    I will always find it amazing how a " well trained dog" can supersede the spirit of the fourth amendment

      Further, how can the canine testify? What is the record for false positives? How often is the dog recertified?
      Can I train my own dog to search around vehicles owned by cops? It's not a violation of the 4th so what's the problem?

      I know people who train these dogs. They come out of training and are ruined within weeks.
      They go from being rewarded for a proper search, whether or not they find something. Then once on the force, if they don’t alert, they’re stuffed into the back of the vehicle rudely. Whereas a false positive is rewarded. How long does it take for the dog to learn that alerting is the way to go.
      A friend of mine had her car torn apart because she had a female dog in heat in the vehicle that got the sniffer dog very excited.

      63.5% successful detection rate inside the car and 57.9% success outside the car. Marginally better than random guessing.

      Dogs shouldn't be used in law enforcement. When an Officer is running after someone, he understands that he's foot chasing a suspect. A dog's instinct doesn't discern between a suspect and prey. If the "suspect" is too hard to catch, the dog could instinctively switch to an easier target, like an innocent kid or an old lady. This happens too often with dogs that are rewarded for hurting people as part of their training. Municipal governments are reckless and barbaric.

      And using the dogs to do so pisses me off. I grew up helping my parents train dogs like this and they stopped selling dogs to police dept's.due to crap like this, along with the dogs tend to get abused or neglected and treated like equipment to some cops - Cops have a very high rate of anger management and family abuse issues, I think they have a hard time turning off the 'abuse the civillian' switch when they get home and just beat the wife and kid and pets to make the time go by before they can get back out there.

      @@TCK-9 Using dogs as drug sniffers pisses me off in general. As we saw in previous incidents, they can command the dog to make the same move as if they sniffed something. So if they want to get someone for nothing, they can make the dog alarm. This is BS

      There's a big difference between a cop who can emotionally handle the job, and is probably just following bad practices as told to him by his superiors, and a cop who can't keep his emotions/biases in check. The former can be mostly fixed with better superiors and some retraining.
      I'd like to see more D+'s: the highest possible failing grade, but I understand ATA's logic

      I would agree ATA is too lenient. I don't expect LEOs to know the subtle nuances of the law (even judges retire to their chambers to look up statutes), but If an LEO illegally performs a common basic task (here illegally extending the stop), it should be an automatic F.

    We are at a point where every complaint against a cop needs to be put in front of a jury of our peers because they can't seem know the laws and also need to be forced EVERYONE OF THEM to do the schooling needed to be an officer. WHY THE HELL IS IT 4 YEARS FOR A TEACHER AND 6 WEEKS FOR POLICE WORK legally

      Who said they don’t know the law? Any constitutional violation would have to be hashed out by a court. It’s FAR from clear they violated anything. It’s entirely possible another officer beyond the officer who made the stop was running checks, and preparing a warning while the initial officer assisted with the stop. There’s equally a strong possibility everything that happened WAS constitutional

      You can blame the “training” for why many police officers are like this. They are trained to follow orders and policies, not the law. And this is the problem with police today.

      Exactly, pull you over for the pettiest of reasons just to try and invade your personal space with a vehicle search. It’s a disgrace that police are allowed to do this. None of this mans actions says he possibly has drugs but yet they can’t just give him a ticket and move on. And of this man wasn’t recording I guarantee you they would have pulled him out of the car and arrested him for “obstruction”.

      Especially when RUclipsrs like We the People U say 'it's our job to help educate the public and law enforcement' -since when did it become a civilian's job to educate LAW ENFORCEMENT? That's their job, and the police academy's and bcs those institutions continue to fail, it should not fall on the shoulders of civilians who are already targeted to then be ready to educate.
      If other 1st world countries don't have the same problem, it isn't because their civilians are going around educating law enforcement when they're stopped and detained for no reason

      I've had to know the law better than court appointed attorneys because none of them would fight for me or somebody else that I knew so yeah that's how it is unfortunately. And yes you can get arrested even for the police lying and then you'll have to fight your way through that with terrible terrible attorneys I even had a paid for attorney that was just awful didn't care about the law and clearly was working with a prosecutor and they were all hand and hand working together against me which is absolutely despicable especially when it costs thousands of dollars and the corner pointed attorneys just didn't care and you know if a court appointed attorney doesn't do their job you can get the case overturned but when it's criminal you really don't want to go through all that because it's scary and it's just awful what police and prosecutors do to regular people especially when they're lying.

      Journalists need to look into law enforcement academies. I suspect some are much worse than others.
      How much time does each spend on teaching law, and how much on target practice?
      Why don’t LEs shoot fleeing vehicle TIRES instead of drivers’ heads? Especially when they’re standing right next to the vehicle. There’s no excuse.

      Right, these rulings are riddled with contradictions... When law enforcement agencies openly violate protected Constitutional Rights, excuses are made over and over in rulings... This is the ongoing criminal behavior of law enforcement, thus protected by the U.S Courts... The man's personal dashcam is imperative... This is a case of damn if you do and damn if you don't, especially when law enforcement agencies can and will afflict harm and/or death to a person that fully complies and step out of their vehicle was asked to do so... Not sure if that even matters to ATA🤷‍♂️

      Traitors? I mean, sure, no one is 100% loyal to their own country, social class, beliefs, etc, at all times, but the word traitor should be reserved for people more heinous than ignorant/bad justices. That's my opinion, at least.

    ATA I’m so happy to have you review a k9 search. I was a K9 LEO for 6 years with the US Army and specialized in all of the legal aspects and court precedent of k9 in the US. You definitely covered a ton of the content surrounding this content.
    I know you don’t comment on details that are option based and focus on facts, I would like to add that in my 6 years of experience where I worked with all layers of k9 (USSS, DHS, DOD, FBI, State, Local, ATF, & TSA) and in my experience, local k9 are some of the most undisciplined and guys out there. Handlers like this gentleman has obviously let his weight go, and hovered over his dog to stay focused on the vehicle, and in my professional opinion is likely to have undertrained an effective dog. Most local and state k9 have false positive rates somewhere around 50% or above, meaning if they were to search 10 blank areas that have never been exposed to narcotics, they would have 5 false alerts. And on the opposing side they miss quite often because they never train with street obtained narcotics. These handlers tend to be unsupervised. I urge people to challenge their LE k9 if ever going to court and request the dogs records because it will expose this if they are doing any at all.
    The DOD has some of the strictest k9 standards in my opinion. I felt as though we were the best of the best. Marines were maybe better than army dogs, depending on the individuals but nevertheless DOD had it right.

      Excellent post . A canine sniff is like a coin flip. There needs to be a database on each dog and false alerts. Undisciplined handlers is an understatement. I’ve seen a cop call for a dog. The dog circled the car 5 times never alerted. The handler gets angry and keeps making the dog circle the car. Still doesn’t alert. The cop THEN calls in another dog. The second dog alerts after the second time around. Guess which dog the cops went with.

      Good catch. FTP but he did say "if" a few seconds later (that's what I heard). He did say the real situation out loud. The dog will falsely alert far too often. Sadly, as w/ far too many Americans, pigs have no verbal skills.

    They ask you to exit the vehicle for "officer safety", yet when there's multiple armed agents outside my car telling me to get out, i can't say no for "citizen safety". I understand their safety, and all the unknowns that are intailed with dealing with hundreds of random people every day. But we as citizens deal with hundreds of randoms every day also. Safety should be a 2 way street. Seems nothing more than an escalation tactic to me. Good show!

      They need different training too. These police are trained to ignore the law and do what their superiors tell them to do. Why do you think they rarely get punished for violating the law like they do? Because you can’t punish someone for doing what you tell them to do. This is also why they hate being recorded by us.       ​@@ianbattles7290they used to be a well known speed trap. 18:07 I guess they have graduated to civil forfeiture as it brings in more money. Hated the otherwise great area because of it. You had to drive 10 mph below the speed limit, watch for sudden changes in signage that was obscured and be going the new speed as you passed the sign. I dont speed but enough of my friends and people on the roads got tickets for not going from 55 mph to 45 in 2 seconds.

      They want him out of the car so that they can search him, for "officer safety", and then search the car to justify the arrest while claiming to smell alcohol\marijuana and performing road DUY tests. Next thing you know your car has been ransacked in a pointless search, and you have DUY charges while stone cold sober and probably a few resisting arrest\obstruction of justice charges .

    They can literally just say you weren't wearing a seatbelt and then everything they do after is all justified according to the supreme court. Even if you were wearing it they can say "oh i thought he wasnt" and theyll say they acted in good faith. Then you better have an interior camera that can prove you had it on, but still the traffic stop is "reasonable" because of "good faith".

    Here's a police/security secret: K9 handlers put more weight on the *person's reaction* to the dog more than the actual results of the dog's sniff. Handlers know they can make the dog alert when there is nothing and dogs may not alert when something is present. But if the suspect shows signs when the dog shows up (like dialated pupils, sudden shallow breathing, and other signs of nervousness/fear/adrenaline) handlers just force the dog to alert and use that as justification to search further.
    School police, concert/festival security, city/state police, and even Homeland Security (TSA, immigration, border patrol, etc) all take advantage of visual cues you give them to single you out for increased screening.

    the issue is that he was pulled over for a traffic stop. Extending the length of the stop beyond what a reasonable time to write the ticket is a second seizure that requires reasonable suspicion..     I saw a recent video where a canine was brought in and did not signal anything. The cops immediately brought in a different dog that allegedly signaled to give cops probable cause for search of the vehicle. Nothing illegal was found.

    This is a normal occurrence in that particular area. The Cumberland police force believe they are big bad drug busters and will pull over anyone with out of state tags or even in state tags if the address comes back from being an hour or more out of their area. Just look deeper into the department, they’ve had tons of complaints.

    The entire argument that a dog sniff isn't a violation is garbage. I feel that unless there is probable cause having a dog sniff for shit, which I might add, has a far higher failure rate than a successful one, governments shouldn't be able o have a dog sniff. The fact that there is a higher failure rate than a success rate should be considered by the supreme court. But they have to have some authority over us.

      Dogs do have incredibly sensitive noses, I'm completely sure they are more than capable of detecting just about anything in a car, from drugs, to money, to weapons, you name it, and I would absolutely support using dogs for searches, just as soon as you get that dog on the stand and he can testify about what he smelled/found. Until then, it's just a "that was easy" button for getting around the 4th amendment.

The small town cops and sheriffs run the towns and hassle the public and abuse their authority regularly. Just drive around Carroll County, the Sheriff department has turned the county into a police state. I hate driving through that county.

      We have seen too many videos where even the wrong look or not kissing a cops behind is a way for some (racist) cops to escalate basic stops into violent arrests.
      People getting fed up with excessive stops, especially those who have a "you do not belong in this area" type of feel behind it, happen way too much.
      I live in Europe, and in over 25 years had exactly, one! stop happen to me. Ask the average black/hispanic person in the US their average stop rate... Its not going to be 1 in 25 years.
      When people do not react/stand for their rights this misuse behavior became so routine, that the laws protecting people vanishes.

      Yes, lock the door. But you should always roll the window down (unless you have been drinking or smoking pot). It shows that you are co-operating.

    Police should be REQUIRED to keep records of how often there dogs supposedly alert vs how often there are no drugs, pointing to false alerts by the dog or cop.

    My biggest concern with "dog sniff" is they do not keep track of when they do a dog sniff, if the K9 "hits" or doesn't "hit" and how many times when the K9 does hit and they search and found nothing. This is all information that should be recorded and tracked.

    If Mr Love had got out of his car he would have been cuffed and possibly arrested on some made up charge, even beaten. Staying in his car may have been his best option, even if he legally obliged to exit his vehicle.

      If he would have gotten out of the car he would have been cuffed and they ABSOLUTELY would have let the dog INSIDE THE CAR even though he DID NOT give consent.

    The Civil Rights Lawyer mentioned in a recent video that it's not the case that cops can order you out of the car as a matter of routine but many don't understand that. Apparently there has to be some legitimate officer safety reason. But it wasn't the main topic of the video and he didn't expand on it. I'd like to see a video expanding on when cops can make you exit the car.

      All he has to do is say "Due to my years of experience, I noticed some furtive movements that allowed me to ascertain that he was carrying some kind of implement which could of hurt me or my fellow officers, so I asked the subject to exit the vehicle" (they always talk like that, think it makes em sound professional or something) and then it's reasonable. The court is on their side, not yours.

    I’m glad the law seems to dictate that a dog sniffing around doesn’t violate your rights because they don’t enter the vehicle.
    Basically they’re saying you’re allowed to r*pe an underage girl so long as you never penetrate them. I’m glad to hear that… really makes me feel safe and protected and served!

    This whole chain of action has to be brought to an end. People need to be left alone while driving unless there is reckless driving involved. I hate paying police to harass people.

    My neighbor is a cop with a police dog. The dog is a drug dog. My neighbor told me he can give a command that would make the dog react as though he detected drugs. My neighbor showed me when i asked to see

Like how tf do cops being condescending, extending a stop, misunderstanding the law, focusing more on finding drugs vs traffic stop, and not approving of said things but saying hey it’s legal AND saying it’s open to officer abuse. Idk how you can defend this. Sure yeah it’s the law but it’s not okay. ATA’s ranking aren’t good frankly… this is why Lackluster is the better channel

Lots of people dont want to do that so they can project an image of themselves being right,try it sometime with time stamps,you might be surprised that your judgement might be different then waiting till the end,thanks for the reply
