I've actually done this, and it can definitely work for you. Make SURE you send the letter within that 30 day window. Make SURE you send it certified mail, and preferably even write the certified mail number on the letter itself (you can hand write it in ink for convenience), and obviously keep a photocopy. You want it provable later that you sent within the 30 day window and that you actually sent the letter. But here's an extra: if they respond, they'll often give you a crappy little printout showing little other than that they bought the debt. Santiago is right in that your signature needs to be there somewhere, or it's likely insufficient. Send them a second letter noting that what they sent is insufficient to meet the required legal standard (also certified, etc.) I've never heard back from the after the second letter. This procedure is for "big" debts. What will probably happen after that is they will sell your debt AGAIN to the next debt buyer. And you'll have to do the same thing all over again. But if it's a big deal to you not to be SUED over the debt, just keep doing it. Eventually it dies down and goes away. Just be persistent.
Why 30 days tho. What if someone has moved or something and it takes longer to receive the letter or something
@@marktravis69 30 days is the time limit set in the law; unfortunately I didn't just make it up. In the case of you moving, it seems you'd have a great case to make, because you can simply point out the letter wasn't mailed to your actual/current address. First step if you're dealing with that situation might be to simply incorporate that information into your response letter, if you feel it may be received late, maybe throw in a photocopy of something proving you've moved, hopefully with a date on it. I'm not a lawyer but that is how I'd generally deal with it.
@@willhartman300 thank you so much for your quick response. I appreciate it. And thank you for the knowledge
Y'all stop it already. Allllll this misleading info and direction is just laughable. It's soooo much easier than this and 30 days? 2000 days? WGAF? No one, and no letters need to be sent to anyone lol. This is dumb advice
Someone did medical fraud and used my name to get pain medicine. I got mail from a hospital visit i never went to, I disputed it, they tried to say there was my signature. I then tried to escalate it to the FBI since I never signed it. They stopped calling but it did give me a scare that someone can just sign your name and you'll be fucked and have to owe money
Even better, within that same letter, reqest evidence of acquiring the debt and right to collect. If they purchased the debt, then they technically paid off for you, and you no longer have an obligation to pay that debt. Debts are not transferable without your written consent.
That's bad advice. Don't believe that they "paid off for you" because they purchased the debt. Maybe some people want to hear and believe that, but you can as a general principle buy and sell debt. Any attorney will confirm that you may very well still owe.
@@willhartman300 It's crazy how these deadbeats make stuff up and give bad advice to other deadbeats.

I did this. I sold a car that I didn’t put in my name. I floated the title and the new person I sold it too didn’t put it in their name either. Come to find out the car was towed and impounded in a tow yard almost a year later.
I get a collection agency trying to collect on the tow yard bill. The tow yard already sold the car and only collected $900 from it apparently. They wanted me to pay $2000 in storage fees 😂.
I sent a letter to the collection agency stating to validate it. Nothing happened. Then a year later I get a letter from their attorney. I call for validation again, they can’t produce a legit bill. I claim it was settled when the car was sold, also that I was not in possession of said vehicle. In the end nothing came from it. In reality they couldn’t prove I owned the vehicle.
But is it on your social right now? Collecting interest?
A simple bill of sale would have eliminated that....most states even have or require you to notify them in some format you sold it anyhow.

It is legal to not pay on a collection from a collection agency. Once your debt is sold to a collection its no longer owed. The original company writes it off as a business loss for taxes people they have insurance for this. Then ABC collection buys the debt and tries to collect on it. Even though there is no original agreement between the 2 parties.
And it then nails your credit for 7 yrs.

I've always just waited till I had a little money called them up and every time settled for way less than I originally owed.
This is probably the most reasonable way to go if the debt is actually yours
What you did was Settled (the account) In Full (SIF). This means you negotiated an amount between you and the current note holder. You did not Pay In Full (PIF). The remainder of the debt is sold to a new agency because it is still a legal obligation under the original agreement. In Law, one word means a lot. Debt relief scams all do this. What he offers is good advice.
That doesn't work with revolving collections. The unpaid portion of those gets sold to a collection agency or another collector and leaves you liable for the remainder because you've already validated the debt was yours by settling in full.
@@monteestowes1245
That's why they want you to pay even a small amount. Set up as a payment plan. Validates the debt and great residual income beyond a settlement.
@@rregen8198 no, the debt isn't passed on if it is settled in FULL. That's it the debt is over with you will however have a black mark on your credit report for 7 years showing you didn't pay back the full amount. That was smart 20 years ago, but with the housing markets now there's no possible way you can own and stay away from debt. And if you don't own every year you are practically giving money away. Giving this advice to young people now will set them back 17 years. Most people don't have the money for a car or house, and if that's the case how are you going to work to make money, or where can you live. With out losing thousands of dollars a year in rent, leasing a car, and paying home and auto insurance on items you don't actually own.

I always come across high school grads out here that make close to 6 figures and are getting certified in electronics/ plumbing/ welding on their employers dime. There are plenty of ways to make a living now and not go into debt.
Don’t be a slave to the lender.

I am 3-0 with cases where i represented myself in debt collections...about to be 4-0 without a doubt. The first thing you should look for is the sentence at the top of that bill typically it will say along the lines of..." this is an attempt to collect a debt you owe to ( blank)." It may or may not have an amount. It is a legal obligation that they declare who that bill is owed to. If the name in that sentence does not match the name of the company trying to collect the debt...you do not owe that company. Period. They specifically say you owe it to another entity which tells you immediately they dont own it. I can tell you that you owe a car payment but that does not mean you have to pay me. Instantly dispute. It helps greatly if you do it in writing but be sure you send it to them certified signature required because come your court date..you can prove you disputed it and they received the notice.

On game? Dodging collection (or being there in the first place) is game? Terrible mentality dude. You’ll be broke forever.
@@Dan-lr2ic No i beg to differ this guy really gives good advice and i trust him. You can have your opinion but Thats just it a simple opinion worth nothing to me or others.
@@onlythefamily7856it’s not an opinion, if you’re in collections and spending time and effort dodging collections, you’re broke and have a broke mindset. Get off this channel and go watch / study something productive. You are better than this.
I had a debt collector send me a collections notice on a credit card in collections that I had paid off 10 years prior. I just ignored it.

It’s like a lawsuit they gotta serve you. “Return to sender”
How many donuts are you buying to be defaulting on loans?!
This guy isn't telling you all the truth, chances are today they do have your signature now you've acknowledged the debt, the collector can then have the court's serve you then demand a monthly payment by the court's of law.
Collector must send the letters to a correct address by law otherwise you won't know about it. 🤔
Or how bout you just pay what you and stop trying to get stuff for free.
I got some incorrect debt claim from Comcast sent to collections. I canceled my service and they kept billing me. I refused to pay. They sent the bill to a third party collections. I bet there mate many many others who have had invalid debt sent to collections
It’s awesome training people how to avoid paying their debts they borrowed. Congratulations.
Cancel this man please
Another option: be an ethical human being and pay back the money as you promised. No one forced you to take the money--that was your decision. So...live with your choice and do the right thing.
SANTIAGO EATS THOSE COLLECTION LETTERS LMAO 😂
Most debt is bought before being collected on. So they almost NEVER have a signature as they are not the original creditor. But some WILL obtain this signature. Which means you may as well pay it.
Not a single other person in that room 😂😂😂
