    I’ve been through the mill, 2018 rear end accident immediately had L4/5 lumbar fusion, then straight after had to have a sacral nerve stimulator due to damage to the nerves controlling the bladder, then a multilevel cervical fusion months of Epi Dural, nerve blocks, then a spinal card stimulator year later removed as it didn’t control pain replaced with an inter the cal pain pump then a meniscus repair for knee injury, after that a total knee replacement and another lumbar L5/S1 Laminectomy then had to have the inter the cal pain pump removed due to complications, more chiropractors and physical therapy more epidurals in cervical spine and physiotherapy and now awaiting carpal tunnel surgery in both arms all from the accident in 2018 insurance offered a settlement in 2021 which was declined, EMG showed permanent nerve damage and Radiculopathy in cervical and lumbar spine, do you think this is a serious injury supported by 5 years of ongoing medical treatment is a high value case given fault is 100% at the at fault driver

    What are your thoughts on an ACDF surgery and NYS Workmen’s Compensation settlements?

      Usually that type of surgery will result in a substantial third party lawsuit settlement as well as a section 32 workers comp settlement

    Can you talk about the SI joint fusion surgery and a possible settlement do to a truck rear ended accident also had done block injections and RFA to both cervical and lumbar but still in pain as today

    Then they tell you start with epidural injections to see if he helps and if it doesnt time for an operation today in pt seen a lady that had cervical and a guy with lumbar

      Yes often people start with PT and if that doesnt work they try epidurals

    I was rear ended by a 4th offender drunk driver (BAC .24). work comp. 1 million auto insurance on the drunks car. i had to have my forehead reconstructed from the damage and now going in for an L4L5 fusion and laminectomy. can you ever seen settlement amounts on cases similar to this? And if so, what were some of the outcomes?

    I'm going through this now with my 3 herniated cervical disc I'm having shots on Friday lawyers says to get them early my question is why what happens after you retain a lawyer and you are just starting treatment what are yall doing while your client is starting treatment do we have to wait until treatment is done before you start what is going on in the meantime just curious

      They should be building up the rest of the case. Liability. Also perhaps filing a lawsuit as it takes time to get deposition stage

    If I were in a car accident outside of work, which caused a herniated disc. So bc of it, I could no longer handle my job duties (lost my job) but during recovery another job calls to hire me (higher pay) but I had to turn it down bc it’s difficult for me to bend/twist my body,stiffness in back/neck. So can I sue for future lost wages on new job that I missed out on because of injuries to neck and back? (Accident happened in New Jersey on route 4)

      Btw the new job would’ve been a union job with union pay & benefits that I missed out on smh

      Yes you can. You just have to show you lost your job bc of your injuries and that your injuries prevent you from doing the new job. Usually this is done through your doctor and an economist

    Mr. Frekhtman, what are your thoughts on Functional Capacity Exams for car accident cases? I was thinking a FCE could paint a better picture of my chronic neck pain than the IME.

    C6 is where I think the radial nerve comes down which causes radial nerve palsey?

      Yes I think that’s correct. A few levels affect the radial nerve from c5 to c8

      C4-c7 fusion about 4months now I have more pain on the neck next week Dr.ll see how fusion is going x-rays. But this pain make me crazy.

    What if they refuse to pay for the injury and you go back to work with restrictions pending surgery and paying for the surgery threw your insurance you have at work

      It may depend on the laws in your local jurisdiction. In New York its fine to use health insurance or a lien to pay for surgery if for example no fault insurance refuses to pay

      Yes absolutely. There was a recent case with an $8 million verdict for a rhizotomy

    What if someone has a *trial* date. Well, more like *jury selection* and also, has a *conference settlement* right before. Why are those events taking place like that?

      That’s pretty standard. They try to settle the case to avoid a trial and if that doesn’t work out you go to trial to have a jury resolve the dispute

      @@AttorneyArkady ok, last question: if you have jury selection right after the conference how long can you expect the *actual* trial date? A ball park number could be perfect.

      @@notarant5107 Depends on which court as they all have their own rules. But in NY if we have a settlement conference it takes 30 min and if it doesnt settle the judge will say go pick a jury so trial starts immediately often the same or next day. Then once you are done picking a jury you wait 1-2 days to get assigned a judge. You see that judge who may try to settle your case again and if not start the trial so its all pretty much continuous without interruption except for brief pauses. Jury selection is actual trial as it starts the trial

    When you're saying the nerves get thicker is because the nerves are swollen from all the bone pressure and caused a lot of pain. I just had a C7 cervical fusion, I wonder how much a case like this is worth. According to the MRI I also have a damaged disc on my left lower back as well all from an auto accident I had a year an half ago. Any thoughts how much this case worth? I am from California. Thanks!

      Sorry to hear that. Cervical fusion can be worth a tremendous amount. Just settled a cervical fusion which included C7 in the Bronx and it was $3,500,000. They are all different. A lot depends on who is handling the case. Trial lawyers who go all the way to verdict get more than lawyers who just settle for whatever the insurance co offers. For example in our case the first offer was $100k and even when we went to pick a jury and start trial they were only at $450k.
