Section 175 BNSS:
Police Officer's power to investigate cognizable case. (1) Any officer in charge of a police station may, without the order of a Magistrate, investigate any cognizable case which a Court having jurisdiction over the local area within the limits of such station would have power to inquire into or try under the provisions of Chapter XIV:
Provided that considering the nature and gravity of the offence, the Superintendent of Police may require the Deputy Superintendent of Police to investigate the case.
(2) No proceeding of a police officer in any such case shall at any stage be called in question on the ground that the case was one which such officer was not empowered under this section to investigate.
(3) Any Magistrate empowered under section 210 may, after considering the application supported by an affidavit made under sub-section (4) of section 173, and after making such inquiry as he thinks necessary and submission made in this regard by the police officer, order such an investigation as above-mentioned.
(4) Any Magistrate empowered under section 210, may, upon receiving a complaint against a public servant arising in course of the discharge of his official duties, order investigation, subject to-
(a) receiving a report containing facts and circumstances of the incident from the officer superior to him; and
(b) after consideration of the assertions made by the public servant as to the situation that led to the incident so alleged.
Changes:
1. In sub-section 1 of section 175, one proviso has been added which is as under-
Provided that considering the nature and gravity of the offence, the Superintendent of Police may require the Deputy Superintendent of police to investigate the case.
#No change in sub section 2 of 175 CrPC.
Change 2:
In sub section 3 the following bold and italic words are newly added and other are borrowed from CrPC.
(3) Any Magistrate empowered under section 210 may, after considering the application supported by an affidavit made under sub-section (4) of section 173, and after making such inquiry as he thinks necessary and submission made in this regard by the police officer, order such an investigation as above-mentioned.
Change no. 3:
subsection (4) in section 175 BNSS has newly been added. It was not in old law CrPC. The same is as under-
(4) Any Magistrate empowered under section 210, may, upon receiving a compliant against a public servant arising in course of the discharge of his official duties, order investigation, subject to-
(a) receiving a report containing facts and circumstances of the incident from the officer superior to him; and
(b) after consideration of the assertions made by the public servant as to the situation that led to the incident so alleged.

Section 175 (4) ab police ko kisi darr nhi, kyunki department mostly apne officer ko bachane ki kosish karta hai.
As per law, Magistrate kewal opportunity dega aur uske senior ke report mangega. is ka matalab ye nahi hai ki magistrate FIR ke order karega hi nahi. Is provision ka police officer ko ek nukshan hoga ki yadi magistrate ne FIR ke order kar diye to is matter cancellation karna bahut mushkil padega.

Agar SHO permission na de FIR register karne ki aur sulah karade jabardasti jo ek party nai chahti ho toh
Agar information se cognizable offence banta hai to SHO bound hai FIR karne ke liye. SHO ko sulah karane ki power nahi hai, agar jabardasti sulah karaya gaya hai to vo galat hai aur aap thana se nikal kar ek letter by post SHO ko bheje ki aap ke sath kya hua tha aur jabardasti sulah karaya gaya. aur ek letter uske SP/DCP ko bhej den. Fir court me application laga de FIR ke order ke liye.
Aur Agar aap acused the aur aap sulah nahi karna chate the lekin fir bhi SHO ne jabardasti sulab karaya hai to aap court me complaint laga sakte hai extortion ki.

Kanoon to FIR ke liye koi permissuin ki bat nahi karta hai, 197 CrPC (now 218 BNSS) ki aavshyakta to cgnuzance ke tume par hiti hai.

Police quash nahi kar sakti hai. police ke pass quash ki power nahi hai but investigation ke bad police kah sakti hai ki koi offence nahi banta hai aur cloaure report court me submit kar sakti hai.

Court will see the report. Agar court ko lagta hai ki evidence sufficient hai to vo cognizane pekar accused ko summon karke bula sakti hai aur agar court ko lagta hai ki sach much me evidence nahi haniya offence nahi banta hai to court us closure report ko accept kar legi aur matter close ho jayega lekin matter ko close karne se pahle complainant ko ek opportunity jarur degi aur usse puchhe gi kya complainant kuchh kahna chahta hai. Aur tisra police ko order kar sakti hai ki further kuchh points par investigation ki jaye.
