      @@Tmtrnr And yet they get away with it all the time. Really, filing a dmca complaint should(as I understand it) require an affidavit that you legally declare that they absolutely are stealing your content, which means you *_SHOULD_* be able to take them to court over it. But that's an entirely different, and still expensive fight, and while you may get a judgement for whatever amount, that doesn't mean you'll actually be able to collect on it.
      Our legal system is utterly fucked.

      DMCA Claims are ultimately settled by a court, not by RUclips. To prove a DMCA false you'd have to get in front of a judge and have a judge rule that the content was fair use/not infringing on a copyright. Furthermore if it goes that far and a judge believes you acted in bad faith when filing a DMCA, then you can face fines as a result. RUclips can't get involved, it's a legal dispute not social one.

      I don't see the issue. They're willing to hash this out in a legal setting so everything is done by the book. If this youtuber thinks he's right then he should meet them in court and challenge thier stance. It should he an easy win if these devs are as shady as he claims them to he, plus it would be good for his channel. Seems like a win win for him.
      only reason i can think of why he doesn't go to court is because he feels he cannot win. It's not like it will cost him anything, I'm sure his subs will pay the legal fees if he begs enough.

    10:14 It wouldn't be an indie developer's Discord if there wasn't that one meatrider who is so committed to ensuring that the project he's given money to stays somewhat afloat to the point that he is encouraging said developer to legally and financially ruin you, despite the LITERAL PAGES OF SEARCHABLE OPEN-SOURCE information regarding the dev team's dubious history in this industry. So blinded by the sunken cost fallacy that not even 7 days after joining the Discord, he's already fully committed and sided with the devs and rejected all else. Incredible.

    It's time to Ralley against companies who falsely use dmca takedowns, they need to be held accountable, and RUclips needs to be held accountable for having zero protections for creators against this sort of issue.

      I don't get why DMCA takedowns that are counterclaimed and where the first party doesn't follow up with court filings aren't punished somehow. If someone issues a DMCA takedown request legitimitely, I would presume they would also be willing to pursue further legal action if the copyright infringer didn't remove the content. I think RUclips should refer the party issuing a spurious DMCA takedown to law enforcement. I assume that RUclips requires full identification before issuing a takedown request, but maybe I'm wrong about that.
      As it is now, someone could issue DMCA takedowns on every video on the platform without reprecussions, and that seems very wrong.

It all comes to safe harbor status, basically this means that when someone wants to sue youtube for content they host, youtube can claim that they are under safe harbor status: meaning that you need to sue creator of content because youtube has no knowledge of content hosted on a website. If they knew they hosted pirated content/other illegal stuff and you can prove it, they lose this status so you can sue actual company. when someone issues copyright strike, the only thing youtube can do is verify information claimant put (like if he cites law to take video down and not something like: he slandered me) and they can try to verify if content they claim to own (not actual content in the video, but what they claim to own).. they actually own it.

      It's not really youtube's fault. They're required by law to not ask questions, but they in fact deny obvious bs claims that aren't even filled properly for example, and they have sued several copyright trolls.
      You should want to change the law, it's the DMCA that's made to screw normal people and favor the big corpos

      Also these scammers have been around for over a decade making like 20 scam games and are well known for their scams - their first scam title was literally the reason why steam introduced the easy refund system. If there's anything that's currently hyped or relevant you can be sure they'll release something in that area. And in between there's gonna be another Zombie Survival game scam from them.

    I'm starting to feel Steam needs some sort of developer trust metric. Like a review rating for developers.
    As game development gets more accessible, we're going to see a lot more scam projects emerge.

      That would be wonderful. I agree with your comment about game development. It's a double-edged sword that is hard to deal with. On one hand, as a developer myself who wants as many people as possible to be able to express themselves through code and the game art form. On the other, I'm worried that we'll see a flood of scams and disingenious projects fooling customers. Ultimately it will hurt genuine and honest developers, because trust in new and small developer teams or solo endeavours will be slashed.
      I think games platforms like Steam could and should be a big part of the solutions to this dilemma.

      I don't know how this could be done in a way that's both fair to indie devs working on their first game, but also useful for highlighting companies and individuals with a low reputation.

      they backed tons of youtubers so far that spread hate and youtube defends them somehow????
      i got called a F slur a few times on one of those channels comments. told them to KYS and i got a day ban for it. for hatespeech.
      went back days later. their hate towards me and lgbtq was still up. telling i should unalive myself for being the wrong way.

      Not sure if that is a good idea. It´s how it is to safe people who have legitemit claims. But there defenitly shoud be repercussions for false claims like this. Like: one false claim and on following claims the legitimacy of those claims is checked before the vid gets taken down.

      @@brodequinakatukk7591 Not a good idea no but at the same time the DMCA has changed barely one iota (no major things to make sure it meets the criteria of the changing landscape, it was made for a time when the internet was relatively speaking still "small") since it was first enacted in 98'...It doesn't have ANY safeguards against false claims, it still operates the exact same as it did in 98' AKA a goddamn mallet and it doesn't matter if YOU are the copyright holder and it's your stuff that's being hit with a DMCA, you're STILL hit the exact same as the person filing it would be.

      lol I got banned for “spreading misinformation” in a certain hot game’s discord for asking about the inclusion of cosmetic real-world money microtransactions being worked on based on a certain website that shows their game package updates, before they’ve even put out a demo/beta for everyone, albeit they did do a “closed 2-day playtest”…

      companies in the EU still do it. products get "adviced pricing" data from manufacturers but companies will inventory it at a lower price and call it a "discount". Some scam companies like samsung will force a contract price so businesses cant compete and they will ban you from selling you their products.

      Not always. Several great games out there that served up their games to a select group of people pre-release under NDA, to get honest outside feedback without leaking details about the game.
      It can be used by honest devs, to avoid bad press about an early build, based on issues the dev are aware of, and have a plan to change well in advance of release, to keep the mystique around what the game will be like, and to avoid a bunch of hype too early - You don't want people to get too hyped, if your game won't be releasing for years. People might get tired of speculating, and move on, or make up too many preconceptions of what the game will be like.
      It has to be put in the context of the rest of the project, to say whether it's a scummy move. In this case, it most definitely is.

      NDAs are pretty common in early play testing but generally the terms used allow play testers to talk generally about their experiences but not about specific details. It leads to a grey area where you can legally talk about a game you play tested, but you could also run the risk of letting something slip that could result in legal action so most people tend to just remain silent for the sake of playing it safe.
      In this case if they just want you to clam up and not even utter their name, they're using it as a tool to silence you completely. That's not a red flag, that's straight up scumbaggery and the response to it should be exactly what we saw in this video. Don't play their shit, don't sign yourself into silence, know your rights and firmly assert them. Do not let them threaten you.

    i actually found your channel during the Free Reign/sergey titov holy war. so been here for about a decade. this is so beautiful in a way💀
    also, people on the discord are blinded by hype and pretty much have 0 critical thinking skills whatsoever and they will paint anyone who talks bad about the game they are excited for as a villain. i see it very often. if you’re early to spot and call shit out, that shit always happens. happened with Identity too. happened to me with another kickstarter game. shit is unbearable so i know how that feels

      Depending where he lives he could get "media liability insurance". Its a system some states have that will cover all legal costs. Any journalist (even youtuber) or media celebrity can get it for cases like what Fry is going thru. I wouldn't be surprised if he already has one.

    15:10 The way they price their different packages may actually be considered fraud/deceptive pricing in some countries. If I'm releasing a new product and I intend to sell it at $100, but I release the product for $200 instead with a 50% discount, to give the illusion of a better deal. It can be considered illegal in certain situations and countries, because it was never actually priced at $200 at any point in time, and I never intended to sell it at $200.

      netherlands where i live is one of those... companies got shut down for false discounts. its a pretty no go way to do bussiness. pretending the product is always been at 400 euro even if it just released. and keep a sale on it for say 90% off. 40 euro only wow.
      and then the company gets strucken down. its funny to see.

    Wow... i'm sorry you gotta go thru this Fry, but i really appreciate it because it shows they want to make it seem like they are transparent but really aren't. If they take it to court i'm sure the community will come together for you because that's just disgusting of them especially when what they're claiming is provably FALSE.       They probably want to avoid court at all costs, because then their scummy practices might be brought to light. Who knows what other illegal/borderline illegal stuff they're hiding that BigFry didn't manage to uncover. They are also opening themselves up to questions regarding DMCA abuse, which is illegal. They probably only want to use the threat of court to make BigFry back off. Might work against a new content creator with one subscriber, but they don't know who they are dealing with.

      They're releasing like 2-3 scams each year - that's not even a joke, most of them fly under the radar, sometimes you find a website of a new WarZ or anything else with the exact prices tho, even tho after like 6-8 months they switch "dev teams" and other names are mentioned while the games get free 2 play.

    Bought the huge pack for "The War Z" ages ago, they deleted it off steam and renamed it as something else and released that essentially removing it from libraries.. I can probably pull email receipts and steam wallet ones(If steam goes back far enough) Do not by these guys' stuff, I'm glad someone is around to warn people now

    You should reach out to Artemis Knives. Last i heard from him on his stream he seemed done as fuck with sergey. Id love to hear an interview with him what it was like working with sergey. As far as i could tell it seemed to be like the video game version of the disaster artist. Sergey being Tommy Wiseau and "the game" (WarZ, Aftermath, SS, etc.) being "The Room"

      This started back in 2012. The game received huge hype in Russia, but it was a real disaster because of which the game turned into three separate pirated games supported by modders (which were closed anyway due to lawsuits)
