Very light, I was hoping to get some details about situations where the house has appreciated and there is capital gain if sold, so how to manage that?do you step up the house value to the estimated price paid at the divorce? How do you do that? Is it even allowed? What are the consequences to the party that takes the cash? Do they owe taxes on that? Is it free money to them? The above are the questions that really need to be addressed or at least covered under the topic. If you don’t have the expertise at least hint that an accountant should be consulted to assess the impact of the decision of buying out someone else.
Neither spouse wishes to sell or move out. But one spouse does not want the other spouse to live in the house, whereas the other spouse doesn't care. What happens?
What if you were married to the narc and he didn’t put you on the mortgage and now says it was never a marital home. 3 years later and the lawyers are the only winners. The ex narc is doing everything he said he would!
Maybe you could speak about QDROs. Ex could not assume mortgage loan bc he didn't live in the home. I had to sign Quit Claim deed, and he refinanced the home. I expect to receive release letter from mortgage company in 3-4 months. Wished I knew what to expect, the timelines, and had divorce coaching throughout this long, hard process.
What about giving up retirement assets? How do you manage that? He wants a larger amount to cover the taxes he will pay when he takes the money out after retirement. I will be assuming the current mortgage and also have less retirement. 35 year marriage ending p- mostly stay at home mom but started my own craft and teaching business to help financially. Now with covid I have no income.
@natureArtist I hope you stick to your retirement assets and do not give up on these. I don’t think the law is fair to take retirement assets especially as you mentioned that you didn’t have a job with a W-2 paycheck that gave you a regular consistent contribution to your retirement account throughout the 35 years of marriage. Fight for your retirement that will be all you have for your support in old age. I don’t care narcissistic or not. I don’t care what they say, the law, I’ve learned IS NEGOTIABLE. Best regards🙏🤗🤍🌺
Thanks for the advise how about if our house is paid off and I want to keep it till my youngest is a adult its he’s and mine. He want to sell and I want to raised out children here can a lawyer help me?
Been kicked out my home for. Year . Still waiting on something to happen . He still has my personal and community property. This is unbelievable. I went there to see my 17 year old daughter when he wasn’t home and she told him, he called police and almost had me arrested!
What do you mean "kicked out"? Did he file for an order of protection? Otherwise, even if your name is not on the deed/title, I don't think you culd have been ejected by him. It's communal property.
What if the husband bought the house while separated. The wife moved out with her daughter. Now she wants 20%. He’s ready to divorce and re marry. What can he do?
@@RebeccaZungEsq increased debt to credit income ratio;when spouse who doesn't take car is still on title loan, sites often mention problem of both parties still being on the loan, but do not mention that the problem of qualifying for house after divorce due to all car loans from both spouses being used for debt to income ratio....no easy solution if credit score won't allow for refinancing. Thank You.
@@RebeccaZungEsq I think courts rarely if ever want divorce decree to have Co-ownership...maybe judge won't permit. But if one car needed to transport kids, maybe... My problem is knowing what power courts have two years hence, so I can plan for my two grade school age kids: Decree would be wife refinances a volvo,950 a month car payment, in her name only in two years; car has. 4 years currently owed. Her credit score is too bad to refinance now. In two years years decree states she refinances. But it doesn't say what happens if no one will refinance with her if her score is too low. Does court have power to force sale If refinancing not possible due to poor credit score? (NH) Obviously, staying on creditors books for 4 years show on debt to income ratio of 950 a month, yet if mother of kids take a off and never sees kids, it leaves me less able to provide best environment for kids because this 950 car payment would affect my debt to income ratio if wife cannot refinance and court cannot force sale. I have not found any information on this yet. Thanks for any ideas or insights.
@@RebeccaZungEsq Forced sale, might not be an option in NH...? Does court have the power to force a sale in some states, but not in others even if the forced sale wording is in the decree?
Rebecca's videos give power to the listener. This includes all phases of dealing with the worst people on earth.
Your channel is the best on these topics!!!
Thank you! I'm learning a lot from your video's❤
Food for thought! So much to learn!

Great advice. Thank you!
What if the house needs repairs and one of the them wants to keep the house? Can the estimated repairs get deducted from the division of the asset?

What happens?
Equity meaning left over from mortgage or worth of house post appraisal?

What about forcing the sale if both people want to buy the other out?
Does the person who refinances the home split what’s owed also?

@donna what do you mean by divorce coaching, please?
Thank you in advance for your reply🙏😊🌺
@donna how are you doing now, 1 year later after the process? 😊🌻
Does it matter if My name isn't on deed..? Married for 30yrs
What if she quits paying the bills and moves out before the divorce becomes final?
What if it’s already paid off
So the value of the home when splitting is the Assessed Value not the Market Value?
I prefer option 2 instead

I am from NEW YORK CITY
Give the house back to the bank, no one gets shit
My ex stop paying after mortgage
There is more litigation to “split the proceeds” from selling the house. What a crock.
Thought was going to be with a narcissist co-owner sibling
How about the wife who cheated forfeits everything? Narcissist my a$$
You people way over-use the word narcissist. You dont even know what it means.
