I disagree with u. Despite the fact the guy is stupid, he can change. If both love themselves, good advice can change the guy’s character.
We should stop advocating for divorce all the time. Sometimes devil uses this way to break a marriage that will yield good fruits.
There are challenges in marriage, and sometimes , at a point in time, with good advice, one’s senses may come back.
It’s obvious the guy wasn’t like that initially.
I pray they both find peace and live peacefully as family.

@@stephaniei.3424 She is a judge and not sadly because she has no power under the law to force a woman who has approached the court to save her marriage to dissolve it. The law in Nigeria requires the judge to first try and reconcile a couple before granting a divorce. If its a statutory marriage they must have lived apart for minimum of two years before approaching the court for divorce and despite that, the chief registrar of the court must still file an affidavit disclosing that he has tried to reconcile the couple again before filing for divorce. This judge condemned the husband's act of beating the wife and advised him over the children of the marriage not to grow up believing its right to beat a wife. She recommended anger management classes and marriage counseling. The wife did not move out of the house after the incident and Judge Funmi can not force her to abandon her marriage. I personally believe she ought to have moved out if she actually want to divorce her husband and then approach the court. There is a procedure for granting divorce in Nigeria and Judge Funmi is in compliance. This is not western world, Nigeria has her own law. Unlike the western world it's the wife that will pack out of the matrimonial home in Nigeria if the house does not belong to her. The judge is acting within the province of the law.. Under penal code which is applicable in the Northern part of the country a husband is permitted under sharia law to met out corrective beating on the wife as long as it does not cause grievous harm, I made reference to this not because I support this law which I believe should be abolished but as at today December 2020, its an applicable, valid law at the Northern part of Nigeria. If you see a Judge applying that law you may think the judge is incompetent but that judge will merely be applying the law as it is. Its good to understand the law and know why judges hands are tied at times by the law. I have watched several of her cases on line and I believe she knows her onion. The laws of Nigeria is different and distinct from western world our culture is different, we have traditional marriage which is recognized by law and can be polygamous. The law of Lagos state now recognises baby mama too

I don’t support the direction this conversation is going. Why is the judge questioning why she wants to leave? Put the beating to the side, imagine having 3 kids and a husband that doesn’t work for over 7yrs!!! And he has the audacity to get drunk, with her money!!! She hasn’t left because she is stuck not because of any stupid love. Love has nothing to do with this! She has no respect for him at this point so forcing her to stay is ridiculous! I’m outraged! The better advise was to kick him out of the house so he has time to reflect on the streets and prove himself worthy. A separation so she can breathe easy. Scared in her own house!!! No consequence to him at all! I’m disappointed! Marriage isn’t the end all. 7years!!!! Judge, sorry but that wasn’t the right advise.

I expect a serious undertaking that list consequences for repeat offense. "Am sorry", is not the answer to this madness. Most couple are only upset because of current situation but love still exists, and to call you to an attention she can't just dissolve a marriage if both parties are not ready. She refers many marriage for counseling which is a very smart move. The country need lots of awareness, abuse ( physical and emotional) happen is many homes across Nigeria and before a iron fist is place on the matter, a need for awareness and trainings are needed. Please do not conclude just on one case, our society is not ready for many broken homes. Broken home will cause lot of hudlums, irresponsible children that will make irresponsible adult which will result in irresponsible country.

@@lawalbada3798 i agree with you to some extent; our society sure needs alot of education on the matter. i get when she didnt want to dissolve marriages because there's still love involved but love is not enough. If love is enough they wont be in court in the first place. Now marriage counselling is of absolute important way before marriage and of course marriage course in marriage to make it not only to work out but to make it beautiful. what I dont agree is that there no broken marriages; there are more broken marriages in our society than we are letting on. It takes two to tango in marriage, if there is a deadbeat husband or wife in one, its not what you can call marriage as there are many wives in Nigeria who are the only ones in their marriage with the husbands who are not physically or emotionally available. The women are living as single mothers in real life but to the world they are married. Their children suffer and we probably have more hoodlums than we care to admit. Dont get me wrong divorce is terrible and should be done when the marriage cant be salvaged but in my opinion its better that they live as singles whether in separation or divorce than to live a life of mystery. What i believe the country should put in place is to empower these women or men alike to look after themselves and their children, legalising child support, education on domestic violence, invest more on marriage counselors and counselings.

Our country and tradition had long silence our ladies/mothers and had not paid attention they deserve to thier pains and it frustrates me. In developed nations, judges don't just dissolve marriage at first appearance, they give opportunity for counseling and change. With love everything is possible. Am not saying that am perfect, at some point in my life I had to seek marriage counseling and it helped. The judge is doing the right thing by given the couple chance to redeem or save their marriage as it is done in developed nations. If the abuse continue, the abuser can be referred to criminal court for prosecution. Please do not misquote me, I do not support abuse in any form and I condemn anyone who abuse thier spouse. Also I don't know the judge or have any connection with her, am just a fan who love this development and like to support the program.

I bet you are not Married. Go and check most women that go to court to seek divorce are no longer leaving with the man, they must have moved out of the man's house. Any woman that is in court with a man she is leaving with is actually seeking reconciliation not divorce, the Judge could read in between the lines. She is very smart and recommended marriage counselling.

@@patiencebello5552 I beg to differ. Some people feel stuck in their marriages and only stay because they feel they don’t have any choice. She is applying the law as it is in Nigeria, divorce is not automatic here. It has a procedure and that's why divorce cases linger in our courts. The judge must first of all try to reconcile the couple before taking further steps besides the plaintiff sought the relief that its assurance that he won't beat her again she wanted and the judge said he would sign an undertaking. This is not final she is an adult that can always approach the court again but the judge has complied with the first step to be taking in divorce proceedings

It’s sooo frustrating because she keeps mentioning the woman loves her husband and is willing to stay for love. Most battered women go back to their perpetuators for many reasons including no place to go, afraid, low self worth and esteem, conditioned to feel that they aren’t good enough and no one else will want them and are addicted to the toxic nature of the relationship and very little to do with love. Usually, the issue only gets worse and leads to death. This judge needs to be EDUCATED AND FAST. But then again, it brings awareness to the culture and tradition of Nigerians in terms of marriage.

I know what it means for you to grow up with your parents apart. On the other hand, being jobless for 7 years doesn't mean he has not tried in between. He might have taken up jobs not worth it at the end of the day. I am not justifying beating up his wife to the extent of tearing up her ear lobe. Some ladies are not good psychologist naturally. I'm sure if he was a drunkard from the scratch , she couldn't have married him. The guy is drinking out of frustration. U can imagine what a jobless man can be drinking ( paraga ). That his drunkenness should be addressed. Look at how he is looking fresh & the woman is looking worn-out. Where does he get all the money for his drunkenness. Even if you don't have work, there are other ways to help your wife like doing chores, being with the children when the woman is at her business. Wives are so disadvantaged in Nigeria. How can only one person carry all the responsibilities while the other partner is busy getting himself drunk. The woman just doesn't know how to express herself.

Again this is one of those days I will say, The judge has not done a good job, if you want to be a judge, be a judge and stop pulling in facts based on your own intution, believes or sentiments influenced by a clearly patriarchal society. I am a man, but what is wrong is wrong.
Even the judge acknowledges she has issues with raising his hands on her, which I appreciate her acknowledgment of that, but I am still confused on why she still decides to go on a frolic of her own. What happen to talking about his drinking issues, not providing for the family?
The lady clearly said when he goes out, and comes back he will start beating me.
Judge: ofcourse I am trying to imagining you just sitting down and somebody comes in and starts beating you.
And then she goes on and on recommending, in the morning you talk to him when is eyes are clear (His eyes were not clear, but he knows well enough not to run into an oncoming vehicle and get hit? His eyes were not clear, but he knows well enough not fight somebody who can obviously beat him up at the bar? His eyes were not clear, but his eyes were clear to start beating his wife?), which is obviously a good idea. But before getting to that conclusion, I will expect her to ask her if she has tried that and if it worked or not , instead of just going on and assuming more facts upon facts and end up painting the victim with a guilt brush.
Another one, the lady talks about how she's being pitching in on the house rent, and the judge goes on to say "not to tell lies to justify it". I have seen some other episodes which she has done EXCELLENT JOB of asking people for receipts or bank statements to prove facts. What suddenly happened to that same line of thoughts here? She goes further to say "I know you must have seen him as a responsible man and somebody that was living up to expectation of what you wanted in a man……before you married him". Your honor, I am sorry to say, no you don't know. This is a mere assumption. People marry for different reasons: could have been for money, love, age (the lady might feel she's getting old), pressure from family or even she might have been bequeathed to this dude. This is Nigeria. That is not a fair or valid conclusion.
There is a lot of making this woman seem like the bad one here or the one who is not doing something right, for lack of words. It is this woman who is being beaten, it is this woman, who is having to be reasonable for 2 people's issues and bills and then she is the one that gets the " are you saying you are not ready to struggle with any man?" The issue here is not struggling with a man, she is already doing that - taking care of the kids, doing the bills etc. The issue here is this woman is carrying all the weight and yet still get beaten, that is the issue. This is somebody's daughter. How do you beat someone so bad and pull earrings off her ears till you tear off her earlobe?
That right there is an indication that this guy could have even done worse, like blind this lady. Then the judge goes in a soft tone and say - "you shouldn't have done that". We should be asking this lady if she wants the police to arrest this dude here and the state should try him for assault (maybe not for real, but at least as a threat to let this dude understand the gravity of his actions), instead of the "hand smacking" - "you shouldn't have done that".
The poor lady is naïve and simply wants out, even though I advocate for married folks to try to resolve issues in marriage if they can (which is what the Nigeria Family law strives for as well), but I always say, once domestic violence comes into the picture, people, the life and safety of the victim should be the next thing we need to start talking about and not excuses or 'defense of drunkenness'. What happens if dude gets home later that night gets drunk again and kills this poor lady while beating her? Yes, the guy will sure get punished under the law, but guess what has happened to a nation? We've lost a potential solution to a problem in the world. We've 3 kids who are going to have to grow up without a mother and a father (most likely, because his stupid ass will be in jail) and now we have more kids who have a potential of causing the nation more problem down the line - simple "principle of ripple effect"
Even though your honor ended up with an recommendation, not an award, your honor should have taken a step further to check with both party if that is fine by them, especially since this was not in the parties pleadings.
Overall, this arbitration or reconciliation proceeding (whatever, you like you call it) was tainted with a lot of facts manufacturing on the side of your honor, assumptions, your honor going on a frolic of discovery of her own and relegation of the victim to the villian here.
I had to come back to update my comment with this paragraph based on 2 items I ran into today. In this episode the judge talks about handing someone over to the police for being dubious - ruclips.net/video/_FxyRoL2-j8/видео.html (Not beating a woman oo, being dubious), and contrast it this news ruclips.net/video/txwWt05C3cs/видео.html maybe this will help add more context to to my above lines. In Arise News, I love Adesua's and Rufai's train of thoughts here, which is what I said earlier in my comments, we should be talking about how to get this guy arrested and prosecuted if possible.

@@Quinnet2813 The judge did not condone the man's act, the judge even said if she want divorce she would be out the house after the ear incident which I agree with. This woman want solution to her marriage because she want the beating to stop. The judge did not ask her not to pack out. In fact the judge can not do that at this stage because she must first try to reconcile the couple before granting divorce, this is just the first step. Do we throw away the baby and the water, the woman is an adult and surely knows the way to the police station before opting to come to the court. She knows what she want, a mother of three children. @Ms. M. The Show needs to be subtitled so many people will understand the communication better. You misconstrued the Judge's counsel to the lady. I hope you will remember the Judge saying "the state of drunkenness is as good as the state of Insanity". That lady mentioned that her husband beats her when he is drunk and the judge advised that she should hold her conversation with him whenever he is drunk till when he is sober, because her conversation with him in drunken state is what typically provoked him to beat her. The lady saw wisdom in that counsel. She also mentioned that she had planned to divorce but she will like to stay in her marriage if the court can intervene to make him stop the beating to which the Judge made the man sign undertaking. I will advice you watch the episode again.

The judge did not justify the beating but condemned it . The woman agreed she provokes the husband when drunk and the judge advised that at the man's state of drunkenness is a state of insanity and it's not the best to provoke an insane man , that is the summary. As a judge the law in Nigeria does not permit her to automatically dissolve a marriage, she must first try to reconcile them which is the first thing she does in all the matrimonial disputes before her but ignorance of our law is making people to condemn her actions. Besides, as the judge said after the man injured her she would have moved out the matrimonial home and then seek for divorce
