Also approved K1 petitions are only valid for 4 months, so most applications that are sent back from the embassy with a revocation recommendation, by the time a decision for an appeal would be made, the petition would’ve have already expired and instead of receiving a appeal decision letter saying yes we will approve this petition again or no we agree with the embassy and will deny it, you will receive a letter saying the petition has expired and no appeal decision can be made on it.

I had a question if this gets denied can I Go to Vietnam and marry her there and then apply for a spousal visa. Someone said I had to wait two years for this. I’m afraid this might happen to me. We have a lawyer and got a notice that they intend to deny.

You need to have met in person at least once in the two years before you apply for your K-1 visa.
Even after filling the K1 visa you need to have met atleast once, if you havent your visa will be denied on grounds of petition expired.
