    Kindly in regards to AOS for Assylum pending, Am I eligible for AOS when I've been selected for DV lottery? Entered in US on B1/B2 Visa type, filed assylum before my I-94 expiry. I have always followed you on Yutube & your articles as well indicating Assylum pending is NOT a status. I am not F1, H1 or EB active meaning I am not in status but having immigration benefit for authorized stay. How do I adjust my Status on DV without leaving the country?

      You'll have to do consular processing, which means that you'll have to process your green card outside the United States and mostly in your home country. Since you're an asylum applicant, it's not advisable to go back to your country of persecution. You will have to request a process transfer to another third country (for instance, Canada 🇨🇦) for consular processing. Remember, you have not overstayed for more than 180 days since you got your authorized stay when you were still in status. Hence, you're admissible to the United States.

      @@samwelmajani2624 Thanks for your response but it's not possible for Consular processing for an individual who has no tie in third country i.e Marriage or Work.
      Secondly, DV time lines are very tricky with consular processing especially when some Embassies prioritize some visa therefore chances of interview are slimmer depending on Embassy capacity too.
      Lastly having mentioned timelines on DV processing, Individual in Asylum pending interview situation needs an Advance parole to leave US on humanitarian grounds (Is DV processing in 3re country a humanitarian ground?). Advance parole takes time to be approved & with interview dates if any in through Consular, the time factor is a challenge.
      It's not easy, anyway I don't see how this can be explored. In a nutshell this leads to abandoning DV processing all together and focusing on pending asylum interview.

    Mam my father has also pending it has been like 4 years and still no interview he applied in 2016 or 15 , but now i have grown and am under 21 i want to go USA to study will that affect me to get visa ?
