Why Child Support is F*cked Up

  • With the pathetic outcome from the Family Law Inquiry, Australia's child support scheme is about as f*cked up as ever. So what went wrong?
We explain how the Joint Committee messed up through a combination of stupidity and bad advice from the Child Support Agency and academia.
The politicians on the Committee might actually believe they're helping kids and parents by sticking to the same old formula. They couldn't be more wrong.
Senator Pauline Hanson was the only committee member who could see major problems and wanted to take real action. Sadly, she was outnumbered.
The committee seemed oblivious to the many problems caused by the child support formula, including the fraud and rorting that happens routinely.
As promised in the video, here's a link to comments from parents about the dodgy things they've experienced concerning their ex's:

Imagine if family court and custody arrangements were worked out by accountants who simply looked at maximising both the income and care with an actual parent between both parents… but that would only work for the children, not the parents… god forbid!

Absolutely devastated. I have 50/50 care and pay 100% of the support pool and yet again have worked/studied hard, earnt more now give the other parent a free pay rise. Morally disgusting and corrupt! Seems that senator Hansen is the only one in the committee with a spine!!!!
How does one get involved to push again for change. I firmly believe 50/50 care should equal no child support. I have another 12 years of support payments ahead of me, and the thought of handling over $250K (or more) makes me sick to my soul. My kids would be far better off if I could control the money I have worked hard for.
The system is cruel to hard working mothers and fathers that love their children... and protects lazy parents.

I pay 1.8k monthly for my daughter, but what's painful is, she used to spend 2 nights per week with me and I didn't have to travel 200km for a day just to see her for a few hours and spend time with her, BUT NOW, my ex found a way to convince my daughter to not spend 2 nights with me by telling her that her friends and other relatives will miss her dearly and she won't have time to spend with her friends during the weekend, and this is my ex way of bending the rule for herself by getting 100% care and get the chunk of payment from me. It's sad and frustrating for me, because I travel the long distance, pay petrol, spend at least $100 on food and snacks for a few hours of time with my daughter every weekend, and then at the end of the day the sense of emptiness engulps me while travelling back home to my 4x6 meter rental room, while my ex now has her own 2-bedroom property and employed full time with salary close to mine, and yet I pay, I spend, feel empty for the time I didn't have with my daughter. I also don't sleep much, like just 5 hours a night due to work stress, and i'm only working here in Aus just to be with my daughter, I feel like it's taking its toll on my mental well-being.
CSA is unfair, so unfair. Child services minister or whoever came up with this ridiculous formula and never did any studies about the different scenarios is so dim-witted.

I’m a working woman with zero children and child support has ruined my life. I’m not even the “victim”, but that’s how much child support affects the payers families. Children, new partners, everyone.
I’ve been both the child involved in child support and the partner of people who paid it. Never helped my parents separation, never was any use to me as a kid, has massively hurt me as an adult and my family. Never had a kid and never been on welfare, I’m a worker. And it’s ruined my life.
Hope that says something. I can’t imagine what the single parents paying it and being alienated are going through because they are the real victims above me.
      CS doesn’t support families.

I happy to support my kids financially, but when your in debt, earn $813 after tax, have to pay rent, food and petrol for the week your left with jack crap all and yet your told doesn’t matter your income is higher. Yet here she is just built a million house, brand new car and living the life and still use the kids to cut my time off! Going from every weekend and any other day she didn’t want them, due to her party ways and now she wants to come back in and play happy family with her new partner. The system is absolutely disgusting and no one cares about the kids nor the father genuinely loving his kids and wanting to be a part of their lives! This gives the mother the upper hand to play god with our kids. Mine you I have an interim order in place and after three weeks of it being in effect, she drops a bomb she’ll telling me I’m relocating and take the girls…and you know she probably will been given the all clear because it’s all about the mother and I can say these solicitors are vultures and want only money…they bleed you dry and still want the crust!
I ain’t giving up on fighting for the rights of my kids and I will not let this disgusting, corrupt system we so called the law! Who would ever think we would have kids to be told by someone else, what time we are allowed to spend with them, what we can do with them. We wonder why fathers walk away or worst kill themselves. It should be equal shared care, unless there is abuse ect then no! But these mothers need to wake up and realise it ain’t hurting noone more but the kids! Only a bitter, angry, spiteful and disgusting person with no compassion would go to any level to destroy the father of her kids and I’m speaking for all gender here too!

My son recently turned 18 and I started a new job with higher income so I thought it was a good time do my tax for last few years and catch up. I new there would be a year were my income was estimated 30% lower than it should have been. My ex-wife denied me custody from my sons 16th birthday and was making 150k+ and I was still paying $450 a month.
Well I was told last month I owe around $10,000. I was surprised but figured OK I can afford $500 month and get it sorted but no CSA want $1400 a month. This is the minimum they want and I am currently attempting to apply for hardship witch was denied on first attempt. I am no in hardship but if I have to pay $1400 a month I will be. Also create a social media account that and don't add anyone that knows her and we're on her side after the breakup because they will tell her and she will contact the csa and depending on which country you move to they could still recover that money from your wages and taxes etc. You need to research which countries child support systems help Australia's with recovering child support and avoid those countries...

My ex has the choice to work more hours or less yet I can only choose to continue to work full time or have it deemed I have the capacity to earn more if I only work part time and continue to pay at the higher rate. Our children are of school age so there's no reason for her not to work other than she doesn't want to. She has lots of choice and full control over her life and I have no choice or control of my finances whatsoever.

I feel your pain gentleman. It happens to both Mums and Dads and it’s just heart-wrenching. 😥I have been alienated from my daughter for over 12 months now, because my ex-husband is very aware of the amount I would pay him if he has 100% care. I pay him $1000/mth for my child I miss desperately, but am not able to see at all. What’s more unfair is that he has over 2 million in assets, and I can not even afford to save a deposit for my own home.
In the USA, they are starting to introduce laws where parents who alienate a child/children from the paying parent, can stop receiving child support until the situation is resolved. Why should they be rewarded for their appalling actions?
A system that supports and enables parental alienation is a very unjust and broken system.
How can this be in the interest of the children, when PA is actually child abuse, and the paying parent pays in so many bloody ways?! 🤬🤬

Yeah, same with me, see my reply to Russ Thomo. I wanted to be with my daughter like before where she stays with me for at least 2 nights, I'm okay with what I'm paying as long as she stays with me and I spend quality time with her, but to be travelling 200kms just to see her, then pay the amount I'm paying and also spend $400 monthly on food eating out whenever we go out every week, is somewhat too much for me, the formula that CSA gave me to pay $1200 now and around $1500 to $1800 next year is absurd, because I think in their mind they want to PUNISH the paying parent for 'leaving' the child and carer, without taking into consideration the full story of each parent. My ex has her shiny 2-bedroom unit in a every expensive suburb, while I'm renting a 4x6m room to save money for a house I want to buy for my daughter as well, and afford to pay the child support amount at the same time. So here's me, working my a$$ off, stressed at work night sleeping most nights, trying to work as hard so I can save for a house for my daughter, and yet I have to pay this ridiculous CS payment as well. I'm so stressed that I feel i won't live long to see that happen. CSA is just disgusting!

I could stomach it if the money wasn’t going towards cigarettes tattoos and clothes for herself while the kids have school uniforms with holes in them. I love my daughter. I used to spend 2 nights with her every weekend. But My ex found a way to convince her not to do that anymore and instead just spend , at the most, 1 night with me, making the formula work for my ex since she'll be getting 100% custody in payment calculation. It worked for her, now if I want to see my daughter I will have to travel 200kms, spend $100 just to eat out, and then travel back feeling the emptiness, both with emotion and wallet, because every month I will have to pay CSA $1800, while my ex just bought an expensive 2-bedroom unit priced almost half a million, while she also has a thriving career and a great salary. So at the end of it all, not only did I lose my quality time with my child, but it's also like paying dearly financially for losing that time, it's a double whammy.

    1) No one I mean no one should be obligated to give their earned money to anyone else to decide how to spend toward their own children. I earned it I decided how to spend.
    2) Noone should be penalised even further to try and earn more money to support itself and their children.
    3) It is mind blowing that additional payment directly link to the kids benefits like extra curricular activities are not credit in any shape or form unless receiver is approved.

The formula also forgets that if a non-working parent is in housing, their rent stays 25%. Working parents have higher housing expenses to live in the same quality of house or less.

    Can you investigate
if the receiving parent of chid support has to include their chid support income they received in their tax return ? and pay another tax to that too when their ex husband or partner has already paid the tax to that money he’s given as child support
Double charging tax would be so wrongful making money from the money given to kids by a parent who’s already paid tax to these money

Women and men should choose carefully and really take into count their vows and not run when things get tough. Social Services Legislation Amendment (Child Support Measures) Bill 2023
    Seeking
    further
    information
    pp. 16-25
    Departure authorisation certificates
    Right to freedom of movement
This bill would expand the circumstances in which a child support debtor who is
subject to a departure prohibition order (restricting them from leaving Australia)
may be refused a departure authorisation certificate (which would allow them to
leave Australia for a foreign country). It would provide that a certificate cannot be
issued solely where a person has given a security for their return (as the law
currently provides). The bill would require that a person must have given a security
for their return and have satisfied the Child Support Registrar that they will wholly
or substantially discharge the outstanding child support or carer liability (or the debt
is irrecoverable or they will likely no longer have such a debt).
This limits the right to freedom of movement. The Minister for Social Services
provided the committee with information in relation to the compatibility of the
measure with this right. However, the committee considers that further
information is required to fully assess the compatibility of the measure, and is
seeking further information from the minister.

I have worked hard to increase my income over the years, to support my family - unfortunately it didn't work out with my ex-wife and in the end we have agreed to a 42/58 split of custody. I would prefer 50/50, but in order for me to earn more money to pay for the mounting bills, mortgage rate increases and cost of living pressure I have had to forgo extra time to spend with my child. Our income asssessments have come in for FY22-23 and she took 3-4 months off work, penalizing me. My CS payment increase now takes 40% of my extra income, leaving me worse off for earning more money.
We have an amicable agreement regarding our child, but it just isn't right that I have to give away so much of my income because someone isn't motiviated to work more and earn more money - there should be a payable amount calculated based on care percentage, it rely so much on income alone because it's clear where both parents interests lye at the moment.

The whole movement for the equal opportunity and gender diversity in the workplace these days is unbelievably huge and these people who say that women do not have the capability or capacity to earn good money is going against everything they have fought for and still fight for. Child support amount usually can not even cover rent in Sydney if you live in good areas unless you have free housing, shared or live at west. And your FTB also decreases when you’re receiving child support so it’s really not that much money to raise a child it’s simply not enough. Grocery, snacks, shopping, furnitures, hair cuts, eating out, clothes, shoes, entertainment, holidays, classes, childcare, toys.... child support is a drop in the ocean, it’s not enough! It’s only %12 of your income. How does that make the paying parent broke I don’t get it

I think it is appalling that fathers deny their children financially by dodging child support....the money is for the kids. Where there is domestic violence in those cases it is not safe for children to be continuously abused. These children suffer the most with financial abuse still occurring well after separation.

Men here’s a simple solution…….. if you DO NOT SEE Or have any access at all to your children due to parental alienation or unfair parenting conditions or rights simply REFUSE to Pay Child Support.
If you see your child or children and it’s 50/50 then support should be fair on both parents halves! Because it takes both parents to raise and support a child or children
    3. The other thing is as Men who don’t see our children demand that we are to see where the money that we provide goes. Otherwise refuse to give money to the opposing parent and place the so called support money into your childrens bank account!
Child support will be happy to assist and allow this but both parents have to agree on this and must be signed off on,
I haven’t seen my child for eight months now and it’s NOT that I haven’t wanted to or that I chose to not see her it’s simply because i was pushed out of her life under Full Family Law Court Orders, so you tell me why I should support the opposing parent for pushing me out of my child’s life on her punishing grounds.
There’s just some tips Child support if you read this I’m all for supporting the child or children but let’s be realistic here it cost men and fathers money also when we have our kids in our homes too. So let’s consider that we too need to survive on what we need to. Children need both parents and not just one! We need to understand that Men and Dads love their kids too!

If you refuse to pay they can still get to you. BUT, it costs them time and money and for every dollar they steal, it costs them time and money. It slows everything down and the bureaucracy becomes very bloated. Now if all men who absolutely despise this system, as I do, stood together instead of buckling to the corrupt whims of communist Australia, we might just put enough pressure on the system to break it. Yes they can get at 1 man maybe 10. But al of us? At the same time. Imagine the pressure. Think Vietnam war stop works and the trucker rally in Canada.

@@DanWallis86 I think it wouldn’t be needed if fathers took more responsibility and care. It’s capped a $2500 a month regardless of how much you earn. Don’t avoid doing tax returns and complain when you have a massive debt and can’t leave the country.
A high income mother that doesn’t have custody will pay the same child support as a father would in the same position. It not bias to gender. Men and some women can earn more when they don’t have the responsibility of looking after children/child daily or don’t have to pay for childcare. If you choose to only see your children four times a month you should pay child support.
