They probably can't legally do it but if I was the cops I'd just tell the guy the pepper spray should wear off in an hour and it's not doing any physical damage to you so you just have to suffer through it. It works in the form of its mostly water and it washes it out similar to water but not as good. His results were water is better and don't use milk to wash out pepper spray. Google also says milk or antacid doesn't work.
