  • Tune in as we break down a recent win for a disabled Veteran client at the U.S. Court of Appeals for Veterans Claims (CAVC)! Our VA disability attorneys represented a Veteran at the CAVC and Board of Veterans' Appeals (BVA) multiple times before our client finally won the VA benefits to which they were entitled, ultimately winning a claim based on "clear and unmistakable error" and securing 100% TDIU VA benefits.     Background Information- CUE Claims:
    A request for revision based on clear and unmistakable error (CUE) is a way to challenge a final decision from VA. A request for revision based on CUE is not a claim in and of itself. It is a procedural means for a veteran to attack a final VA decision and each request must meet very specific criteria in order to be successful. CUEs are filed with the Board of Veterans Appeals or the Regional Office, whichever made the decision which contained an error.
    Background Information- TDIU Claims:
    Total Disability based on Individual Unemployability is a benefit offered by the Department of Veterans Affairs that allows disabled veterans who are unable to work due to a service-connected disability(ies) to receive disability compensation equal to a 100 percent rating, even if their combined disability rating does not reach a schedular 100 percent.

    BRAVO, CC&K!! Multiple team members, multiple decades of up and down at the VIPEROUS AGGREVATORS (aka VA). Ignoring a Federal Court of Appeals ruling should put some of the VA claims obstructers in Federal Prison! A few months of making license plates, desks and pacing should improve their abilities in following the law! Well done! Thank you for the great report. Please wish the Veteran well, too.

      In November of 2023, the BVA issued a decision granting me TDIU. It's half way through May of 2024, and nothing. I have received nothing. Every time I call the VA, I get a different person and a different explanation as to why.

    Does this mean that backlogged cases that don’t have a case number gets one sooner?

    In November of 2023, the BVA issued a decision granting me TDIU. It's half way through May of 2024, and nothing. I have received nothing. Every time I call the VA, I get a different person and a different explanation as to why.

    Why does it seem that some peoples claims are always F by the VA no matter how many they submit and where as some others have no issues what so ever ?!

    I was misdiagnosed with spina bifida occulta and chronic back pain. I have been denied my disability benefits strictly due to spina bifida occulta. I have been going to pain management for 5-6 years and was diagnosed with bilateral radiculopothy. He saw my mri and radiology report and says I do not have spina bifida occulta. I recently saw a neurosurgeon who viewed my mri. He too agreed I do not have spina bifida occulta. He states this is something you are born with and it never heals or goes away. So for all these years I have been denied my benefits from an in service documented injury and my disability benefits. Do I have a leg to stand on and how far back can I collect benefits? I have board appeal pending.

    I been trying to get my BENEFITS for a very long time and VA Been lieing from day one they come up with something new each time the attack happen while in boot camp that's when I went to sick bay they cover the whole thing up even after four months in the hospital and a medical discharge they are still covering up they attack
