Regardless of age, and contrary to popular belief and desire - taking photos of people in public, isn't illegal. Unless he's taking photos of parts of them that are private, or where there is expectation of privacy like a bathroom stall, then there isn't much that can be done about it. People seem to have this misconception that you have to give permission for a photo, or that you cant take photos of kids, or that somehow being outside is private, and get all up in arms over it but that's just how the law works. If you don't like it, then petition the county and state you live to make legislation that bans photos of kids in public if the person is closer than 20 feet and not related to that person. Then hope that it does national and hope that there is enforcement of it. Otherwise, expect a lot of people, creepy or not, to take photos of your family, you, your kids or whatever. So long as it isn't sexual, it's legal.
This just sounds like you're defending his behavior by going, "Well it isn't illegal so get over it." Just because it's not illegal, doesn't mean people can't react and scream at someone for doing it. Expect to get yelled at and called out when you take photos/videos of random people.
