are well versed in creating terror among those who provide them with accomodation. This is a new form of urban naxalism which needs to be stopped. Property owners should no longer be constructing houses for rent purpose and should invest their money elsewhere. When all the homeless people start living in slums, then they will realize the value of a house.

Advice as a developer to everyone . Don’t make a lease agreement create a leave and license agreement and charge rent against it. . Always pay the electricity, tax and maintenance by yourself. . Ensure that your name is there as a person in occupation of the flat in a registered society. . Always keep a spare key . Always take a deposit against securing yourself against any damage and litigation, not as an amount payable to tenant against leaving the premises. Edit: The intention here is to not allow the tenant to create any lein on your property, which the tenant can use to justify his/her claim in court. Lease agreement means to give certain rights on use of premises for stipulated period of time, against waving off your own for the said time, but leave and license is your are only give the other person only a permission to stay in the house which is in your occupation, at the same time not entirely waving off your own.
@@chinmayraut8561 I am a developer and a lawyer too, I wish I could help you, if the lease agreement was for more then 15 years the other person might be claiming alternative posession through no obstruction which is if you are using a property for 15 years without obstruction and paying tax on property for 21 years with receipts, the only defense is you have to show that your lease was registered and you have a good title of the property.
I was going through this but I am partially responsible for it. My tenant started defaulting on rent citing his business failure during COVID. My mistake was my sympathy towards him. Also his sweet talk saying he will pay everything once his business is back on track. And like giving biscuit to a dog, he kept on paying small amounts to me giving me some hope that he will pay full. Then when i knew his trick and asked him to vacate , he started talking about his moral responsibility to pay me full outstanding amount before moving out. Again I was a little soft on him and allowed for another few months. Finally I got fed up and kicked him out saying I am going to police station to file a complaint. By this time , he owed me 1.8lakh in rent! He vacated and with great pain i know I am not going to get my money. 😢 Interestingly he still messages me saying he will pay me some day!
OK the story is made. Lakhs of people have seen this video. Now what is the next step in the real world? How can we citizens help if we want to ? Or what next action will be taken to help him get his flat back and stop dealing with this so called Dr Manali? Hope something happens. Because this is just so bad.
I am working in this industry for the past 5 years and i can guarantee you this is not at all a common scenario. It only happens when the owner become very lenient on the tenant and over trust them. What they forget is that they are still in a business relationship with the tenant. It's not a personal relationship. This looks a clear case of police inaction due to several factors. Cheats and specially stubborn cheats are everywhere be it medical, education , insurance or business. . Owner should be as stubborn as the thugs otherwise they won't get their rightful share anywhere in the world. It's good that quint covered their story. He will get some support and pressure on the local police.
Buying house renting is such a waste. You get rent for your house worth crores is 2% of its value and then your judicial system is useless. Why should anyone buy and let it out for rent? Society can't do anything to her?

It is very common in Delhi and places near it. In the past, the same thing has happened with my family. We were left with no choice but to pay the tenant some amount to get out of the house. I feel the pain and suffering the uncle might be going through.

It happened with us too. My father asked the electricity department to cut the electricity of my apartment. She left the house in a single day with all belonging. After that my father had to pay again to get the electric connection back. But this technique worked.

She is now a squatter, not a tenant anymore. Wait outside or anywhere close. Tell the security to inform you as soon as she goes outside. Bring a locksmith, change keys and remove all her belonging outside. Let her go through the legal route, you already have everything you need to back yourself.
It would be even better if her belongings are not thrown out and released to this defaulter only after all her dues are paid.

@@devashishgole4722 Nope...she can file a case of theft against you and use that to get inside whether she 'blames' you or not, then good luck with evicting her again. Where someone leaves their belongings is their business, but that doesn't give you the right to acquire it. If somebody accidentally left something valuable of there's in your home and you refuse to give it back, you'll surely be charged with theft. It doesn't matter whether it's your home or she put it there despite the place not belonging to her. That's still her belonging, the ownership of those thing doesn't change based on where its "parked".
You can try to justify it however you want here, but that's not going to work with police or in the court.

It happened to me.. my tenant who is practicing lawyer, was not vacating. I sent notice to him and took him to court.Finally after a year he vacated and then I sold the apartment. No more headache now.People normally say don't rent your home to lawyers and police. But it's true in my life.

My Mother allowed her maid to stay in one of our investment properties after she got married. She & Her husband gave us really hard time to vacate the same. They went on to police station & posted about us on media giving false claims.. finally, my parents had to pay them up to leave. The world is full of thankless people.

We faced the same issue, our tenant put a case on my father that we harassed them, when we asked them to vacate. Court case went on for 2 years and she was luckily forced to vacate. But she had abused the house so much that we spent a lot of money to restore it
Eviction order from court must be served by court personnel along with local police protection. Any objection to this becomes contempt of court.

All he has to do is visit your flat every day and put a lock on the outside at 7AM and go to the spot where all electric meters are there and pull the plug and take it with him. whenever I hear such news, I am literally shocked that how can a Tenant live so confidently in the flat after all this! . Even after Courts order, police intervention etc she is not vacating and neither paying rent!!! How??? Is it so easy for a Tenant to take control of another person's house? Not even the society's maintenance team is cutting off her power and water supply! Why! How!

Happened with me too recently. Leased out my flat to a contractor, wasn't vacating. Got the electricity disconnected. F*cker had to leave. If the court has also ordered to vacate, then simply lock the house from outside, or use force to throw her out. Let's see what she can do.
I guess the problem is that person in question is a woman... So, if he uses force, she is most likely to file a fake harassment case on him like how such frauds tend to do and we all have seen too many examples of what will happen after that...

Similar problem I faced in my Kolkata apartment. The tenant started defaulting on his rent. He said lockdown is going on so his car rental business is not going well. Fine I said and we waited. Soon lockdown was over and his business was also running. Still he didn't pay rent and was not moving out. Police came and told them to vacate the house peacefully without going to court. I even said I don't want my rent, just vacate it. But he was adamant. Started saying his parents are not well, his business is struggling. He will pay all the due rent and then only leave, even if it takes few years.
Now I don't stay in India much and my parents stay there. I came back to Kolkata after 6 months, still he didn't vacate the house. We got an order from the district magistrate in another 6 months that they should vacate the house.
Then I put false allegations against him that he is selling marijuana and is creating nuisances in the building every night after being drunk. In 2 weeks we brought the police, local political friends and we broke their lock and barged in. We started taking out his furnitures and putting it on the road. He came and started shouting lol. I said I have sold the house and new owner wants this to be vacated today as tomorrow onwards they will start renovation. Trust me friends, within 4 hours he found a new rented house and by evening he moved out. We gave him 2 days time to shift his remaining furnitures.
So in this type of situation you have to force your way into your house and then let them complain. You will be charged with trespassing but actually it is your property and occupant is staying illegally, so they are trespassing. When police is there as witness then there cannot be any charge of robbery also.
Thank you so much I will try this too I am also from Kolkata and same this person who took my flat on rent started same story since covid and now not paying rent he also went to jail last year for misbehaving with his family I was thinking of taking help of police .

In west Bengal it is very very tough to get your rented property vacated. Especially from those who have stayed for years. In Alipore, Kolkata my uncle fought a legal battle for more than 10 years to get his property vacated. He lost all his savings.

Then she will file defamation case for this video. Then owner will pay rent himself and she will continue to stay free of cost for ever

Cut the electricity and water supply, Same incident happened to me in 2021, and I didn't go to the court because I knew that the other person would enjoy my problems. Then I asked the electricity and water department to cut the supply. Then the family finally vacated the flat in 1 month. Trust me , no one can live without water and electricity. So go ahead and do it. And thats completely under your rights to cut the electricity and water supply because that's your property.

My mother is sick and had decided to use the rent to open up a small business for me to run to support her medical bills(I’m in college but had decided to drop out until that business runs itself). Our lease with the tenant expired but he’s refusing to leave, verbally abused my mother who actually gave him an extra year of lease because she has a good heart and didn’t want that tenant to leave with a bitter feeling. Also , his rent is so low compared to the market prices because my mother was approached by a friend to was mutual with that person and said he didn’t have much money , turns out he was working for govt bank and was earning a lot. He agreed initially but didn’t leave even after a year. Instead he demanded that if we in future ever build a new property, he should be given a flat. Wtf? Just filed a case against him. God knows how my mother will manage court hearings when she’s so sick herself. People are so ungrateful. Wish us luck.

Even if the agreement is not 100 percent legit all ownership papers are with the owners, even then Indian legal system is not able to support a citizen. This is just poor legal system of India.

Mine is going on from 2017. He wanted to buy the apartment but my dad was nice to him and rented the house to him while his loan was being finalized. He kept delaying the purchase and paid some advance whenever we asked him to vacate saying that it'll be done soon.
Due to immense health issues and this on top my dad passed away in 2018. He paid rent till 2020 then stopped that also. We are unable to vacate him, court system is very slow. Multiple tears have been shed to no avail.

We had an infringement on our property once. We had rented it to one guy who never paid rent but he sub leased it to someone other people and was collecting rent from them as a landowner but never gave anything to us. They illegally put shops on our land thinking the guy we rented to was the landowner. When we came from the US to see the situation, we just walked in, began throwing out all their stuff onto the street. They called the landowner who came and asked who we were and to share our documents. We told him to f off and we continued throwing out their stuff. He made a few life threats which we recorded and shared with the police and a copy to the US embassy. Police commissioner called us and told us that the guy is connected to a local politician. We again escalated and the local politician and everyone under him was arrested. These types of guys only understand one language.

A tenant can issue a fresh notice stating she doesn't knew about courts order, later will file fresh application that she doesn't have anywhere to go, later she will file harasment case making video if owner comes to their own house to talk with her. The rent agreement is not valid one.. Beyond 11 months of rent agreement, the agreement should be properly registered as per registration act before registrar, failing this criteria agreement is null and void
He may have done this because of reference and also to save in taxes which needs to be paid for any lease agreement over 11 months. You are right though all precautions must be taken.

US is pretty good at eviction, barring a few cases. Canada's legal system is still far better than India. Not only that. Nonpayment of rent could reflect in credit history. Someone who is able to pay will not risk it, as future rentals could be difficult.

Its scary to rent out your home. You never know who will squat on your property! Horrible state of affairs.
You need proper legal representation, file an application for delivery warrant along with police protection and break open of lock to recover possession. If the police and court staff fail to recover your possession , file a contempt petition in high court , all arrears of rent must also be paid, so file an application for recovery of arrears of rent by attachment of all the tenants movable property.

My family faced similar thing! A guy came and asked to rent our vacant house but he let someone else live in it. When confronted, we found out they were lowkey thugs and had political connections. We couldnt do anything about it. After 1.5 years of not paying rent we finally filed a case in court and they were ordered to move out which they did after 6 months. While leaving, they damaged the doors and shelves and made a mess of the house. We had to renovate the house all over. It boils my blood to think how shameless that family is to be able to do such a thing. Also it seems they had borrowed 12 lakh from a women and cheated her out of it. She came to the house after they moved out and was panicking to see they left. Poor woman I feel so sorry for her. Trust no one people. It's a harsh world. I hope they get their karma.

Sir you shud file a writ petition in high court ...once the petition is passed thru court then the police will be bound to carry out the court's orders & within 7 days time your flat will be vacated.

You can't do anything unless court orders it. It's actually illegal to cut power supply to tenants or even tresspassers at any cost. If he files case on you, the illegal tenant will stay in your house for free while you'll be in jail. Our law supports criminals more than innocent people.

They talent can simply accuse the owner of increasing the rent (no evidence needed), and every time owner tries to fight in court that accusation makes him loose every time. This halpened to my uncle whose house was acquired illegally by the tenant. Court case took 30-40 years to solve however nothing happened to tenant he still aquired the half of the house property got sold put after judgement at very low price all sugfering and pain and cost was ot compensated.

There have been many incidents in which the tenants have harassed and threatened the owners in Bengaluru as well, with some of them even putting the life of the owners at risk. Even though tenants don't have their own house to live in, they are well versed in creating terror among those who provide them with accomodation. This is a new form of urban naxalism which needs to be stopped. Property owners should no longer be constructing houses for rent purpose and should invest their money elsewhere. When all the homeless people start living in slums, then they will realize the value of a house.
@@himanshupandey8967 please don't generalise... I have been in banglore for 2 decades... 15 years as tenant. Only one onwer created problems in giving back deposit - made me run around about 2 months Everyday. Rest all owners were very decent. Gave money as soon as key was given back

Why Why we r forgeting that this so called IPC, constitution and laws are for us, for us, We are not for laws....yes we have to follow it so that it can help us to live good life. Lets Unite and show our strength to help this man, raise posters n do some kind of peaceful march against this Manali Agarwal, so that our blind Judiciary and corrupt police station wakes up. Sochne se nahi hoga... sirf 2-3 days ke March se case solve ho jayega, but we have to unite in thousands....Lets do it on 2nd FEB 2024. Bro, what is the guarantee that even after doing BG check this will not happen. The point is our Judicial system is so dead that it cant even help itself. Its time that we people help each other to attain justice, only this is the route to wake up this dead system.
After eviction order if she refuses , court will send baliff , there is some gap in the story any how she have to vacate the place
Advice as a developer to everyone
. Don’t make a lease agreement create a leave and license agreement and charge rent against it.
. Always pay the electricity, tax and maintenance by yourself.
. Ensure that your name is there as a person in occupation of the flat in a registered society.
. Always keep a spare key
. Always take a deposit against securing yourself against any damage and litigation, not as an amount payable to tenant against leaving the premises.
Edit: The intention here is to not allow the tenant to create any lein on your property, which the tenant can use to justify his/her claim in court. Lease agreement means to give certain rights on use of premises for stipulated period of time, against waving off your own for the said time, but leave and license is your are only give the other person only a permission to stay in the house which is in your occupation, at the same time not entirely waving off your own.

@@chinmayraut8561 I am a developer and a lawyer too, I wish I could help you, if the lease agreement was for more then 15 years the other person might be claiming alternative posession through no obstruction which is if you are using a property for 15 years without obstruction and paying tax on property for 21 years with receipts, the only defense is you have to show that your lease was registered and you have a good title of the property.
I was going through this but I am partially responsible for it. My tenant started defaulting on rent citing his business failure during COVID. My mistake was my sympathy towards him. Also his sweet talk saying he will pay everything once his business is back on track. And like giving biscuit to a dog, he kept on paying small amounts to me giving me some hope that he will pay full. Then when i knew his trick and asked him to vacate , he started talking about his moral responsibility to pay me full outstanding amount before moving out. Again I was a little soft on him and allowed for another few months. Finally I got fed up and kicked him out saying I am going to police station to file a complaint. By this time , he owed me 1.8lakh in rent! He vacated and with great pain i know I am not going to get my money. 😢 Interestingly he still messages me saying he will pay me some day!

I am working in this industry for the past 5 years and i can guarantee you this is not at all a common scenario. It only happens when the owner become very lenient on the tenant and over trust them. What they forget is that they are still in a business relationship with the tenant. It's not a personal relationship. This looks a clear case of police inaction due to several factors. Cheats and specially stubborn cheats are everywhere be it medical, education , insurance or business.

Owner should be as stubborn as the thugs otherwise they won't get their rightful share anywhere in the world. It's good that quint covered their story. He will get some support and pressure on the local police.

Buying house renting is such a waste. You get rent for your house worth crores is 2% of its value and then your judicial system is useless. Why should anyone buy and let it out for rent? Society can't do anything to her?

It is very common in Delhi and places near it. In the past, the same thing has happened with my family. We were left with no choice but to pay the tenant some amount to get out of the house. I feel the pain and suffering the uncle might be going through.
Yes you are right, i am in this industry and whatever you are saying is right. But still you can be strict and take your stand , that's the minimum requirement is you are the property owner.
