DA deliberately charged murder 1 knowing he couldn’t prove premeditation. The jury had no choice but to acquit. The weren’t given the option to convict on non premeditated murder or manslaughter. That was a corrupt cover move by the DA to get the cop off the hook.

One big thing that REALLY alarmed and flat out scared me wasn't even mentioned in the video. The "officer" literally turned the gun and pointed it at the innocent bystanders, and ordered everybody to back up after the man had been shot. Yelling at a crowd is one thing, but this guy actually used his weapon in a position of power and intimidation against a group of innocent people.
Depends on state. Some states actually do allow you to defend yourself against police legally. The only issue is, it will likely still cost you your life. Best way to get back at the police is let them do dumb shit and take them to court. Win your lawsuit making some decent money and likely get the officer(s) fired as well.
My thoughts exactly. I cannot imagine that if I was there I wouldn’t have attacked the cop from behind. I wouldn’t have done any harm but I absolutely would have grabbed the guy and pull his arms away so that he didn’t kill the man. I would have also asked my friends to grab the suspect so that we could just keep both parties secure and safe until back up arrived. @@ThABaTToSai Premeditation is one of the fundamental elements that constitutes a 1st degree charge/conviction. The element of premeditation is clearly missing here. Ultimately it's up to the prosecutor to "pursue persecution" or not, depending on what the charges are and if the evidence supports such a charge. Because there is no evidence to support premeditation the "1st degree" can never be applied to get a conviction.

This is one of the saddest most infuriating situations that I've ever seen. That cop is a true danger to society and should be doing no less than 20yrs and possibly even life. I know some may think that is steep but think about how quickly he escalated the whole situation. The victim was never a threat and seemed like a decent guy. I always support LEO when they shoot to defend themselves but this was not that situation. As iterated by other viewers, condolences to the family and I hope they get whatever limited justice is available to them.
I live right near this area and Id say one in 10 cops around here is like this guy as far as aggression and confrontation level(just the attitude not the actions), but 5 out of 10 are cool as shit and the other 4 are decent.
Ya this officer was totally wrong for shooting him there. He didn’t present as any sort of IMMEDIATE threat to where shooting him was justified. If he would have just listened he would have been fine and if he hadn’t done any wrong doing the police would have let him go.

They charged him with PREMEDITATED murder… this incident doesn’t meet that standard. The jury likely wanted to convict him, but couldn’t on that charge. The state was protecting him.
As a retired Officer I'm ashamed of what this Officer did. The Officer deserved to go to prison...period. This incident just made it that much harder for good cops to do their job.

I remember as a 16 year old kid , being able to handle a drunk very easy with my bare hands. This guy was Older and bigger, But he was drunk. This Cop had to use a Taser and Gun. What kind of Hand to Hand Combative training did he not get?

I’m a 38 year old Black man who lives in a small city in Pennsylvania. I watch this channel religiously. Videos of anyones death saddens me, but this video particularly so. For the record America, every Black person is not a criminal, and in fact, the vast majority are law abiding citizens. Based on my experiences many officers are fearful of the communities that they are assigned to police. They typically have this war time mentality of go home at all costs, which is irrational to say the least. I think all police officers should be required yearly to complete a predetermined amount of meet and greet hours with members of the communities they serve. This would vastly improver community relations by ensuring officers and civilians know each other on a more intimate basis. Can anyone imagine how this encounter would have turned out had the officer known anyone on scene on a name and face basis, or vice versa? Chances are the encounter would not have escalated they way that it did. -Peace and Love

This is the first time ever I’ve heard anyone speak about Taser deployment and prong spread. No one EVER talks about it. So many times Taser gets deployed and it’s too close and the prongs aren’t far enough apart to work effectively and it escalates the situation so much worst than it has to be. They didn't charge him with lesser charges, because the DA knew M1 would be hard to prove in this case. M1 with manslaughter, the manslaughter would have stuck, and the DA knows this.

Absolutely not the jury's fault here. They charged him with murder 1, that's completely insane, there is nothing remotely close to murder 1 here. It's as if the prosecutors did it on purpose to intentionally let him walk free. That cop didn't even know that man's name. Charging a serial killer with murder 1 instead of 2 or manslaughter is risky, much less a cop who was placed in a situation during his regular duties as a police officer. The fact that the jury was all white is also a red flag that the prosecutors were up to some shady business.

The cops was only charged with murder 1. Ridiculous charge as that is premeditated and impossible to prove in court. This seems like absolute corruption by the prosecutor knowing this charge would not hold up in court. However, only charging him with murder 1 allows new charges of Murder 2, Manslaugher, Assault with a deadly weapon, etcetera without it being double jeopardy. BRING NEW CHARGES!!! This is INSANE!
@@AkronJosh take your own advice. You can't be tried for the same crime twice. Meaning he can't be tried for murder 1 twice. But he can be tried for the other crimes I stated. This is the reason prosecutors usually charge a defendant with multiple charges for the same crime. Because if they don't get a conviction on one, they will likely get a conviction on a lesser charge.

I am an officer for almost 5 years now and can say this was horrifying and unjustified. This officer should've been vetted out before being hired. This is NOT every officer or even most officers. Most policy enforcement officers escalate most situations. Espically when their ego is challenged and aren't recognized as authority within the situation. Egos with a badge and government authority are deadly weapons.
Well quite frankly ANYONE in a position of power who doesn’t get the treatment the want when giving a command acts like that. Lawyers, doctors, cops, politicians, Teachers. The list goes on and on. Not just a cop issue. And not all cops act like that.
I support law enforcement but like everything else it's not just black and white. proper vetting, training and oversight is needed. As a troubled youth I had my share of encounters. some horrible others not. I've had a rifle shoved in my face at a house party that was raided and threatened to kill me for talking... I was 16 at the time. But Also had police bust me and friends for smoking weed in a parked car when it was illegal everywhere.. It was during senior year when we were able to leave the school for lunch. Officers were calm collective, gave us a warning and told us to go back to school.

One big thing that REALLY alarmed and flat out scared me wasn't even mentioned in the video. My thoughts exactly. I cannot imagine that if I was there I wouldn’t have attacked the cop from behind. I wouldn’t have done any harm but I absolutely would have grabbed the guy and pull his arms away so that he didn’t kill the man. I would have also asked my friends to grab the suspect so that we could just keep both parties secure and safe until back up arrived.

Premeditation is one of the fundamental elements that constitutes a 1st degree charge/conviction. The element of premeditation is clearly missing here.
Ultimately it's up to the prosecutor to "pursue persecution" or not, depending on what the charges are and if the evidence supports such a charge.
Because there is no evidence to support premeditation the "1st degree" can never be applied to get a conviction.
I agree, they went after the most extreme punishment and with that comes the most righteous prosecution. They could of gone after 2nd degree murder and won this case without any problem. Every jurisdiction knows this. Make one wonder why. Seems a lot out of character for a prosecution for sure.

I’m a 38 year old Black man who lives in a small city in Pennsylvania. I watch this channel religiously. Videos of anyones death saddens me, but this video particularly so. For the record America, every Black person is not a criminal, and in fact, the vast majority are law abiding citizens. Based on my experiences many officers are fearful of the communities that they are assigned to police. They typically have this war time mentality of go home at all costs, which is irrational to say the least. I think all police officers should be required yearly to complete a predetermined amount of meet and greet hours with members of the communities they serve. This would vastly improver community relations by ensuring officers and civilians know each other on a more intimate basis. Can anyone imagine how this encounter would have turned out had the officer known anyone on scene on a name and face basis, or vice versa? Chances are the encounter would not have escalated they way that it did. -Peace and Love

This is the first time ever I’ve heard anyone speak about Taser deployment and prong spread. No one EVER talks about it. So many times Taser gets deployed and it’s too close and the prongs aren’t far enough apart to work effectively and it escalates the situation so much worst than it has to be. They didn't charge him with lesser charges, because the DA knew M1 would be hard to prove in this case. M1 with manslaughter, the manslaughter would have stuck, and the DA knows this.

Absolutely not the jury's fault here. They charged him with murder 1, that's completely insane, there is nothing remotely close to murder 1 here. It's as if the prosecutors did it on purpose to intentionally let him walk free. That cop didn't even know that man's name. Charging a serial killer with murder 1 instead of 2 or manslaughter is risky, much less a cop who was placed in a situation during his regular duties as a police officer. The fact that the jury was all white is also a red flag that the prosecutors were up to some shady business.
Hearing the shock and horror in his friend's voices is heartbreaking. This power tripping POS just murdered their friend right in front of them.

Very dangerous type of people to be around, so much in fact that I'd flat out refuse to go on patrols with them. The cops was only charged with murder 1. Ridiculous charge as that is premeditated and impossible to prove in court. This seems like absolute corruption by the prosecutor knowing this charge would not hold up in court. However, only charging him with murder 1 allows new charges of Murder 2, Manslaugher, Assault with a deadly weapon, etcetera without it being double jeopardy. BRING NEW CHARGES!!! This is INSANE!

This is the reason prosecutors usually charge a defendant with multiple charges for the same crime. Because if they don't get a conviction on one, they will likely get a conviction on a lesser charge.

I am an officer for almost 5 years now and can say this was horrifying and unjustified. This officer should've been vetted out before being hired. This is NOT every officer or even most officers. This was clearly a case of excessive force. This should not have happened. Condolences for the friends and family!

Most policy enforcement officers escalate most situations. Espically when their ego is challenged and aren't recognized as authority within the situation. Egos with a badge and government authority are deadly weapons.
Well quite frankly ANYONE in a position of power who doesn’t get the treatment the want when giving a command acts like that. Lawyers, doctors, cops, politicians, Teachers. The list goes on and on. Not just a cop issue. And not all cops act like that.
I support law enforcement but like everything else it's not just black and white. proper vetting, training and oversight is needed. As a troubled youth I had my share of encounters. some horrible others not. I've had a rifle shoved in my face at a house party that was raided and threatened to kill me for talking... I was 16 at the time. But Also had police bust me and friends for smoking weed in a parked car when it was illegal everywhere.. It was during senior year when we were able to leave the school for lunch. Officers were calm collective, gave us a warning and told us to go back to school.

I'm in shock . I just can't believe this . I don't know how this guy became a police officer . So much is wrong here . First I believe who ever was his training officer is partly to blame . This officer learned this behavior from someone . He didn't even get any FACTS about what happened . He just went right after that guy . Talk about letting your EGO control you . This officer let his EGO control him . And his training officer should have noticed his behavior . Another thing is I bet other officers in this department act the same way . I've seen way too many departments with officer EGO problems . And then the D.A. definitely dropped the ball on the charges against the officer . He knew the jury would have to acquit him . With each charge the jury is given instructions on what proof is needed to find the defendant guilty for those charges . The D.A. set this up so the officer would get away with MURDER . Because that's exactly what this was MURDER .....
I hope this haunts all those who made it easy for this officer to get away with MURDER . And I really hope that officer suffers for the rest of his life .
