The difference is that I have permission to be on NWPCO and SMART property with a signed release of liability from both. Also I knew that a train was comming and the trespassers did not know a train was comming. The trespasser had no idea of what is required to be Safe around trains.
The point is that they should get permission to be on the Right Of Way. They had no clue as to when a train was comming and what direstion. The train could have come around the curve and found them on the tracks. I had to point out the light on the tracks heading in their direction.
