  • George Wagner, IV is standing trial for the April 2016 murders of eight members of the Rhoden and Gilley families. Wagner IV faces 22 counts including eight counts of aggravated murder with death penalty specifications, aggravated burglary, conspiracy, tampering with evidence and forgery.
    Wagner’s brother, Edward “Jake” Wagner, and his mother, Angela Wagner, have already pleaded guilty to taking part in the conspiracy to murder the eight Rhoden and Gilley family members over their desire to obtain full custody of the then two-year-old daughter Jake shared with victim Hanna May Rhoden. Angela and Jake Wagner have agreed to testify against their family members.
    George “Billy” Wagner, the father of Jake and George, faces the same 22 counts.
    On the morning of April 22, 2016, family members found Chris Rhoden, Sr., 40, and his cousin, Gary Rhoden, 38, dead in Chris’ mobile home on Union Hill Rd. Chris Sr.’s ex-wife, Dana Manley Rhoden, 37, and their children, Hanna May Rhoden, 19, and Chris Rhoden Jr., 16, were found shot in the head in their sleep in their mobile home down the road. Hanna May had given birth days earlier to a baby girl who was not harmed. Clarence "Frankie" Rhoden, 20 and his fiancee, Hannah "Hazel" Gilley, 20, were also found shot to death in their sleep. Their six-month-old son was in between them covered in blood but unharmed. Frankie’s four-year-old son was unharmed in the home as well.
    Kenneth Rhoden, 44, was found shot once in the eye in his camper on Left Fork Rd. more than seven miles away.
    Angela Wagner’s mother, Rita Newcomb, pleaded guilty in 2019 to a misdemeanor count of obstruction. She had been charged with forgery and obstruction of justice for lying about signing and notarizing custody documents related to Hanna May, Jake and George’s children. Newcomb has agreed to testify against her family members.
    Billy Wagner’s mother, Fredericka Wagner, was initially charged with obstruction of justice and forgery for allegedly lying about purchasing a bullet-resistant vest for Billy. The charges were dropped after it was discovered a plate in the vest was manufactured after the homicides. Prosecutors have said they may refile the charges at a later date. Fredericka has been subpoenaed to testify.

    and Frankie’s fiancée Hannah “Hazel” Gilley, 20
    The Wagners did it so they could get custody of the young daughter Jake had with his ex Hanna Rhoden, prosecutors said. Jake indeed won sole custody of the child, now 8, after the murders. The Wagners moved to Alaska. That all changed after authorities arrested them in November 2018, sparking a legal battle lasting almost four years.

    I loved this opening! Everything they plan to prove. This is the victims story. A family chart would have been helpful. Smart to take jury to the properties for a clearer understanding.

    Dear God undoubtedly the devil walks among us. Those poor babies now have to grow up without their parents. To call this individual a monster is an understatement. How cold does a person have to be to kill a mother nursing her precious baby! God its sickening and that's also an understatement. There are no words that suffice. Rest in peace to all of the victims.

      Not just their parents, but their entire extended family! That’s almost a big of loss as parents! I had a single mom and my grandparents, aunts, uncles and cousins were a HUGE part of my life. To have grown up without my mama would have been a tremendous loss, but to not have the other people who loved you almost the same as a mother, would be devastating!

    I’m sure the female prosecutor is a great attorney, but goodness gracious I had a hard time understanding due to all the pauses, ands and ums, and corrections. I watch boring court cases all the time and this was by far brutal.

      I just began this trial on here and the “um’s” are really making it hard to follow! I hope the jury is able to get passed them, maybe it’s different in person, O don’t know, but I’m rooting for the prosecution been following this case
      For years and I just wish the opening statement had been better rehearsed and she has more confidence

      She is not a dynamic speaker, that is for sure. She was unbearably hard to listen to and follow and if I was a juror, I would have already stopped paying attention. She comes across as so unprepared! Girl, did you not practice? You are a prosecutor, you have to be a good speaker!

      I remember all the connections and relayed it to my husband perfectly afterwards. It’s actually quite easy to follow if you listen. Does she say “um” a lot and try and add info? ABSOLUTELY!! But I guarantee she’s never tried a massacre such as this, with all this extensive info that is extremely important to the case and needs to be relayed in lay terms to normal people. I would actually pay to see you go up there and do better. Let me know when the show is 👍🏻

      Try counting how many ummms are in her opening statement, it's almost impossible to do.

      I'm with you on this one @Lauren Martin.
      I'm in the UK & had heard of the case, but not many of the details. Basically I knew 8 people were brutally murdered, except for some babies, & the 2 surnames of the families involved. That's it.
      I followed along & was also then able to relay the details to a friend who, like me, is a True Crime Junkie.
      As far as the "Ums" etc, it's clearly a habit, one it's likely she's very aware of.
      I'm sure if her team, the Judge, &/or whoever else, felt it would have a truly negative impact on the case, she would not have been taken on, let alone deliver the Opening Statement!
      Habits are HARD to break!
      Is anyone here perfect? We ALL have habits & again, they're hard to break. Otherwise there wouldn't be any, would there!? For all we know it was maybe how her family, her favourite teacher (if she had one) or her school friends spoke whilst she was a child, people she spent a lot of time with, & she just picked up on it. Who knows?
      Remember Chris Watts & how he said "Like" in almost every sentence? As did NK? Did they BOTH just happen to do that? Or did one of them pick it up from the other, & formed the same "habit"? It's possible.
      Does she do it on purpose? No! Of course not. Especially when she knows the world's eyes are on her. She's a SPECIAL Prosecutor, so she must be doing something right.
      I'm sure she'd rather she didn't keep saying "Um" all the time, but that's just part of who she is.
      I know someone who sniffs ALL the time.
      Sniff, sniff, sniff. She doesn't have a cold, it's a habit & she hates it.
      However she just can't help it.
      So, if any of us here are perfect, including myself, & have absolutely NO "annoying habits", please, do let me know.
      I'm putting MY hand up straight away & will state
      "Yes!
      I have what "some people" would consider "ANNOYING HABITS". One of which is extremely distracting for others.
      Yes, I know, I'm not a Prosecutor, but I do have a very responsible job & presentations & public speaking are involved.
      Personally I thought she did a great job of explaining & unravelling an extremely complex case.

    I painfully listened for 2 hrs before coming to comments 😇 even aside from the length 😣 all the trailing off, back-ups, & incessant “so, um, and aaaaannnnd” I had to pause 3x or so bc I noticed myself zoning out 😬 I feel for the jury not having a pause button 😰 “right?”

      Agree- however, I came to look for comments 1.5 hours into it, because it’s extremely difficult to follow the opening because of her pausing and mistakes and she says 4593762 “um’s.” She sounds depressed. Other prosecutors are upset and passionate and engages you so you’re paying attention and follow what’s going on. Like Jodi Arias prosecutor.
      It’s not an article, or a news report, where you can read or watch and gasp at the terror. And it doesn’t symbolize lack of horror at the sickening and scary tragedy.
      Remember….there’s a jury…who needs to be focused, awake, and follow it correctly.

      Agree. But, to be fair, there is a jury…that is listening to her. If it’s painful for us, it’s painful for them. I would think you’d want the jury focused, alert, and absorbing all the information. Unfortunately, the way she delivered the opening statement, I doubt any one of those occurred. Which, is highly unfortunate in a case of this magnitude and tragedy.

      It just goes to show that public speaking requires preparation.
      It’s the bajillion uns and the perpetual back-tracking that makes her whole narrative impossible to follow and irksome to listen to. The fact that the crime is so heinous makes it that much more unfortunate that the delivery of the opening statement is so disjointed. One can appreciate the gravity of the trial and still critique the orator.

    Can you even imagine being this little girl that sparked a custody battle turned brutal murder of one entire side of her family, the other whole side goes to prison for the 8 murders?? I hope for her sake they changed her name when she was 2yrs old and noone ever tells her who she really is. I can't even imagine what she would/will go through when she's old enough to really understand all this, the guilt and shame she might feel knowing custody over her is what sparked this. But a crime like this goes deep, its not just about custody, you don't just murder a whole family side over just custody, there is deep hate that causes this. Unreal. After reading the comments all I can hear now is "UM" and "AND" but this prosecutor never met a detail she didn't love to tell. I hope they prosper in nailing these sumbiches.

    Am I seeing this correct, her opening statement is THREE HOURS LONG?!??! That's poorly done, not necessary. I also agree with a journalist who said that they should've presented a relationship chart including ALL of the outside members of the family and friends that are involved in the case, and how they're related to the victims and suspects to give a clearer picture to the jury.

      The jury had to request note pads & pens! This rule area prosecutor’s office needed to outsource help from a more seasoned prosecutor. Where is the conviction in her voice?.Uumm..

      @@jasminej2844 I believe this has been speculated as one of the reasons that Casey Anthony got off with it. The jury was bored silly and found it hard to follow the prosecution's case due to an overload of drawn out information

    Also…I don’t know if others do this but when a speakers voice drops, toward the end of a sentence, and becomes barely audible…my ears stop listening. If the speaker doesn’t care enough to keep their voice well modulated I don’t owe them the courtesy of listening.

    This was so incredibly painful, I almost feel bad for the attorney. I can’t believe the prosecution team picked her to give the opening. Did they not rehearse her opening statement? I have to believe they would have given feedback to keep it to 90 min max and that you don’t need to go into every detail and down every rabbit hole because those aspects will come out during the trial. And of course, they would’ve told her to watch the “ums”! She has really done the family a disservice. The jury has probably already decided they can’t stand her and hardly remembers anything she said because there was way too much to digest. If they even stayed awake! Terrible opening statement.

      Someone needs to tell her all the ums and ands are unnecessary. She says um over and over not to mention repeatedly saying and in between every single simple phrase. Definitely a public speaking class should be in the works.

      This case has already cost so much, and the cost of finding a death penalty qualified prosecutor couldn’t be cheap. Having said all that , I think it’s safe to assume they accepted the one with the lowest price tag

    I understand that a huge part of the Attorney's job is to tell their side of the story, painting a picture for the jury. I am honestly appalled at the opening statement of this prosecutor. I'm sure she's great at what she does but come on, a little bit of rehearsal would've done her some good.

    The woman/prosecutor has really done her homework and knows this case inside and out. I remember when this happened and there was a whisper that family might be involved. If you do love a child so much and want full custody, how can you kill her mother and family members and friends. These fiends are so twisted, who do you start with. The bloody parents. Very sad for the child and her mother.

    For those criticising others complaining about her disjointed presentation and all the "umms" and persistent tapping of the stand near the microphone.
    Some people find it harder to stay focused, or find over detailed information/explaination unnecessary/confusing. Remember our brains all work very differently!

    In the 1840s my great-great grandparents moved from Bavaria to Pike County, Ohio. My great-grandfather moved away in the 1890s. I hope none of these people are related to me.

    The prosecuting attorney is extremely thorough in her opening statement. It almost felt as if she was giving way to much information. Granted, it was a mass shooting with 8 victims.
    It just was easy to feel lost in her opening statement. Instead of giving a synopsis of what happened it was far more detailed.
    Maybe it’s just me.

      It was very detailed because she couldn't talk about many of these things in the evidentiary phase of the trial. She needs to load some information onto this part so she can be sure to have told the jury everything that they need to find him guilty and give him the death penalty. It seems like way too much, but it was all necessary. I think many people on here don't get that.

      You try summarizing this very complex case with 8 victims and 4 suspects, trying to keep everything straight and stick to the facts about this one specific suspect that's in trial at the moment. It CANNOT be easy. Oh no, she says um when she's trying to remember which train of thought she was on while speaking! THE HORROR. I'd rather her ums instead of her rushing thru it, confusing the jury and end up with a not guilty verdict but go off.

The prosecutor for the Parkland case didn’t miss a beat and there always double the victims and crazy circumstances, yet he managed to not only remember their names and every detail, he did so without barely using no notes.     This is absolutely horrific. Why in world did it take 8yrs for this to get to trial! These poor young people wiped out. And all the babies who lost their parents.     The Defendant reminds me of Norman Bates from the movie Psycho - after he is caught he won’t even flinch to swat a file to show the detectives how non-violent he is. This Defendant hasn’t moved or flinched except to wiggle his nose.

    I found nothing wrong with this opening except the last 20 minutes going over the language of the offences dragged on.
    I didn't know much about this case & found it easy to follow what was said.
    There's alot of ppl involved so I can understand why it took longer than most opening statements.

      Perhaps she is cognitive of the fact that she is in charge of getting the horrific story out and realizes not every juror picked are well educated.       This is a death penalty case. she laid out the whole case with tons of evidence that was found. This evidence will have to be corroborated during trial, and it will be. A death penalty case is the hardest one to prosecute successfully. I think she did OK even though it was a little long.

      She didn't drone on & on & on.. she clearly explained a very complex, a very intertwined, very voluminous crime.. in which 8 people lost their lives, many more were involved... and you have a whole family to paint as the perpetrators.. so that they can get a successful conviction. A crime with one victim & one assailant... who have never met each other.. can need an hour long opening to establish the facts. She fit 16+ plus actors into the mix with little over half that. Besides, much of this Evidence had been blocked in the evidentiary phase.. so she had to take the opportunity to get it in. Sheesh. It isn't a simple shooting of a Stanger in a dark alley. A whole family was slaughtered. The story no doubt takes a little time.

    One thing I can say which is not always a norm is the officers and others involved did a good job to secure evidence and find witnessed... but I do also feel that this prosecuting attorney dropped the ball and is very lucky that there's so much evidence and a plea to help prosecutors. She misspoke names of gunw, bullets, bullet projectary was off from what corner reported. A mess

    How about, “You will see that 3 different weapons were used.”? Then show that through evidence, during the trial.

    I Live in Ohio, esp when this all occurred. As bits of info came out, it was obvious that this was a personal attack. That's when, to me, I suspected family. As far as the prosecutor? I have never heard so many 'and um', um', 'and uh's'. Very hard to follow her presentation when her delivery is broken and stuttered.

      That means he’s the 4th in line named George in their family for generations. So you have a senior George (his dad) and he’s the junior.
