Nothing sinister and not a breach of human rights. Prayer in this particular situation can be seen as harassment of anyone visiting this clinic - hence a breach of the law.

While people who can't afford to eat or heat homes or watch TV are quickly hassled and arrested for it.
Somebody knocked a police officer unconscious and was punished with a £165 fine and a week of community service

How does one even enforce a bail condition like that?

Then you are into territory where police can just arrest you for what they think instead of what they can prove.

To be honest, this lady strikes me as someone who truly lives her values and would honestly answer if she had prayed. She seems to be the sort that you could ask to hold your life savings while you pop round the corner to buy a pint of milk and she would be there when you came back.

It needs to be challenged in court, over broad and too restrictive. The clinic was closed, no one rights were infringed on but her rights.

Her biggest mistake was talking to the police : The burden of proof of her praying would've then been the police's problem : Say nothing except name and address and then announce you will be saying nothing until you have legal advice present. When approached by them ALWAYS remember , they are NOT your friends !

As a veteran of two gulf wars, i'm starting to feel ashamed of my service and doubting everything i thought i was fighting for.

You were used to stop the Gulf states from ditching the US dollar as the medium of trade for international commodities; Iraq had switched to the Euro and had been doing very well out of it. When the body bags stopped coming home, US companies got lucrative contracts for reconstruction and the UK didn't seem to get anything. Then in 2008, when the US started their QE program which devalued the dollar, Russia, China, India and a few others discussed moving to using a basket of currencies (not the USD) as their basis for trade and, as if by magic, the suggestion was made to extend NATO membership into Ukraine and we got another war (in which I see both sides as being victims). A lot of the QE money lent to the banks was invested into the US shale oil/gas industry, including the building of LNG terminals and it turned out that there wasn't a market for it because they couldn't compete economically with a pipeline (e.g. Nordstream). That debt was in danger of becoming the next bank-busting sub-prime debt crisis. A few months ago, Iran told Russia publicly that they should be pursuing a peaceful resolution and that they would depose the USD as the medium of international trade and now suddenly people are agitating to attack Iran.

But now that i see a group of cowardly so called officers of the law, harassing and arresting an unarmed harmless women for merely what she may or may not have been privately thinking in her head, i find myself ashamed that i was complicit in furthering the future goals of such evil actors in our very own governing establishment. Strangely, I've found many people on left-leaning forums who are happy she was arrested and ask for severe sentencing, because she was "causing anxiety with her presence". Interestingly, the mass looting and rioting and arson (committed by some sort of people I can't even name because my profile would be banned), are not considered by them as something that can cause anxiety.

Remember of course that the Police Officer sent to the scene would be liable to serious discipline offences if he Failed to do his best at the Time.
As Police Officer I often had to enforce Laws which were not to my liking, as I had also to protect people with views with which I strongly disagreed. But that was part of my duty as defined by my Oath.
If you don't like a Law get it changed. Don't keep voting for these odious Politicians .

Just to clarify my actions were always within the rules set down by English law as it followed rules set out by the European Court of Human rights and the UN declaration of Human rights. Unfortunately the current government has determined to revert to a system of law without international oversight, hence the flood of very poor law of recent years. The problem is we either obey the law of the land as it stands, whilst attempting to change it for the better, or accept the inevitable injustices and chaos that follows.

@@paulsawtell3991 They may not be able to prove that you were praying, but they can reverse the burden of proof i.e "prove you are not praying, or be arrested." On such a flimsy pretext, they can search your person and dwelling, confiscating all and any materials such as computers, phones, books and artefacts that they can use to make their case from anyone who lives there, not just you, and you are not likely to get your property back in a timely manner, if at all. It is truly totalitarian, and all done under colour of law.

@@DJWESG1 Oddly enough, I have wondered about that possibility given the high incidence and prevalence of the crime and the way the police most often ignore it (only 5% of all cases are prosecuted). Coupled with the profile of some victims. Evidence needed though.

I actually become religious in the last few years. Government fear over religions and prayers made me think it is real. In AU is a criminal offence for a priest to pray for people with gender issues even if they asked for that. Some people with gender issues are religious and asked priests to pray with them or for them for them. No, it is criminal offence and priest can go to prison. I gave up on being a law abiding man in the early 2000's. This country has put in so many laws since the mid 90's that are contrary to my morals that I simply cannot be a law abiding man. I have made the choice to be free, regardless of the consequences. I speak my mind as and when I wish. I'm sure at some point this will lead to my arrest - not for physically or financially harming any one, simply for speaking my mind or refusing to go along with something evil, oppressive or tyrannical.
The law is now so messed up and deeply immoral that we all must make this choice.

@@TheZooBrooksAB yep, fully comp. I have home insurance too. Mandatory insurance is a tricky point - I understand why its there and why its important - same with MOT and driving test, not happy that private companies get to make a profit on MANDATORY purchases though.
I think it would be better if the 3rd party cover was put under road tax instead of being handled by insurance companies. not having some form of mandatory 3rd part cover for vehicles would simply lead to people being made bankrupt if they make an expensive mistake and no recompense for the damages, ordinary people don't have 10k to 100k lying around in the bank.

That's what I was thinking. In all technicality it's still an offence under the wording of PSPO but it's totally not in the spirit of PSPO which is to prevent harassment. If it wasn't clear the woman was overtly praying or interfering in anyway this sets a worrying condition if not successfully challenged.

This young woman was arrested for having ALREADY committed a crime; the location and execution of which was inside her own head and a crime which left no physical evidence whatsoever in the world because it was literally a thought crime.

It means that what she was thinking was not manifest in anyway. It might as well have been me thinking about what to have for dinner. The reach of society's laws stops outside a person's head.

However much I disagree with the breadth of this law and the way it was applied, it is not a global ban on prayer and it is not solely directed to those who disapprove of abortion.

The other side of the prayer story is that there was a general cease and desist ban because people have been doing it for years and people have been harassed going into the clinic and also the residents complained. Basically the ban was part of consultation to stop violence and harassment.

The idea obviously is that there would be no theatrical displays outside the hospital trying to pressure the patients to not go. And we don't know what sort of theatrical display the woman was putting on while standing there, maybe praying, since that wasn't mentioned.
Regardless, it's a pretty broadly written law certainly, and I don't know if the police should wander around the hospital demanding people if they're praying in order to arrest them.

Just cause the law says it's legal does not make it moral or right. Secondly, the clinic was closed at the time, she also stated she was not demonstrating. Check her own video out on the matter. Thirdly, where do you draw the line? Take away free thought or the right to show disagreement is a slippery slope to saying, what we say goes, you have no rights so we do as we please regardless of how it affects you. I got through only up to 50 pages and I had to stop because it was so depressing. I’m going to read the rest today. And I knew what was in the fiction is somehow now becoming our reality.
It's terrifying how close we are to that book being real. All we would really need is for a complete merger between the tech industry and government. The mass surveillance and behavior monitoring infrastructure is already there. Google and Facebook can accurately predict things about you that you don't even know. All you need are the right (wrong) people in power and for enough citizens to ask for it.

I can only guess the woman in this case is not associated with any organised religion because if she was Muslim or Jewish for example and had been told she was no longer allowed to pray it would be all over the news already (and rightly so!). No way is it lawful, nor is it proportional or necessary. I'm not sure what legal defence you could ever mount to justify it tbh.
Fact: I worked in Operating Theatres ( NHS) I Never worked in gynae, but, know of colleagues who would inwardly pray during terminations. I often have to stop when I am out walking and close my eyes for a few seconds or even a minute or so, just to collect my thoughts and take some deep breaths to arrest the anxiety I often get when there are a lot of people around me.
Nobody could possibly tell with any certainty what was in my head. No matter what I may momentarily think, it is ultimately deniable and unprovable!!

No one should have any control over a person's thoughts. Thoughts are private. If the person starts shouting out their thoughts in public, then there might be some consequence. And I don't know why anyone would tell a police officer what they were thinking if its prayer, thoughts are private or else everyone would be able to see them.

@@Wayfarer4Christ What if you picked the wrong denomination of Christianity of the 35000 that mutually contradict each other? What if it turns out that the Greek Orthodox Church, or the Lutheran church, for example is the correct religion? Are all the other Christians going to hell for picking the wrong denomination? The whole thing is laughable and deserves to be ridiculed.
Who is to say the person was not praying but sleeping. Let the prosecution try and prove what you are thinking. Good luck to them! Exercise your right and do not speak without a lawyer being present! Well done for bringing this subject into the public arena for discussion! Given what we have seen with climate protesters impeding the rights of others and police just looking on and here we have a person silently praying it is quite apparent the police have lost their way! As a community we need to tell our politicians what we think of this cause it is not right!
If this goes to court, then I can see it being appealed all the way to the highest levels possible. It raises fundamental issues, including whether if a police office asks you if you are praying do you have to answer them at all? Would the police officer then be able to arrests somebody because they had reasonable suspicion that they were silently praying? The whole thing seems bizarre.

@@saraheverardsrapers3910 The state will pay for the prosecution, and I suspect the defence would be paid for by the Christian Legal Society or something similar. This has he making of a test case.

Human Rights Act 1998 is what is valid, but does not prohibit breaches, only maligns all law to be read in view of the HRA, so causes a significant movement in our overall jurisprudence towards compliance. Question would be whether relevant law allowing for PSPO and relevant guidance in relation to specific PSPO is able to be read in a compliant way to HRA, vis-a-vis the prohibitions and breach.
Moral of this story is to just reply 'no comment' to anything a police officer ever asks you! So you cannot be arrested for some random by-law.

I can't believe they banned her from silent prayer outside the bounds of the area she was arrested. That's wild. The original 'crime' is a bit wild too.
The Freedom of Religion aspect makes the extended ban illegal. At that point, they certainly did overreach themselves.
That Judge should be banned from practice and every case he or she ever had should be overturned.

What this incident says about the poor quality of Magistrates and court judges today in this country is plain to see. We need to get rid of them all, and put people with some common sense in their places.
Alas, despite the enormous number of complaints about local councils, the people vote them all back in time and time again. Some local councillors have held their posts for decades.
I sat in on Alex Belfield's trial. It was a complete farce. The jury appeared lacklustre, the judge was bemused and the prosecutor was hamming up the case ridiculously.
The law is biased l'm afraid. They cannot justify giving a person who has caused libel the same harsh sentence as someone who has raped someone else. Ludicrous and medieval.
Ah yes, here we are, get rid of the judges and replace them with people who bend to my own odd biases.
