    The Constitution states that there must be a fact or an evidence of a crime, not a suspicion of a crime the word suspicion is not anywhere in the Constitution. If all they needed was suspicion we wouldn't even have a fourth amendment. Lol

    • @leroirobinson-grant5885
      @leroirobinson-grant5885  6 лет назад +7

      Trevor Thrasher you forgot fact. To be stopped takes fact, not assumption. Suspicion is not fact it is opinion, statutory law system. The Statutory system is contradictory to law as it is to negate the constitution and judicial decisions by definition. That makes it color of law and a felony. A simple reading of any legal/law dictionary and case law makes this clear and undeniable.

      Archas1000 bruh it's probable cause

    • @Archas1000
      @Archas1000 6 лет назад +2

      @@true1stresponderthe fourth amendment makes it obsolete, it says no unreasonable searches or seizures, and suspicion can be unreasonable,so therefore your supreme Court case is certainly obsolete, because of the supreme law of the land, the word reasonable is not in the Constitution, there is only the word unreasonable and anytime police seize or search without a fact or an evidence of a crime that would make it unreasonable. A reason must have the fact or the evidence of a crime or it is considered unreasonable. probable cause is concrete evidence of a crime for the most part. You cannot be stopping people and herassing people all day because you think they look suspicious that's rediculous, the Constitution was created to put governments back against the wall not the people's backs. If probable cause was just suspicion then police will just make up whatever they want, but being so that probable cause is a fact or an evidence of a crime that makes it so they have to prove you guilty, with evidence and facts, so your supreme Court case lied about probable cause because people like me were not there defending the Constitution with logic and common sense and the obvious. This is not rocket science it's pretty simple to figure out and it's an insult to the American people and their intelligence for the courts to claim that all police need is suspicion..if all police need is suspicion to conduct a seizure or a search then you might as well throw the fourth amendment away because it's not protecting anyone other than whoever government chooses to protect. Anyways you have to have a cause to have a reason and a reason is the fact or the evidence of a crime, and that's the fact of the matter. What they are doing to the people now is just tyrannical and unconstitional. In order to have probable cause, you need probability and you need cause and suspicion lacks both.

      It's probably not a lie or they wouldn't have come to the gym. The issue is that for too many people "black" = "suspicious", and then when there is nothing truly suspicious they keep fishing. More to your point, cops will say anything. They either don't know the law or just care and just lie to get what they want (like your ID).

      Ummm... No, it doesn’t. You can be investigated in suspicion of committing a crime, and you can also be investigating to see if you’re committing a crime. Look up the definition of “Investigation”. You people have no knowledge. You just hear things from other internet colleagues. As you can see, they ran his information at the end of this video and he was already breaking law and ended up in more trouble. ☠️☠️ The dude took an L and did all that talking.

      @@GodIsCallingUs__ you're genuinely a moron lmao. the police being told there's suspicious activity means jackshit to the person involved if they cannot identify a crime being committed or having been committed when they come onto the scene. they could've said anything and they didn't because there wasn't a crime. they could've arrested him for interfering with an investigation by not giving them an id, which they didn't because they couldn't. like please use your goddamn brain before trying to say others are dumber than you.
      according to the msba police can ask for identification if they have reasonable suspicion that a crime was committed or was being committed. the fact that they could not answer what the crime being investigated was, is enough to tell you that they have no grounds to ask for id. they knew his name because he was signed into the gym, a gym that needs fingerprint scan to enter. all they could say at the end was that his license came back suspended which is irrelevant because they cannot arrest him for having a suspended license without him being in a fucking car driving or having driven a car to the gym lmao. that's why they left him. yes, it might be difficult for the cops to have someone refuse to give up identification, but that is within their rights as a free citizen.
