Every state has different jurisdictional limits for small claims court. My state's is $5,500.

She still would have to pay the court fees. She would be fine if she can get the defendant to reimburse her the amount during the judgement.

Just finished the settlement on an attack on my daughter, and the answer is an emphatic YES. For two reasons: #1- If you have medical insurance they WILL NOT pay the bill if they know it was someone else's fault, and #2- The owner needs to feel the pinch so they change the way they handle their pets. It sounds bad, but their insurance company needs to know what's going on.
It was her dog that was attacked, so she had to pay out of pocket for the vet. As Dave said, it would probably cost more to collect the money than what she would actually receive.
Why isn't the dog owner looking at at least a four-figure fine from the County/State?

Should have just contacted the neighbor's homeowners insurance.
Something bigger to consider is that this person's dog made an attack. When people are not motivated by their own morals, they are motivated by their wallets. If these people have zero accountability, then they will allow it to happen again - and next time, it could kill someone's pet or child.
Make her pay! She's counting on you letting her off the hook; she's lived her entire life that way! First, you can file in small claims court, where it's optional whether to hire an attorney (but your could). Second, and most importantly, remember this: People always have the money for the things that matter to them. Right now, you don't matter to her, and so she doesn't have the money for you, but she will when you bring her to court! Good luck!
This woman is just looking for someone to tell her to sue...she is going to do it anyway but she just wants someone to tell her she is right
It seemed to me more like she was looking for someone to tell her not to sue, she kept talking about grace and stuff.
I think she just wants a resolution to a crapy situation and needed an impartial opinion to break the argument her ego was having with her conscience. If she wanted to sue just to make a point it would have been the first thing she did. Vindictive people dont use logic or have patience, they just go on instinct for the quick emotional fix with out thinking about the bigger picture or resulting consequences. One of the first things she said was I dont really have the bandwidth to continue with the situation. I feal like she also needed to know if her actoins were actually graceful or if they were just trying to take advantage of her.

About seven years ago I was walking my chihuahua and pug on the sidewalk several houses down from my own. A neighbor had his door open and his Great Dane dashed out and began fighting with my dogs. After us pulling the dogs apart and much commotion the pug was fine, but the chihuahua need about 1,500 dollars worth of work. I went to the man's house about a week later with the chihuahua's medical bill and essentially said to him that my dogs were on a leash and his unleashed dog attacked mine, totally unprovoked, and the way I see it he owed me $1,500 dollars. Well, he apologized for what had happened and wrote me a check. The whole thing took less than a minute. Later I was informed that this fellow was independently wealthy and 1,500 was nothing to him. However, it was a very pleasant surprise that he was willing to do the right thing.
I know my situation was slightly different but when I got my car door wreck by some lady, she started throwing that same pitch oh I'll pay for it trying to talk me out of not going to the insurance companies. Then I spoke to a police officer about it and he specifically said go thru the insurance companies do not listen to them because they will always leave you hanging. Best advice I got and I the damaged paid up through the insurance claim and she was founded at fault simple and easy and painless. People's words today are very weak and useless don't bother with them
If it caused a small dog this much injury how much more for a small child. At a certain point I wouldn't even care about the financial aspect a dangerous dog needs to be put away. If she can't afford the cost of liability or the proper training the owner really shouldn't be a dog owner.
You're way to nice lady. I'd have a police report immediately and press charges... At the very least they will have to settle on a payment plan.

@WeeStrom CO Guy that may depend.on the company. I did insurance claims some time ago, and we covered injuries by dogs to vehicles, bikes, and other dogs all the time.
Also, I just got renters insurance and they asked if I have a dog. And the other company I had insurance for my house required extra insurance if we had a dog (we didn't).
It also might depend on the state.
She can file a homeowner insurance liability claim against responsible party. If theres strict liability dog attack/bite law in their city in CA the insurance more than likely will pay with a quickness. Before small claims/suit.

You can put a lien against their property
Get a personal Injury attorney, home owners insurance will pay for all the damages and more, including the lawyers, if they don't have home owners insurance then no one gets paid nor charged.
Why would their homeowner's policy cover it if it wasn't on their property?
Aside from the $2500, I hope she can find the peace and grace to let go of taking inventory of other people’s problems
There problems became her problems when they were negligent with there dog. We all make mistakes. But onely the responsable people own up to them. They opened themselves up to be scrutinized by not following up to there agreement.
It’s very much so her problem. Idk what a “inventory of other people’s problems” is but she is directly affected by their problems. She was their victim! She is not morally obligated to let this behavior slide.

some home insurances company's will not allow you to have certain breed dog's. they could cancel your home insurance.
Homeowners' insurance will cover dog bite liability.
You can only sue for damages injuries. Yes.

She was just looking for someone to give her permission to sue.
There are many alternatives to suing the neighbor personally. Look into neighbors homeowners as well as your own.
I’d blow off the expense, avoid the neighbor at all costs, and report the neighbor’s vicious dog to Animal Control.
Small claims court is a possibility HOWEVER even if you win in small claims court, you are still faced with how to collect. A judgment in your favor makes it easier to take legal collection action but is no guarantee that you will get your money. This is less expensive than hiring a lawyer but can mean more work.
I am suing someone in small claims court for $10,000 who has the money so ultimately, one way or another, I should be able to get my money. Dave is very correct when he states that you shouldn’t pursue the issue if you’ll have to spend more to get your money than the amount of money you’ll get back. And if the defendant has no money (i.e. you can’t get blood from a stone). But in my case, the defendant has money and I stand to make much more than I have to spend to get my money, so it makes sense to move forward.
If the dog is in the custody of someone other than it's owner, is the custodian liable if that dog bites a person? Thank you.
If the husband of the dog owner has been in jail in the last year, one sees a pattern of poor choices, which allowing a dog to be off leash where it then attacks a dog whose owners have their dog on a leash, shows. Of course I would seek out an attorney who will go after the full amount plus damages which will pay for legal fees.
And in a case like this the lawyer takes the case based on contingency, where he gets paid from the settlement ONLY if he wins. If you let the dog owner off the hook, you send a message that they can play the sympathy card for chosen bad behavior and get off scout free. Sung also provides a public record of bad behavior on the part of the dog owners. Because trust me that dog will bite someone else.
It's cases like this why some insurance companies wont even issues coverage if the homeowner/renter owns certain breeds of dogs. Since dog attacks and bites are in the top reasons insurance companies pay damages.

hate more laws, but with near a million people bitten yearly needing medical care-- it is time the elected protect the public by demanding all dog owners carry a $25,000 dog bite insurance-- minimum-- simple as that, can't afford insurance, then get a gold fish--

A judgement in small claims still does not get you paid, it is just a blemish on that persons record to be added to all the other blemishes that they probably have.
Well dave it's easy to let someone off the hook that owes you a 11k when you're worth 55 million. I bet you wouldn't have been like that before you became a multi millionaire...

I’m sorry but the judge will make the person pay and will allow a lien to be put on the house of the person that owes. And she does not need an attorney. This is a civil lawsuit which she can do on her own.
Forget about grace, she owes the money. The caller should go on Judge Judy. She would get her money immediately. The show pays the judgement and JJ would definitely rule in her favor. That's why many low income people go on the show, because they know they'll get paid.

Homeowners insurance could cover the damages, you are better off leaving the attorney and fees out of the equation while working it out with the home owner. This advice came from an attorney licensed in multiple states.

If someone's negligence costs you money, then you should sue imo. Unless you can work with them on some sort of help.
I would worry about people like that even caring properly for their dog. Tell them you are going to small claims court.

Yeah my mom once told me "Just forgive the debt. Let it go and walk away." Which is apt for a lot of situations, but not all ofc.
Sometimes you're basically paying someone to go away.
Attorney fees aren't collectible in small claims unless a statute specifically provides for it or there is a contract. Even if you get a judgment in small claims court, it's not like the defendant will whip out a checkbook. Good luck collecting on a judgment!

If you have right on your side, you have might on your side. All it takes is to bring your first person to small claims tribunal and it becomes much easier after after that. The whole world will trifle you and bluff. If you give them time, they will take more. Tell them what you want and why, at the first point of stalling, take them to straight to small claims. Then when they say they will negotiate tell them that they now also owe you the money it cost you to apply for small claims or the case goes ahead. Just like a bully, you stand up to them and they back down in no time.
Dave Ramsay is not a lawyer but I would think checking with an attorney would be a good idea. I don't know if homeowners insurance would cover it or if they need to be sued. If, they win, and there is a judgement then perhaps a lien could be placed on their home. IF, this had been a child hurt or killed they would be facing A WHOLE LOT MORE !

Noah Johnson: She never specifies if her dog was on a leash. For all we know both dogs were off a leash. We also don't know the how or where. Was her dog in the neighbor's yard? Or the reverse? There is really no way of determinding liability with the limited information we have.

There’s always another side of these dog stories too. This is just one side. I had to get a restraining order against a neighbor who’s dog was on our back porch every day and night. THEY wanted to sue me because they had a small dog. Plus, I think they are on too many prescriptions since she (at 70 years old) walks around asking people if they have any prescriptions. 🤦🏻♀️ Completely crazy.

I encountered this same situation. A friend's son was bit by my mother's dog. Although the dog was tied up yards away from the event we were having in the backyard, her son wandered over and provoked the dog. My mother immediately offered to pay the medical bills. Yes, we could have argued her son should have never provoked the dog, but we decided not to point fingers and just pay the bill.

I don't allow children at my events for that reason. If you are invited to an event, and you fail to supervise your child at the event, you should pay the cost of your own bills. That's a nasty way to repay someone for the invitation to their home.

Short but true story I had a friend who went to a breeder to pick up a puppy and the personal dog of the owner broke out of a locked bedroom and bit her very badly on the arse, she needed stitches she sued and she won 300K the breeders insurance paid out, might not be the best thing to do for everyone and not every case is clear cut but Id say only sue people if you really really feel they neglected something and you were caused sever pain...

It seems very much like he doesn't understand how this works. They'd be contacting home owner's insurance, and their insurance could handle it. This advice just isn't correct.
It’s 2500 move on. It’s a waste of everyone time she won’t gain anything from going after these people if they can’t pay and if they won’t pay it’s again a waste of her time she won’t go broke for this bill
So the guilty party here is having some personal issues and doesn't feel like they should pay nor will they pay because they have other issues to deal with. Tough.... Don't make your personal problems MY problem. If you don't pay by this date then we will see each other again in front of a judge and you can plead your case in front of him. Given these circumstances I can pretty claim he will see it my way and you'll end up paying anyway. So we can do this the hard way or the easy way, either way it's going to be my way.

You don't need a lawyer to go to small claims court just file your claim and if they don't show up he win and then you could put liens on their paychecks or property it's just now it's not easy I've done it myself all by myself and I want and I got my money as they garnish his wages so enough talk
What kind of dog attacked?
The very definition of grace is UNDESERVED FAVOR. So yes, letting go of a debt someone said they were going to pay is grace. (Grace wouldn't be contingent on whether the person is trying to pay it off or not.)
That is wholly ungraceful. Your comment encourages one to enable to this dog to continue its murderous behavior. You espouse this religious undertone yet you ignore the 6th of the 10 commandments.
sue sue sue, off leash pet makes that person 100% at fault and responsible.
I’d report that dog as a biter and then just move on with my life. Spending time trying to teach other adults lessons in money isn’t going to bring you any peace.
