Universities have a code of conduct and have used them to take action when students say racist remarks. As a German, I need to explain a few things: first of all, there are daily protests against the actions of the Israely government in Gaza in many German cities, protected by german police, they are not forbidden. That's a myth, please inform yourself better. Videos of these protest can be found easily on RUclips or Instagram, for example. What is outlawed in Germany, everywhere and at these protests, is hatespeech. Against jews, against muslims, against people pf color, against LGBTQ, against minorities in general. People who would say in Germany what Harvard students have publicly said would be arrested and would find themselves swiftly in front of a judge. And rightfully so. Germany has learned, from its history, that voilence starts with language, and that threats, hate and hateful speech, lead to worse things. Which is why that language, verbalized or in symbolic form like swastikas, is a crime in Germany. That might not be the American way, but it is one of the reasons, that many young Israelis, who don't like their Trumpian government, move to Berlin, not Washington.

Sunny's limited experience as lawyer has no relevance to the arguments being made here. First amendment is not upheld at campuses in practice. This has been well documented and is expressed explicitly in the policies of many campuses. We all know that the rules have been enforced differentially and none of this handwringing has occurs when someone from the wrong group says something (people canceled over saying merit in scientific work matters).

Expelling or taking disciplinary action against a student who calls on genocide on campus does not violate the First Amendment because the First Amendment puts limits on the ability of the government to limit speech, not on businesses or other institutions. Alyssa never asked the colleges to go against the constitution. Sunny herself was defending the "Freedom of Association" and saying "It's consequences not cancel culture" when people were getting fired from their jobs for saying the smallest 'offensive' things... Research grants, financial aid, etc. And it’s not the threat of having their funding pulled that they’re afraid of. It’s the threat of being sued by students who faced discipline for exercising protected speech. Also, the Harvard administrators didn’t say they wouldn’t take action. They said that action would be taken depending on the context and if the speech became actionable conduct. If and when any student threatens or intimidates Jewish students, they should rightfully expect to be disciplined. But free speech demands that we don’t discipline people for simply stating political opinions that we don’t agree with. And no, Sunny shouldn’t be embarrassed for simply stating the law.

I think Sunny explained the law very well. If someone uses hate speech publicly it's technically protected. (Granted that person may be "canceled" by the public, but cancellation isnt a legal indictment). However, if someone uses that same hate speech in a one on one interaction it can definitely have legal consequences and be considered harassment. This is the basis of all contracts. Yes, a contract can not deprive a person of their basic rights, generally speaking, but the parties have agreed on a set of rules of conduct that they can enforce when one party has broken the rules. This is perfectly legal. So back to the question at hand: hate speech is protected speech. But 2 private parties can agree upon breaking their contract if one of them engages in hate speech. That is why universities in the South don’t have university sanctioned white supremacist groups despite their being many who wouldn’t hesitate to join among their student populations. So even if Sunny wanted to make this about the constitution, she would hit a brick wall when reminded of the fact the Supreme Court allows the government to impose guidelines and restrictions to universities who accept federal funds. She needs to read Title VI which says “No person in the United States shall, on the ground of race, color, or national origin, be excluded from participation in, be denied the benefits of, or be subjected to discrimination under any program or activity receiving Federal financial assistance.”

As a German, I need to explain a few things: first of all, there are daily protests against the actions of the Israely government in Gaza in many German cities, protected by german police, they are not forbidden. That's a myth, please inform yourself better. Videos of these protest can be found easily on RUclips or Instagram, for example. What is outlawed in Germany, everywhere and at these protests, is hatespeech. Against jews, against muslims, against people pf color, against LGBTQ, against minorities in general. People who would say in Germany what Harvard students have publicly said would be arrested and would find themselves swiftly in front of a judge. And rightfully so. Germany has learned, from its history, that voilence starts with language, and that threats, hate and hateful speech, lead to worse things. Which is why that language, verbalized or in symbolic form like swastikas, is a crime in Germany. That might not be the American way, but it is one of the reasons, that many young Israelis, who don't like their Trumpian government, move to Berlin, not Washington.

There are PLENTY of behaviors that are perfectly legal but not permitted on a college campus. If schools only enforced policies according to the law; every time a student got expelled, they would get arrested.

Except that's not what Alyssa said. It's how Sunny (wrongly) interpreted Alyssa's argument. Alyssa is completely right when it comes to the University Codes of Conduct. Expelling or taking disciplinary action against a student who calls on genocide on campus does not violate the First Amendment because the First Amendment puts limits on the ability of the government to limit speech, not on businesses or other institutions. Alyssa never asked the colleges to go against the constitution.

Research grants, financial aid, etc. And it’s not the threat of having their funding pulled that they’re afraid of. It’s the threat of being sued by students who faced discipline for exercising protected speech. Also, the Harvard administrators didn’t say they wouldn’t take action. They said that action would be taken depending on the context and if the speech became actionable conduct. If and when any student threatens or intimidates Jewish students, they should rightfully expect to be disciplined. But free speech demands that we don’t discipline people for simply stating political opinions that we don’t agree with.

The congresswoman didn't ask what the law is. She asked what each university's anti-bullying policy is. Highlighting the possibility of an antisemitic double standard, just a couple of years ago Harvard withdrew admission of ten students over 'racist' or 'offensive' social media posts (evidence that Harvard students are removed for exercising free speech). Harvard policy makes punishable "unwelcome and offensive conduct that is based on an individual or group’s protected status. Discriminatory harassment may be considered to violate this policy when it is so severe or pervasive, and objectively offensive, that it creates a work, educational, or living environment that a reasonable person would consider intimidating, hostile, or abusive..."
Sunny is dead wrong, a University like ANY entity can have rules that limit, if you were to say something like that a private company they would fire you and the LAW allows that, that was Alyssa's point, you have the FREEDOM OF SPEECH SO THE GOVERNMENT cannot infringe, a University IS NOT the government

I think Sunny explained the law very well. If someone uses hate speech publicly it's technically protected. (Granted that person may be "canceled" by the public, but cancellation isnt a legal indictment). However, if someone uses that same hate speech in a one on one interaction it can definitely have legal consequences and be considered harassment. I'm not saying its right or wrong but that is the law. Maybe the law should be changed but Sunny was simply explaining the law.
Universities has expelled students in the past for hate speech.
Remember the whole SAE scandal....That whole fraternity got closed and students got expelled.

I can't believe Alyssa goes to "they should all be fired (referring to the University presidents)" Alyssa has two amazing jobs and with out hesitation wants people that are on opposing views to loose their jobs...she said very similar towards the Squad (from Congress).
Sunny is dead wrong. A private school’s code of conduct can indeed prohibit more speech than the first amendment would permit to be prohibited. We’re talking about Harvard, UPenn and MIT.

No Sunny, this is not about the law. This is about Harvard's code of conduct. What these people in the hearing made clare is that genocidal language against jews is allowed. Even though any pushback against lbgtq, slightly racist language or conduct would get faculty members fired and students expelled. Sunny os being condescending and willfully ignorant about the subject at hand.
The U.S. Constitution is the Supreme Law of the land. All American universities (whether public or private), companies, etc. have to adhere to the SUPREME LAW OF THE LAND when it comes to the Bill of Rights/Constitution. Harvard can't say "oh well we're going to ignore federal law on a federal matter and do what we want!" Hate speech is protected speech in the U.S., but hate CRIMES are punishable.
@thislovemusic when 2 parties enter into a contract, e.g. a faculty member at a school or general employer-employee, they can stipulate a code of conduct and penalties derived if either parties break the agreed upon rules. This is the basis of all contracts. Yes, a contract can not deprive a person of their basic rights, generally speaking, but the parties have agreed on a set of rules of conduct that they can enforce when one party has broken the rules. This is perfectly legal.
So back to the question at hand: hate speech is protected speech. But 2 private parties can agree upon breaking their contract if one of them engages in hate speech. This is not a new, or novel concept. 🙄

@@otnielbelfor528 you are conflating contract law with constitutional law, which to reiterate, is the supreme law of the land. Whatever agreements are made under a contract entered into by two consenting parties (btw insinuating that admission to a uni is a contract is questionable) must adgere to the Bill of Rights/Amendments of the U.S. Constitution. Are you American? I'm confused as to why you aren't able to grasp this very simple concept about our country's laws.
