    I've been a cop for 10 years and deal with search and seizure daily. That is one of the most unlawful searches I've ever seen. They either needed consent from the homeowner, fresh pursuit or a signed search warrant from a judge to breach those gates. I'm in total disbelief about what I just saw. I've served hundreds of felony arrest warrants and not once have I entered someone's home without their consent. WOW!

      No problem! I have been turned away from so many houses while looking for people with "ARREST WARRANTS" I've lost counts. You sure do have a nice spread. I bet they pay for that gate once the US Attorney looks at this video.

      Billy Fowler Same here !! this is NOT the proper procedure to a ARREST WARRENT !! An Arrest Warrent does NOT give Law Enforcement permission to search or even ENTER private property unless they PHYSICALLY SEE the Offender on the property RIGHT BEFORE they enter the property !!!. I believe in Law Enforcement and Was a Deputy for 2 1/2 years before I had to quit because of all the Constitutional Laws that Law Enforcement breaks EVERYDAY !!!!!. Myself or my Father couldn't handle it !!!.

    Reminds me of the farmer who told the officer he couldnt go in the pasture, the officer flashed his badge and said "i can go anywhere". When the officer went in the pasture... He was chased out by a bull, the farmer says "flash that badge of yours.

    I'm a retired police officer with thirty plus years enforcing the law under my belt. A arrest warrant does not vacate your rights against an unlawful entry by law enforcement Unless: There has been "Credible" information that the fugitive is on or has been observed to be staying on your property. However, they may enter your property in hot pursuit of an individual or under "exigent" circumstances, i.e. they have compelling information that the fugitive is there at that time and that if they delay entry and wait to secure a warrant, the fugitive would be likely to escape capture. If they claim exigent circumstances existed which permitted them to forcibly enter your property, those "exigent circumstances" must be presented and proven in a court of law. Get a good lawyer who specializes in constitutional law and sue everyone involved. In my experience, what was done on your property was outside and beyond the scope of their authority and the the laws of the United States.

      It's called a Writ of assistance in Canada. When they act out on their own it only works to your advantage in a court of law.

      That’s right! The lead ~ officer~ said anyone can use any address and there is no recourse or liability to try and change it. Knowledge is good thing. Get their address and tell your son to change addresses he uses if warrants continue to bless him and you by default. Might have thought about that for the last warrant.

      First they had a arrests warrant. But they didn't have a search warrant as required by law.. suit the he'll out of them. This is illegal. A arrest warrant spent give them the right to come on your land. Unless they followed them in. In this case they was wrong

      By the marshals moronic logic the warrant (any type of warrant) may as well grant them the ability to search, steal, kidnap, and kill with impunity. In response each and every badge wearing thug here needs to get killed lawfully in self defense of innumerable felonies.       +amon craft Plain view...as in from a public setting, such as the street. Not sure how that applies to breaking down a front gate entering private property, enter a private dwelling, and other structures on private property to search inside. None of that really applies to "within plain view"
      There is a reason those with arrest warrants try to trick you to exit your property and come on to public property

    An arrest warrant is not a search warrant. A search warrant must accompany the arrest warrant for any of this to be legal.

    An arrest warrant does not constitute a search of a private domicile. Unless law enforcement has proof the name of the person on the warrant is in said domicile.

    Had one comment that made an excellent point, something over looked by most even myself, but something these pigs cant hide, take a look at the Dodge just outside my gates to the left, it has the hood open to block the dash cam. so the illegal entry is not recorded, so for all you copsuckers that think so highly of the blue. Ur Cops are the criminals. My honor for these pigs is no more, I have zero honor for anybody that use their job position to violate honest people.

    Watch the video and listen, the answers are in front of you.
    1) No I "Did Not" open my gates for these animals, 2) cops "Did Not" have a Search Warrant, 3) No I "Didn't give Consent" to enter my property 4) "No Arrest" made, for the 7th time, 5) I picked up this camcorder at the last moment, I did not once look into the screen to focus , I was only trying to capture the moment on video for the world to see and I have it, so if you may think I was drunk or nervous while shooting then ur wrong i wasn't , Don't think you quite understand until you have been in this situation. Blood pressure was all that was high at the time.

I was not opening those gates . I have nothing to hide , only something to protect.

    A warrant for his arrest does not give u the authority to damage property and violate these people rights and come on their property and search their home and premises with out a search warrant!!!!!
    These officers should loose their jobs and never be in lawinforcement ever again. They should get 5 yrs in prison and pay 200,000.00 fine a peice.

The founders obviously did not know about AK-47s, M-16s, etc. back *before those tools were invented, so of course they didn't specify.* Are you also saying "Freedom of the press" has its limitations around paper and ink, simply because TV cameras, Internet and other tools used by the media today was not invented back then?
      I'd make any $$$ bet that they'd include AK-47s and M-16s, or any other military-style rifle as "arms" in that 2nd Amendment if they could predict the future. The point wasn't what kind of tool, but that those tools are in the hands of citizens to protect their liberty and rights from criminal tyrants. That's it.

      When written (2nd Amendment) the intent is clear they wanted defense of each State protected by the citizens to fight against tyrannical government, foreign or domestic.
      Back then, the king was their "tyrannical federal government" actually, and they had to fight that tyrannical federal government to gain freedom.

Because they violated your Constitutional Rights, you can sue the Sheriffs office, the US Marshals department and each and every single one of them personally.       Dave Martin ** You are wrong. They need a statement or a witness (not an LEO) that the person is on that property to ASK the property owner if he is there. If said owner denies them entry onto the property, a search warrant detailing what they are searching for and where the signing judge says that they may search is REQUIRED. This is upheld by the US Constitution and SCOTUS.
      I don't know where you're getting your information from, but it is flawed.

      Reasonable suspicion is not sufficient for them to enter and search private property. They need probable cause, which is a higher standard.

      what i did a copy and paste of above is the law on entry without a warrant, reasonable belief is all they need for the purposes i copied above, exceptions are always evident in any law too allow for exceptional circumstances.

    As a fence company owner I would estimate they did between $1500 - $2500 damage just to fix your gates, to replace them much more.

    So......what ever happened? Did they pay for the gate? Did you take them to court? Usually the only time they can enter if they are on "hot pursuit" or a search warrant. An arrest warrant is not a hot pursuit. It would be preposterous to assume they can bust in on every place one has been known to frequent.

    First of all, what a beautiful homestead. Love it. Body warrants and search warrants are different. No search warrant they can not pass the gates, if the mailman can't walk up to the door the property is not considered public domain or usage.

    A proper search warrant must accompany the arrest warrant, period! You can demand to see the search warrant prior to them entering. You also can demand that your attorney must see the search warrant prior to them proceeding onto your property, the Constitution is very clear on this. What they have done is completely illegal and must be prosecuted both criminally and civilly. The only thing that will change their behavior is our resistance to tyranny. Did you make a difference by talking with them? No, not in this case! A badge does not give them the right to violate God given Constitutional rights and laws. You have the right to protect your life, the lives under your charge and your property. These scumbags are nothing but thugs with a badge. Let me ask...if these men had been a group of criminals what would you have done then? How you would react to criminals breaking into your property and home should be the very same reaction to these criminals with badges. At the least I would pursue criminal charges and sue them for all I could get.

      Actually, an Arrest Warrant does allow the police LIMITED authority to enter your home. But, they must have a reason to believe the individual is inside (like a Car in the driveway belonging to the person they are looking for, etc.).

      GySgt 0317 Actually, that is not true. I've been through that myself. Had ATF, marshalls, and local police come looking for my brothers. Had arrest warrant, but no search warrant. They made the 3 hour drive only to leave empty handed since I did not allow a search.
