Yes. All countries, not just Canada, have legislation to manage emergencies. The USA has the War Powers Act which has the same sorts of powers. Management of emergencies require those powers but that does not mean they will all be used. Just read up about these things and educate yourself before getting them in a twist.

So if this is such a big emergency, why wouldn't first be a dialogue between the protesters and the Federal government? Maybe we Canadians hardly know of the Emergencies Act because prior governments would have at least tried to negotiate with the protesters first, before bringing out the big guns, like good Canadians would. This has been a shameful display by current ruling minority government; first by denigrating it's citizens, then refusing to even talk to the leaders of the protest, then by over-reacting and calling it a big emergency when this largely could have been avoided just by being good people. They are completely out of touch with reality.

As I've mentioned elsewhere, it's an act. Can an act supersede the Charter? I'm no lawyer but I don't believe an act can take away an inalienable right. That was the whole point of the Charter, to keep the rights set in stone and not set by the whims of the current flavor of the month government. Unlike the War Measures Act (1914), the Emergency Act (1988) does not lift habeas corpus. On the other hand, the protesters are breaking bylaws and laws all the time. Many will be arrested, processed, released. Probably most charged with mischief. On the other hand rigs will be impounded, and that will be 3xpensive. Ring leaders will scuttle away long before that, though.

So if this is such a big emergency, why wouldn't first be a dialogue between the protesters and the Federal government? Maybe we Canadians hardly know of the Emergencies Act because prior governments would have at least tried to negotiate with the protesters first, before bringing out the big guns, like good Canadians would.
This has been a shameful display by current ruling minority government; first by denigrating it's citizens, then refusing to even talk to the leaders of the protest, then by over-reacting and calling it a big emergency when this largely could have been avoided just by being good people. Who came very close to shutting down the Canadian economy by blocking our most critical trade routes. Even as the Covid-19 restrictions which are their casus belli are being rapidly lifted here. As I've mentioned elsewhere, it's an act. Can an act supersede the Charter? I'm no lawyer but I don't believe an act can take away an inalienable right. That was the whole point of the Charter, to keep the rights set in stone and not set by the whims of the current flavor of the month government. The federal government has not met the threshold necessary to invoke the Emergencies Act. This law creates a high and clear standard for good reason: the Act allows government to bypass ordinary democratic processes.
The Emergencies Act can only be invoked when a situation "seriously threatens the ability of the Government of Canada to preserve the sovereignty, security and territorial integrity of Canada" & when the situation "cannot be effectively dealt with under any other law of Canada."
Governments regularly deal with difficult situations, and do so using powers granted to them by democratically elected representatives. Emergency legislation should not be normalized. It threatens our democracy and our civil liberties.

I’m not sure why they need this measure. If someone is blocking a roadway, then the highway traffic act should suffice. If people are on the sidewalk and not causing any damage, let them protest.

The juxtaposition of these so-called "Experts" explaining the need and the conditions of invoking the Emergencies Act against the backdrop of breakdancing and peaceful Canadians is comical, yet terrifying at the same time.

Unlike the War Measures Act (1914), the Emergency Act (1988) does not lift habeas corpus. On the other hand, the protesters are breaking bylaws and laws all the time. Many will be arrested, processed, released. Probably most charged with mischief. On the other hand rigs will be impounded, and that will be 3xpensive. Ring leaders will scuttle away long before that, though.
